Ex-Patriots Assistant Sends the N.F.L. Eight Tapes

By GREG BISHOP, New York Times

Published: May 8, 2008

A former New England Patriots employee has sent the N.F.L. eight videotapes showing the team recorded play-calling signals by coaches of five opponents in six games between the 2000 and 2002 seasons, in violation of league rules.

But the group of tapes does not include video of the St. Louis Rams’ walk-through practice the day before the 2002 Super Bowl. The employee, Matt Walsh, had been linked to such a tape by news media speculation.

Walsh emerged as a pivotal figure in the spying controversy that enveloped the Patriots last season after they were caught taping Jets defensive signals in the season opener.

Walsh, who worked for the Patriots from 1997 to 2003, agreed to turn over the tapes and other evidence by Thursday under an agreement reached last month between lawyers for the N.F.L. and Walsh. The agreement indemnifies Walsh from all future legal fees.

Walsh’s tapes show that the Patriots recorded the signals of offensive and defensive coaches in regular-season games against the Miami Dolphins, the Buffalo Bills, the Cleveland Browns and the San Diego Chargers and against the Pittsburgh Steelers in the 2002 American Football Conference championship game. In that game, the tape has been edited to show Steelers coaches signaling plays, followed by two different camera angles of the actual plays that were called.

The New York Times obtained a list of the Walsh videotapes. The information was later confirmed by Walsh’s lawyer, Michael Levy, from the Washington offices of McKee Nelson.

The N.F.L. declined to comment Wednesday evening because it did not have the tapes in its possession.

The Boston Herald reported the day before this year’s Super Bowl that a tape of the Rams existed, citing an anonymous source.

Walsh does not possess such a tape, Levy said.

“Mr. Walsh has never claimed to have a tape of the walk-through,” Levy said in a telephone interview. “Mr. Walsh has never been the source of any of the media speculation about such a tape. Mr. Walsh was not the source for the Feb. 2 Boston Herald article.”

On Tuesday, Walsh is scheduled to speak with Commissioner Roger Goodell and Senator Arlen Specter in separate meetings. Walsh could provide additional information at that time, including how the taping worked, how extensive it was, which Patriots employees were involved and the significance of the evidence he handed over.

The first tape is dated Sept. 25, 2000, from a game the previous day. The last is from Sept. 29 two years later. All the tapes are scheduled to arrive at N.F.L. offices Thursday morning.

Levy would not say whether Walsh was behind the camera on each tape, but confirmed that Walsh obtained the first seven tapes during his time in the Patriots’ video department, which ended after the 2002 Super Bowl.

The last tape, in September 2002 against the Chargers, was shot by someone else after Walsh left the video department for a job in the scouting department that ended in early 2003.

The Chargers tape shows raw footage, Levy said, of the San Diego coaches from the Patriots’ sideline, followed by a shot of the scoreboard showing time, down and distance. The tape contains no footage of actual plays during the game, only the sequence, which the Patriots could match to play tape.

The other seven tapes are more sophisticated. They show shots of the opposing coaches’ signals, followed immediately by a shot of the play, usually from the end zone camera, Levy said.

The tape from the A.F.C. championship game is the most extensive, showing two angles of each play.

Goodell has left open the possibility that additional evidence will lead to additional penalties against Coach Bill Belichick and the Patriots. After the Jets game, Goodell levied a total of $750,000 in fines and docked the Patriots a first-round draft pick.

After this year’s Super Bowl, Goodell met with Specter and revealed for the first time that Belichick’s illegal signal filming dated to the beginning of his tenure with the Patriots, in 2000. Some accounts said Belichick admitted to taping defensive signals, others just signals in general.

At the Super Bowl, Goodell said of the Patriots’ practice of taping, “I don’t think it taints their accomplishments.”

Under Belichick, the Patriots rose from one of the league’s middling teams to its best, winning three Super Bowls in four seasons. Last season, they went undefeated until losing to the Giants in the Super Bowl.

Based on a win-loss tally from games after the ones on tapes provided by Walsh, the Patriots went 9-6 against the Dolphins after the first taping. They also went 12-1 against the Bills, 3-0 against the Browns, 4-1 against the Steelers and 3-1 against the Chargers. This included three victories and no defeats in the playoffs.

“We consider the tapes of our coaching staff during our games against the New England Patriots to be a nonissue,” the Steelers chairman Dan Rooney said in a statement released in February.

Telephone messages to the five teams left Wednesday night were not returned.

Since Belichick’s first season in New England, when the Patriots finished 5-11 in 2000, they have gone 86-26 in the regular season, a .768 winning percentage. It remains unclear whether the league will make the tapes public. During the initial investigation into the Patriots, the league accepted seven tapes gathered by the team, dating to 2006, while collecting a written promise that it possessed no more. The N.F.L. destroyed the tapes that the Patriots turned over.

Under the indemnity agreement, Walsh’s lawyer gets to keep one copy of each tape, but cannot release it without the league’s consent.

Lets see if Goodell has the balls to further the punishment
I doubt it. From what I can tell, the Pats punishment was feretted out based on admitted transgressions from the year BB got to NE up until the Jets game last season (basically 2000 - Week 1 2008). So IMO, unless they found something different than what was already admitted to I doubt they will do anything further to discipline the Pats. If they found more evidence AFTER the Jets game from last year (basically Week 2 heading forward) that would be different, but I believe the BB blanket statement that they have been doing what they were doing for years will not initiate further punishment.Obviously I have not viewed the tapes, and perhaps they contain other violations in other areas (which would again be different than what NE has already admitted to).

I think what Walsh might say to Goodell is potentially more of a problem for the Pats than what is in the tapes he handed over.

Im looking for lawsuits at this point. The Boston Herald needs to be held fully accountable for its "Rams Walkthrough" story that completely ruined the SB for some of us before the game was ever even played. The actual loss was just icing on that horrible tasting cake. These 8 tapes dont sound any different than what New England has already turned in. I cant believe this knucklehead Walsh has been sitting on this stuff for 6 years.

not really. he's looking pretty much like a dope at this point. the evidence was the big thing here. the value of his testimony based on his deteriorating credibility over the past couple of months carries no weight whatsoever in my estimation.

There is new tapes of the Patriots illegaly recording other games.

This isnt the same as the Jets game. New revelations.

If you do something illegal in Sept of 2007, any punishment doesnt stop you from further punishment if you are found for doing something (even if similar) in 2002 or 2003.

If there is no new evidence I don't expect any lawsuits. The Pats are going to want this to go away ASAP. A lawsuit will only prolong this whole episode and I don't believe BB, Pioli and Kraft want anything to do with getting up on the stand...it would turn into a circus. That being said I do agree with you about the Herald, specifically that John Tomase's rep is going to take a huge hit locally. This was his story and many have speculated that it was very dicey to be running with it because it never appeared that he had multiple sources. It will not be easy for him to do his job this season in Foxboro. If this is all there is (i.e. more tapes similar to the Jets one) it would confirm what many on WEEI have felt. Once it became public that the Pats have been taping since the beginning of the BB era than Walsh lost his hand. Hopefully this is the case because good or bad I want there to be closure on this episode. Hopefully nothing new comes out next week but this story has had so many twists and turns there's not much that would surprise me.As an aside one thing I found very interesting (especially the timing) is that the NFL filed a suit against Comcast. The first thing I thought when I saw that was they're no longer afraid of Spector (or Walsh) having a smoking gun. I could be way off here but it does seem to be a little too much of a coincidence and I can't see why they'd be rattling Spector's cage unless they were confident this whole episode was being put to bed.

Except the Pats already admitted to those wrongdoings dating back to those years and those were included in their punishments. This is nothing new.

true, except for now there is actual evidence.

I'm honestly tired and bored with all of this and don't really care if anything new comes of it or not. But, man, how anyone can argue that this wasn't cheating is beyond me.

The Patriots have already admitted to taping other games since BB became coach...so there is no new revelation based on these tapes. too bad about having the AFC championship game on tape...I am sure that one will raise a lot of discussion.

How so? How did taping that game actually help them win THAT game?

I am sorry but to me having the playoff tape is just as bad as having a superbowl tape. Lets not forget that Pittsburgh was the favorite that season.

it didnt. people are still going to try and cling to something. anything. New England had all of their video 'priveleges' revoked this year, and roll off 17 in a row. it really killed them not having any film to win with.

The punishment wasn't enough, even if they told all at the start. Wasn't enough. No suspensions? One draft pick? Cheating for years and that's all you get.

Ridiculous.

Are you serious?? Hello have someone watching the signals then getting the pattern and relaying it to the coaching staff or the offensive players when they are on the sidelines?

If this is true, then it does call the validity of the Patriots Super Bowl wins into question. All we heard all year was, the Patriots were caught in Week 1, so their success in 2007 was not assisted by cheating. Okay, fine. I will go along with that. But if the tapes prove that they were also cheating in the years where they won Super Bowls, then that taints those titles, right?

The Super Bowl accusations, which has no foundation and cant be substantiated, involves taping a teams "gameplan" information PRIOR to the playing of that game. That is much different than taping during a game for use at a later date. If the Pats HAD all of the Steelers defensive signals in that game, they did a poor job on offense. That won that game on Defense and ST. They scored on a punt return and a blocked FG. That is what won them that game. That and Kordell Stewart throwing interceptions all over the place.I dont know why I even bother, some of you are so irrational about this it is ridiculous.

If this is true, Belichick needs to be suspended, and the Patriots given another significant fine. The league needs to send a message here.

There is no evidence WHATSOEVER that that occurred. You are making stuff up. Lets try to at least loosely stick to the facts.

Wishful thinking on your part, IMO. As I understand the previous tapes, they were a collection of shots of signals, pan up to the scoreboard, rinse & repeat. The edited versions would have been post production. Not during gametime and not covered by the rules that have been broken. The NFL has already stated they understood the practice of taping opposing coaches signals has gone on for the entirety of Belichick's tenure as head coach in NE, and that the punishment handed out previously was for the entirety of the infraction. These are more copies of the same infraction, and are covered by the original punishment. But y'all can keep hoping for more, and I'm sure y'all will complain if they don't get more, but most thinking fans understand this is more of the same. This will be over & done with for all but the handful of SP posters with an agenda.

Again, no new information. I love this word "cheat" in reference to the NFL. SF was "caught" this year trying to sign Lance Briggs before the Free Agency period. If it is found that they have been doing this for many, many years should all of their titles be eradicated?

If this is true, Belichick needs to be suspended, and the Patriots given another significant fine. The league needs to send a message here.
Why, exactly? This is 8 more tapes of exactly the same thing the league has ruled on. Are you one of the "it wasn't enough" crowd, hoping for double jeopardy?

If it taints it for you, then so be it. Everyone's entitled to an opinion. Id just like anyone who feels like yourself to sit down with Ted Bruschi and Willie McGinest or any of the rest of those guys and tell them how you feel. Tell those guys who gave it all up for months at a time that you dont think their titles really mean much. Love to be a fly on that wall. How can you go along with 17 straight wins last year with no tapes, yet think somehow all of the rest of those wins in other seasons were somehow dependent on some tapes? I dont quite get the logic there.

The punishment wasn't enough, even if they told all at the start. Wasn't enough. No suspensions? One draft pick? Cheating for years and that's all you get.Ridiculous.
You're right! Hang Belichick! Kick Kraft out of the league. Make Brady wear a tutu. Thats what we should do!!! :football:

That doesn't make sense. Why not tell them? What would they do? Kill me? There are laws in this country against that.I thought the punishment was for the Jets game too, not the entire BB era. So they've been cheating this whole time? Yikes! All those guys are cheaters? Wow. I'd tell them, and if you had integrity, you would too. There are things more important than winning, like doing things the right way. You should never cheat.

It shows that it wasn't an isolated incident and that Belichick blatantly violated the rules and the integrity of the league. It wasn't enough and now this should be proof enough that more punishment is deserved. And before you ask, I would be saying the same thing if it were the Steelers caught cheating. Personally, I'd be calling for ownership to fire the coach.

Put down the torch and pitchfork, man. We usually try to convict and punish based on what we can prove in this country.

Not in Roger Goodell's opinion. He knew the Jets game wasnt an isolated incident and he doled out his punishment knowing this fact. The punishment was excessive but what can you do. You ask any Patriots fan and I am sure they would tell you that they would have rather had Belichek suspended for 4 games than to have lost a 1st round pick. You are talking about allowing something that happened off the field to dictate your view of what happened on the field. No matter what taping the Patriots did, they still had to win all of those games.

So Goodell knew they were cheating for 7 years and that was his idea of punishment? Pathetic. It wasn't enough. And how do you feel good about rooting for a coach that resorts to cheating? Does integrity mean nothing to you?

Actually, no. Losing the Super Bowl ruined the Super Bowl for you. As for the Herald story, what makes you think it is incorrect? Someone else may well have that tape. Unless it was destroyed by the league, of course.

It wasn't enough and now this should be proof enough that more punishment is deserved. And before you ask, I would be saying the same thing if it were the Steelers caught cheating. Personally, I'd be calling for ownership to fire the coach.
I don't fully understand what you are arguing. The Patriots admitted to videotaping coaches' signals since the first game of the BB era in 2000, basically saying, "Yeah we've done that extensively throughout each and every season." So NE was not trying to hide anything (as far as videotaping signals) at the time BB met with Goodell after the Jets game. At that point BB gave a very weak excuse of "his interpretation of the rules" which the league did not concur with and Goodell punished the team for all related transgressions from the 2000 seasons to Week 1 of the 2008 seasons. Goodell also said he reserved the right to punish the team more if new rules infractions came to light. BUt from what it looks like at this point, the Walsh tapes seem to show what NE admitted to doing on a regular basis.Long story short(er), if NE admitted to breaking the rules for 7 years and the new Walsh tapes show them breaking the same rules that they admitted to breaking, I don't view this as uncovering anything new.

If this is true, Belichick needs to be suspended, and the Patriots given another significant fine. The league needs to send a message here.

Did the videotaping give them a competitive advantage?

Im looking for lawsuits at this point. The Boston Herald needs to be held fully accountable for its "Rams Walkthrough" story that completely ruined the SB for some of us before the game was ever even played. The actual loss was just icing on that horrible tasting cake. These 8 tapes dont sound any different than what New England has already turned in. I cant believe this knucklehead Walsh has been sitting on this stuff for 6 years.
I'm sure Plaxico Burress, Eli Manning, et al will sleep far more soundly now, knowing that they're no longer the main focus of your "disappointment litigation."
If youre going to provide pointless commentary, please exclude my opinions from it. much appreciated. Ive got absolutely nothing against the NY Giants.
Sincerest apologies. From your assertation that the Boston Herald ruined the Super Bowl for you, I figured pointless and ridiculous was the way to go here.

Oh boy. Not this again. Please..........make it stop.

Seriously, though, can this be limited in some way before it gets out of control again? It's nothing but rehashing old news of which there's been sufficient discussion. Unless something new comes up, ......

But this isn't new information. The original penalty was worded as "the entirety" It wasn't just for the Jets game. It was never "an isolated incident" Go back and read the original coverage, and you'll see that Goodell was aware that this practice has been going on in NE since BB got there. The penalty meted out back in Sept was for all of this type of behavior. But don't let facts get in the way of your crusade. Have fun.
So Goodell knew they were cheating for 7 years and that was his idea of punishment? Pathetic. It wasn't enough. And how do you feel good about rooting for a coach that resorts to cheating? Does integrity mean nothing to you?
I feel pretty good. I just had some nachos and a high quality IPA. :( I like the Patriots, I grew up watching them. I watched 'em win and I watched 'em lose ( alot ). I like it when the win better. I guess I have more going on in my life that I can base my integrity on that a sporting event.
