Funny, I was thinking just yesterday about taking some biology courses at a community college to get enough credits to sit for the patent bar.

 
<p>We deal with them at both my current and former company.  One of the lowest forms of life, right around the same level as Red Wings fans.</p>

they are awful but can usually be made to go away for 50-100k (fudge up or down depending on the size of your company). consider looking into defensive patent aggregation, which is another, more palatable, type of shakedown racket that can (maybe) help protect you. patent defense insurance is another option, but it's like earthquake or flood coverage, in that it's expensive and doesn't cover what you want it to when there's a claim.

Help me out here...I don't work in the private sector.

What happens if you simply tell these people to F-off and/or don't pay them? Are you basically screwed either way because you're force to pay the legal fees to defend yourself?

 
I have a friend who came up with a very successful iphone app and is now paying 10% of every app purchase (I think) to patent trolls just because they saw his app and patented the process before him.

Didn't occur to him that it was something you could/should patent as it wasn't really anything ground-breaking. Live and learn I guess, but I echo the scumbag comments above. That said, they are technically playing by the rules, so the negativity should really be directed more towards the system than the trolls.

Not sure I follow this either.
I guess it is some sort of shake-down.

Companies can either spent X amout of dollars to the "trolls" to get them to go away or pay XX in legal fees or damages.

Then again I don't have the business sense to run a lemonade stand so...

Patent trolls are seriously harming innovation and business in the US. It is the system, but you can put some blame on those that don't see the harm they are doing by taking advantage of that system.

Of course, if you talk to those in the system and those taking advantage of it, they would claim that the system is just fine. I expect that of those taking advantage of it, but for those in the system, it has been really surprising reading some of their opinions.

The only defense that mitigates the risk of patent troll litigation is having no money or assets. You can't rob somebody that's already broke.

The only defense that mitigates the risk of patent troll litigation is having no money or assets. You can't rob somebody that's already broke.
There are plenty of ways to defend against them. They just normally set their price point well below the costs of those defenses.

Hitler invented patent trolling. It drove former Patent Office employee Albert Einstein so mad that he fled Germany. Those are the facts.

Nobody said that anyone who brings a patent suit is a troll. Surely you can see how your example is different than the others posted. These companies don't invent or produce anything nor provide any service. Their business is patent trolling.

We may need to know who you're talking about here. Some people consider Apple a patent troll, and while they are purchasing patents, they actually DO develop new and useful technology. Then there is Project Paperless, which patented existing technology and is shaking down end users. The real patent trolling. Then there is Intellectual Ventures and the like.

Not going to say because every article written in the press contained lies and errors, and I don't want to defend and refute. The fact is that their opponent has a huge PR group and we didn't have the resources to fight this in the press. We put all of our effort into the case.

They tried to produce a product, but never had commercial success because their patented technology had been stolen by a Fortune 25 company and implemented into the bigger company's competing product.

Stolen. While it was being patented, the larger company used the details of the public patent filings to implement the technology into its own product. The patent process is supposed to protect the inventor, but sadly, this is far from the case.

If that were the case, they wouldn't receive a patent. Don't try to bully me into divulging more details. I will tell what I can--there's ongoing litigation. I never said the lack of a PR firm was preventing me from giving more info.

See the letter in the linked article for a near exact replica of the letter. This technology existed with Ricoh as far back as 1980. These people are associated with shell companies specifically designed to exact a 'license fee' from the end user (they don't go after the manufacturer) that is calculated to be just less than the cost of defense.

I'm sorry if your company is unfairly lumped in with groups like this, but the one I'm dealing with certainly IS the lowest form of life.

If I were you, I'd ignore the letter. Patent litigation is exceptionally expensive to pursue and a threatening letter doesn't mean much.

I still don't understand how this works. You can't extort an end user for patent infringement.
"use" is a form of infringement, as are sale/sell, offer to sell, and, in some cases, import.
