A New Jersey family court judge ruled today that Rachel Canning's parents do not have to pay her high school tuition after she sued them to cover her schooling and living costs.

The judge delayed a ruling on whether the parents must pay the 18-year-old student's college tuition while asking lawyers to consider whether it's wise to "establish precedent where parents live in fear of establishing rules of the house?"

The judge also denied her request for weekly allowance and additional financial support including attorney fees.

The next hearing is scheduled for April 22.

The New Jersey family was in court today with the teenage daughter facing off against her parents in a battle to get them to pay for her schooling and living costs even though she's 18.

Rachel Canning, who stared straight ahead for most of the hearing, is suing her parents in family court in Morristown, N.J., because she says they refuse to pay for her Catholic high school education and for college in the fall.

She claims that her parents, Sean and Elizabeth Canning, kicked her out of their Lincoln Park house when she turned 18 in October, which they deny. Dad Sean Canning says she left voluntarily because she didn't want to follow their house rules concerning curfew and chores.

"Private school, new car, college education; that all comes with living under our roof," he told ABC News station WABC-TV.

His lawyer, reading from a statement before the start of this afternoon's hearing, said the Cannings "are distraught that their oldest daughter feels that litigation is a better option than living together as a family."

"To be clear, my clients never abandoned nor abused their child and they have asked her to come home," Laurie Rush-Masuret said.

The judge said today that he wished more energy would be spent on reuniting the family than keeping it apart.

The young woman laid eyes on her parents for the first time in five months, listening to her lawyer accuse her parents in court of leaving Rachel Canning with nothing and painting the "most disgusting picture of their daughter" to get out of paying her tuition.

It was the first time the parents had seen their estranged daughter, 18, since she moved out in October.

"Why can't she go home?" the New Jersey family court judge asked.

"Her home life is an "abusive unhealthy situation," the teen's attorney, Tanya Helfand, replied.

Rachel Canning, an honor student and athlete at Morris Catholic High School, filed the lawsuit days ago and is asking a judge to declare her dependent on her parents for support as a student, according to The Daily Record.

The newspaper said Rachel Canning was asking that her parents settle a $5,306 tuition bill and pay living and transportation costs, as well as "commit" to an existing college fund.

Rachel Canning said in court documents, "My parents simply will not help me any longer. They want nothing to do with me and refuse to even help me financially outside the home although they certainly have the ability to do so. … I am unable to support myself and provide for my food, shelter, clothing, transportation and education."

Steve Mindel, a family law specialist with no connection to the case, said, "This is a case that is totally unusual."

The Daily Record also reported that Rachel Canning had been living with her best friend's family. John Inglesino, the friend's father and a lawyer, is reportedly funding Rachel Canning's lawsuit but is not representing her. Inglesino declined to comment to ABC News.

He has reportedly said he wants her parents to foot the bill for legal fees as well, which now total $13,000.

Sean Canning, a former New Jersey police chief, said the ordeal was tearing his family apart.

"We'd be whole and healed as a family if she were back home," he said. "And I think she's being enabled. I think she's being steered down the wrong area and it's killing us."

Rachel Canning has not responded to ABC News' request for comment.

Today's scheduled court hearing will mark the first time the father and daughter see each other since October 2013.

"I don't know," Sean Canning said. "It's going to be very tough."

 
Phone message left for Liz Canning from Rachel at July 2, 2013 1:18pm, submitted to Morris County Court, which got the judge apparently so angry:

'Hi mom just to let you know you're a real f**king winner aren't you you think you're so cool and you think you caught me throwing up in the bathroom after eating an egg frittatta, yeah sorry that you have problems now and you need to harp on mine because i didn't and i actually took a s*** which i really just wanna s*** all over your face right now because it looks like that anyway, anyway i f***ing hate you and um I've written you off so don't talk to me, don't do anything I'm blocking you from just about everything, have a nice life, bye mom'

 
On or about October 30, 2012, two days before her 18th birthday, Rachel ran away from home. Rachel was never 'kicked' out of home.

'Rachel lived in our house, under our supervision, until the morning of October 30, 2013, when she ran away after a disciplinary hearing at Morris Catholic wherein she was suspended for truancy (having previously been suspended due to alcohol involvement at the Homecoming Dance).

'Between August and October 30, 2013, Rachel routinely (every weekend) would attend parties, become intoxicated, and seek approval from my husband and I.

'On or about October 5, 2012, Rachel committed a theft on my credit card, which card was given to her for the purpose of purchasing presents for my husband's birthday.'

Referencing another theft, she said: 'During at incident in April 2011, Rachel stole $100 from my purse, snuck out of the house, at midnight, attended a party.... And returned home by taxi at 3.30am on a weeknight.'

 
Why would the friend's father help her with legal bills? Assuming he's not a bit Kevin Spacey ala American Beauty.

 
I live down the street from Morris Catholic. We'll probably be sending our kids there. I hope I don't find myself in court 11 years for now.

 
It seems that they are at least obligated to pay her High school tuition, as they probably signed a contract for that before the school year. Skipping out on the bill is Dr Gobbler-level low-class...

The father supposedly would get her drunk (she’s just 18 years old now) to the point of passing out. Once she claims she was awakened for a game of beer pong in the middle of the night. Rachel claims her father was inappropriately affectionate toward her:

“He mentioned frequently that my relationship in his eyes was not one of a daughter, but more than that.In the summer before my senior year he got me drunk at a wedding and said I was his date. He kept giving me shots and mango martinis. I blacked out that night and woke up at the toilet bowl in our room and he was in bed.”

She says her mother called her "fat" and "porky" as she was growing up, and she developed an eating disorder her sophomore year of high school. By her junior year, she says she weighed 92 pounds and was no longer healthy enough to play basketball, which she says angered her father.

Canning alleges her father was "inappropriately affectionate" toward her for much of her life, and claims he fed her so much alcohol that she blacked out on occasion. When Canning complained to the school about the alleged longtime abuse she had endured, the school called child services and her parents, in retaliation, then cut her off and directed her college funds elsewhere.

Rachel Canning says she doesn't think returning home is a viable option, nor does her therapist.

"I am not willingly and voluntarily leaving a reasonable situation at home to make my own decisions," Canning wrote in a statement to the court. "I had to leave to end the abuse. My parents simply will not help me any longer. They want nothing to do with me and refuse to even help me financially outside the home although they certainly have the ability to do so."

From the voicemail entered into evidence, it seems pretty clear that she did have an eating disorder but that the mom was concerned that she was purging rather than causing it.

Sounds like the girl has turned around everything she was guilty of and blamed it on her parents.

And I would say that her stories about her dad's advances are pretty good confirmation that she's sleeping with her friend's dad. Wouldn't surprise me if her friend is too.

Ok, wouldn't there then be some other action to bring against the parents other than paying for a private HS and college? This seems like a money grab.
Just devil's advocate:

If the kid needs help financially to start her life, wouldn't it be more useful to get her that than to have the parents put in prison?

 
Saw the story on the Today show this morning. She's got a really bratty, dirty, slutty look about her. Sexy as #### IMO.

The whole story/case is stupid and should go away, so the above is the only take on this that matters.

Well if she was mistreated, then I could find some sympathy. I guess I'm far more likely to believe that a privileged private school girl with a family with money who has been suspended from school and has stolen from her family is most likely not the victim here.

doesn't have to...As an honor student, school said she could stay and money was raised to pay the tuition

If divorced fathers are expected to pay for their 18+ year old children's college education, why are these parents not faced with the same burden?
