Btw @FBG Moderator can we merge the two SCOTUS nomination threads.  Seems silly to have the same conversation in both threads.

Regarding the question I raised in response to your post, see the bolded in the article that Saintfool posted:

But while both the wisdom and the legality of Section 3 of DOMA will continue to be the subject of both extensive litigation and public debate, this Administration will no longer assert its constitutionality in court."

So your DOMA example does not appear to be one where “the executive branch has the power to not enforce a law it believes is unconstitutional.”
