Criminal Justice and Sexual Assault (1 Viewer)

I'll stop cluttering up other threads with my belief that this country does not adequately prosecute or, frankly, care about sexual violence against women.  Other threads are replete with victim blame for not coming forward, and statements as to what women can do to be treated as survivors instead of liars.

Former Baylor fraternity president Jacob Anderson accepts plea deal after rape indictment

Anderson was accused of drugging and repeatedly raping and choking a young woman until she passed out.  She immediately went for medical attention.  She immediately went to police.  She stayed active and involved in the prosecution for two years, extending the entire experience for her for two years.

After being indicted by a grand jury on four charges, the trial was postponed a week before it was to begin and never rescheduled.  A plea deal was just entered.

On Monday he pleaded no contest to one count of unlawful restraint. He was sentenced to three years unajudicated probation and will not have to register as a sex offender, the district attorney’s office said.

Much like the "USA Shootings" thread, I intend to put cases where accused rapists get a slap on the wrist and/or minor plea deal here.

Makes me wonder if the judge and the prosecutor went to Baylor, were in that frat, or are golfing buddies with the boys father or grandfather.  Of course maybe the story is very biased in the initial introduction of the facts.  I am not in a position to know, but my suspicions are definitely roused.

August 19, a Texas doctor was convicted of raping a sedated patient.  Her nurse call button, which she tried to use to call for help was disconnected.

Probation (in Texas the jury sets the sentence.)

His lawyer:

“He made a mistake, but he didn’t sexually assault her,” attorney Lisa Andrews argued, the Chronicle reported. “Here we have this Latina woman with her fake boobs that came onto that little nerdy middle-aged guy, and he lost his mind.”

So, involuntary intoxication by fake boobs and latinaness is a mitigating factor.  I wonder if the conditions have to be in the conjunctive or if either works alone.

You are going to be REALLY busy.  Do you have a secretary?

It's disgusting how these women are treated and any argument to the contrary can kiss my ###.

Three MSU football players accused of forcing a woman into a bathroom and making her perform sex acts on them all while filming it on a cell phone were sentenced to probation and sex offender treatment.  They pleaded guilty to "seduction" and "surveilling an unclothed person."

The second conviction for sexual violence for a Palo Alto high school student in August, this time for rape and forced oral copulation, led to a sentence of 60 days in juvenile hall.  Outrage in the community was sparked by his third accusation, while he was still enrolled and awaiting trial on this second accusation.

I know lawyers have to do their thing but that comment by the lawyer is disgusting.

Is it "elitist" to say there is a sizable number of reprehensible people in this world and I am confident my morality is far superior to theirs?

I find nothing worse than preying on those weaker or vulnerable. But hey, boys will be boys amirite?

I'm certainly not not going to point to this thread the next time someone asks why a woman didn't report an assault.

Minnesota.  "At least 100 rapes of a 15-year-old girl by a 25-year-old man."  A relative.

Probation on August 14.

The father of one, who works full time as an electrician, Hill struggled to articulate in his psychosexual evaluation with Project Pathfinder why a minor couldn’t consent to sex with an adult or what ramifications the child might suffer for it, according to the report filed with the court.

If you find yourself making excuses for why any or all of these people got light sentences by now, it's probably a good time to honestly re-evaluate your feelings about rape and sexual assault.

Arkansas.  Rape charge over sex with an "incoherent woman" after a fraternity party leads to probation.  After dropping the charges down to false imprisonment.

According to a probable cause affidavit, university police spoke with the victim and her friends at Bear Hall following the incident. One of the victim’s friends informed an officer that Michael “Mickey” Zeher had walked the victim back to Bear Hall after leaving the party, where they both lived separately, because “she was intoxicated and was not feeling well.”
Shortly after leaving the party at the Sigma Tau Gamma House, one of the victim’s friends said she received a Snapchat from Zeher’s roommate that stated Zeher was having sex with the victim.
The victim told responding officers Zeher had in fact forced himself inside her on the night in question.
While at the University of Central Arkansas Police Department, the then-18-year-old suspect admitted to the allegations against him.
Zeher consented to answering questions without an attorney present and admitted to having sexual intercourse with the victim for approximately five to ten minutes. He also said he understood the victim was incoherent during the alleged incident.
He further told me that he took her clothes off, had sexual intercourse with her, ejaculated into a towel that was in his room, put [the victim’s] clothes back on, and then picked her up and put her back on his bed,” one officer wrote in his report. “I asked him why he had sex with [the victim] even though he knew it was wrong. He told me that it was because he had liked her for a long time and that he ‘had feelings for her.’”

Update on an old case:

After being convicted of raping a 14 year old in 2010, Austin Jones was sentenced to 90 days in jail and 15 years of probation.  For his third probation violation, this time attacking a woman and putting a belt around her neck while she screamed for help at 1 am outside her work at an amusement park and then raping her, prosecutors hope they can get his probation violated and have him actually sent to prison.

Officers arrived and found the woman on the ground on a blanket, a belt fastened around her neck and stripped nearly naked. She was unresponsive, shivering “and appeared to be in shock,” the charges read.

This one's from last year, but it has a twist so I wanted to include it.  19 year old admitted to raping a 12 year old and there was a DNA match.  15 years of probation. And no facebook, so you know it's serious.

South Dakota:

Fourth degree rape (meaning the victim was 13-16), 31 year old perpetrator who had previously been convicted when he was 18 of fathering a child with his then-15-year-old victim.  150 days in jail, but he gets to serve those 30 days each July for this year and the next four years.  Other than that, probation.

Oh, and he has to stay away from juveniles.  Except for his own children.

No I mean for every one of these stories there’s probably.....who knows how many that go unreported. Or the ones that are covered up because it would harm someone prominent in the community, harm the church, or the school, etc. The ones that are told to stay quiet because it would ruin someone’s life/marriage/job. It’s disgusting. I knew there was an issue with reporting but I had no idea there was such an issue with sentencing those found guilty.

That's what I meant by "yes."

This thread makes me depressed and angry.

@Henry Ford did you find all of these on a particular website or are you compiling them on your own?
I typed "rape sentence probation" into Google. Then I started just using the articles from 2018 (other than the one from 2017 with the facebook sentence) and skipping the articles about incidents I've already posted about.

I'm on page 15 of 11.6 million results.

MIT student broke into a woman's apartment and raped her.

In addition to admitting to the rape, Donick gave a personal apology to the victim during a court hearing today, the DA's office reports.
Wait for it.... probation.

Victim statement:

Thank you Judge Sanders for allowing me this opportunity to address the court.

I laid in the hospital bed with my terrified best friend and extremely strong lacrosse coach unsure of what was going to happen. The Sexual Assault Nurse examiner assigned to my case arrived after three hours of waiting “because it was a busy night.” A busy night in her life means other men and women were becoming victims. With each buzz of her pager, I personally now know the harsh reality of what it means. I understand the pain, anxiety, fear and uncertainty every buzz received before me and buzz after me feels. The pain of having blood drawn because I needed to be tested for sexually transmitted diseases and screaming “I'm in a serious relationship... this can't be.” The humility of being given plan B “just in case sperm was present” and being told to go to the student health center in three weeks to take a pregnancy test. The stomach wrenching feeling of filling out paper work for my “rape kit” and having swabs taken from areas I never wanted touched again. The soreness of every muscle aching because my uncontrollable shaking couldn't be stopped. The sudden waves of nausea from replaying in my head what had occurred that early morning. From having a random, kind nurse try to sooth me as I cried “I just want my Mom” who was hundreds of miles away and I was sitting in a sterile room with fluorescent lights being told to “hand over my clothes for evidence”. The sudden and intense breakdowns and anxiety attacks because someone had taken advantage of me in my supposed “safe place”-my bedroom. The muffled murmurs outside the door of nurses discussing how a rape victim was in the emergency department and how they could hear my sobs. But the worst of my new reality hit when I said to myself, I am a victim and I need to tell my parents. Tears streamed down my face as I grabbed my coaches hand and asked her if she would do the horrible, life altering call to my parents to tell them because I wasn't strong enough to. The sobs of my mom filled her phone and my dad yelling behind “what happened … is she “okay.” The overwhelming guilt of making my parents feel this way overcame me. But wait- why did I feel guilty? I had done absolutely nothing wrong. Not only did my life forever change the moment I was touched by you, but so did my parents. My sisters. My grandparents. My boyfriends and my closest friends. Not just my life, but every life around me. I was forced to tell my team why I wasn't at the clinic that morning and that the university wide text message alert was about me. I had to look my best friends in the eyes and tell them and all I wanted was to take away their pain. I began to question everyone's trust around me and quickly became isolated. I had to learn to fall back in love with my boyfriend because men became my enemy. I had to console my sobbing twin sister over the phone as she struggled to form words to say as she was all the way in Rome. I will forever be indebted to my unbelievably strong sister … who talked to me for hours on the phone and oldest sister … who strongly encouraged me to go to the hospital. And I will never be able to put into words the gratitude I feel to call the two people sitting behind me, my parents; their unwavering strength and perseverance when I became too weak is the reason we are here today.

I'll never forget the moment I was walking to the locker room to tell my teammates about what had happened when I had a grounds keeper stop me and ask me “how could someone take advantage of an innocent girl like that?” This question still haunts me. And the most haunting part of it is there will never be an answer to why some one feels the have the right to violate another person without consent. Without having permission to enter their apartment, let alone their bedroom. Without even knowing their name. Without them being conscious.

Never in my life did I think I would be standing here. October 18, 2015 will forever be a date that will burned into my memory; an everlasting scar. On that day, I became a victim. But today, I stand here as a survivor. Sadly, I have become another statistic, another number, Another headline. What all these headlines fail to highlight is the forever lasting impact a sexual assault has on someone. Media does a great job reporting the numbers of people being assaulted or raped. But it fails to get deep into the feelings and memories of those tragic days being faced by too many.

The one thing about the past is it can never be changed. It's set in stone and unwavering. But the beauty of life is with each day, we are able to make new memories and Make the necessary changes to live a better life. To better ourselves so our tainted history isn't repeated. So for you, I ask that you make your future untainted. I ask that you make a positive impact in every life you touch because the many negative impacts you made in mine and my families are enough for a lifetime. I ask that you take seconds, minutes and hours and truly realize how that one early morning you changed a 20 year old girl from a student to a victim to a survivor. I ask that you live each day with a little reminder of what you did and make up for it.

Thank you.
