Small caveat - with your own or unowned animals. I think it's illegal to have sex with someone else's animal without his/her permission in all states. Trespass to chattels or something.

Ok. It just seems like some people in here feel that if you would tell your 16 year old daughter not to get blackout drunk because bad things could happen to her, then you are essentially, partially, blaming her for what happens to her.

Well I do think you guys are all talking past each other. Pittsdown has clarified that statement several times. He's said that he didn't mean legal responsibility. He's said that he meant "responsibility to herself." I don't think he's really said anything more controversial than that she engaged in behavior that she likely regrets and will try to avoid in the future.

People in here are sick of the societal situation we have where we have to tell 16 year old girls not to get drunk because they may get raped. And acknowledging that placing any responsibility for being victimized whatsoever on the victim of a violent crime is by definition "victim blaming."

I'm not talking about legal responsibility either. A victim of a rape is never in any way responsible for being raped. At all. Not to herself, not to society at large, not at all. Not in a legal sense, and not in a moral sense.Maybe she acted irresponsibly - but she isn't responsible and bears no blame for what happened to her.

Interestingly, and I'm really sorry I know this, too, depends on the jurisdiction. Using nitrous oxide to get high from a Reddi Whip can is actually illegal in some states.

I'm not sure how to fix this. Not really concerning the facts of this case, but concerning the facts of other acquaintance rape cases. One reason why women and men of all ages might want to avoid getting blotto in co-ed situations fraught with some sexual potential is that it results in a situation where it's very hard to tell who did what and to draw the line between sex someone regrets and rape. Take the example of the situation where both parties are just sober enough to be responsive, but not really coherent. Who was raped in that situation? Either they were both capable of consenting or neither was.This case is easy, but the poor girl could have just as easily ended up in a situation where the case is hard.

Honestly ... before the Steubenville case, I'd have thought of the health ramifications first, second, and third before potential rape would even cross my mind. I may have read her the riot act about alcohol poisoning and given her some personal anecdotes (I was once passed out drunk in the back of a care while my "friends" went and burglarized a house).I guess add "friend" rape to the list now. But only just now, now that Steubenville happened. Definitely not the first case of blackout "friend" rape ... but the one that put that specific crime in the national conciousness.

Here in NC, it is a Crime Against Nature to be caught having oral or anal sex with people (or animals) in a public area (that includes a secluded area in the woods, etc.). It's a felony. When I was on the Grand Jury for a year in 2008, we had a few indictments of CAN, and all them were associated with prostitution. Usually it was a prostitute blowing some john in a car.

For the next eight months, her family struggled to figure out what happened to their soccer loving, artistic, horse crazy daughter, whose gentle smile, long dark hair and shining eyes did not bely a struggling soul.

And then on Thursday, seven months after the tragedy, a Northern California sheriff's office arrested three 16-year-old boys on charges of sexual battery.

"The family has been trying to understand why their loving daughter would have taken her life at such a young age and to make sure that those responsible would be held accountable," said family attorney Robert Allard.

"After an extensive investigation that we have conducted on behalf of the family, there is no doubt in our minds that the victim, then only 15 years old, was savagely assaulted by her fellow high school students while she lay on a bed completely unconscious."

Allard said students used cell phones to share photos of the attack, and that the images went viral.

Santa Clara County Sheriff's Lt. Jose Cardoza said it arrested two of the teens at Saratoga High School and the third, a former Saratoga High student, at Christopher High School in Gilroy on Thursday. The names of the suspects were not released because they are minors.

Cardoza said the suspects were booked into juvenile hall and face two felonies and one misdemeanor each, all related to sexual battery that allegedly occurred at a Saratoga house party.

The lieutenant said the arrests were the result of information gathered by his agency's Saratoga High School resource officers. He said the investigation is ongoing, and Los Gatos police also continue looking into the girl's September suicide.

The Associated Press does not, as a rule, identify victims of sexual assault. But in this case, Pott's family wanted her name and case known, Allard said. The family also provided a photo to the AP.

The girl's family members did not comment and have requested privacy until a planned news conference Tuesday. Her father and step-mother Lawrence and Lisa Pott, along with her mother Sheila Pott, have started the Audrie Pott Foundation (audriepottfoundation.com) to provide music and art scholarships and offer youth counseling and support.

The foundation website alludes to the teen's struggles, but until now neither law enforcement, school officials nor family have discussed the sexual battery.

"She was compassionate about life, her friends, her family, and would never do anything to harm anyone," the site says. "She was in the process of developing the ability to cope with the cruelty of this world but had not quite figured it all out.

"Ultimately, she had not yet acquired the antibiotics to deal with the challenges present for teens in today's society."

At least now these morons are sealing their own graves by taking photos/videos and sharing them.It's sad, but this stuff has always happened. It's just now the bullying is done through social media instead of word of mouth.

These kids will pay. Their normal HS student lives as they know them are over. Welcome to the criminal system ####heads.

I was Sheriff of this county when I was 25 years old. Hard to believe. My grandfather was a lawman, father too. Me and him was sheriffs at the same time, him up in Plano and me out here. I think he's pretty proud of that. I know I was. Some of the old time Sheriffs never even wore a gun. A lotta folks find that hard to believe. Jim Scarborough'd never carry one - that's the younger Jim. Gaston Borkins wouldn't wear one up in Comanche County. I always liked to hear about the old-timers. Never missed a chance to do so. You can't help but compare yourself against the old-timers. Can't help but wonder how they'd have operated these times. There was this boy I sent to the 'lectric chair at Huntsville here awhile back. My arrest and my testimony. He killt a 14 year-old girl. Papers said it was a crime of passion but he told me there wasn't any passion to it. Told me that he'd been plannin' to kill somebody for about as long as he could remember. Said that if they turned him out, he'd do it again. Said he knew he was going to hell: 'Be there in about fifteen minutes.' I don't know what to make of that. I surely don't.

The crime you see now, it's hard to even take its measure. It's not that I'm afraid of it. I always knew you had to be willin' to die to even do this job. But, I don't want to push my chips forward and go out and meet somethin' I don't understand. A man would have to put his soul at hazard. He'd have to say: 'O.K., I'll be part of this world.'

The pattern here is extremely disturbing. If there's good evidence that a crime took place, then prosecution should have begun months ago. If there wasn't enough evidence to proceed a few months ago, then a suicide shouldn't change that calculation. I don't see any way to attribute good decision-making to the people who were supposed to be overseeing these two cases.

I think part of it is that you're dealing with new forensics, namely linking YouTube accounts to individuals, that cops and law enforcement haven't gotten familiar and comfortable with yet, particularly in smaller communities. I know, it sounds silly, but this is the way that sort of process happens over time, which is to say by crisis.

Victim recalls assailant’s breasts, little else

A woman intentionally rammed her car into a man’s car while arguing over a parking spot in the Haight, but the victim was so focused on her low-cut dress that all he could describe to officers afterward were her breasts, San Francisco police said Thursday.

The woman drove away after hitting the man’s car at Haight and Cole streets at 5 p.m. Tuesday, said Park Station Officer Al Wu. The man couldn’t tell officers what kind of car it was, let alone supply a license-plate number, but he “was able to give a detailed description of the suspect’s cleavage,” police said.

No one has been arrested.

Member of Anonymous house raided

A 26-year-old Kentucky man has revealed that his home was the subject of an aggressive raid by a group of FBI agents last month in connection with an Anonymous hack that helped publicize key social media events in the Steubenville rape case.

Deric Lostutter, also known by his screen name KYAnonymous, told The Huffington Post over the phone that on April 15, FBI agents raided the Winchester, Ky., house he shares with his girlfriend and brother and that he was told he could face jail time if he let the story get out.

Lostutter, a self-employed IT security consultant and self-described Anonymous member, said on his blog that he'd just returned from a turkey hunt when he noticed what appeared to be a FedEx truck in his driveway.

"As I open the door to great [sic] the driver approximately 12 F.B.I. Swat Team agents jumped out of the truck screaming for me to 'Get The F**k Down' with m-16 assault rifles and full riot gear armed safety off, pointed directly at my head," Lostutter wrote.

"They seized my laptop, my girlfriend's laptop, flash drives, music CDs, an external hard-drive, two cell phones and my brother's xbox 360 for some reason," Lostutter told HuffPost.

The soft-spoken 26-year-old, who's also known by his hip-hop moniker, Shadowrapz, says he was a key figure in hacktivist collective Anonymous' efforts to publicize what happened the night an intoxicated 16-year-old Ohio girl was raped by two high school football players.

Lostutter says he was the one who published a trove of incriminating social media photographs, videos and messages that had been posted by Steubenville football players and that documented and ridiculed the victim."The tweets, screenshots, Instagrams. ... Pretty much everything you've seen in the media, that came through me," Lostutter said.

Lostutter also told HuffPost that the cache of social media posts was sent to him by Michelle McKee, who had received them from Alexandria Goddard, an activist and blogger, who had originally tracked down the posts, which at the time were publicly available and weren't obtained by hacking.

In March, two Steubenville high school football players, Trent Mays and Ma'lik Richmond, were found guilty of sexually assaulting a 16-year-old girl in August 2012; both youths were sentenced to serve time in a state juvenile detention center. Mays, 17, was also found guilty of distributing a nude photograph of a minor.

Judging from the FBI search warrant, which Lostutter has also published on his blog, the FBI was interested in seizing any evidence relating to the hack of the fan page for Steubenville High School's "Big Red" football team, RollRedRoll.com, and the site administrator's email, both of which were hacked in December of last year.

After the hack, a video appeared on the fan page. It showed a man wearing a Guy Fawkes mask, threatening to release social security numbers and other personal information of Steubenville football players unless they apologized to the rape victim by Jan. 1, 2013.

Lostutter told Mother Jones that he was the one in the video.

But Lostutter says he didn't hack RollRedRoll.com. A 22-year-old from Virginia Beach, Va., who goes by the moniker Batcat, took credit for the hack in an interview with the Steubenville Herald Star back in February.

Although Lostutter told HuffPost he never asked Batcat to hack the site, he admitted that he had approached "a lot of people daily" about different hacktivist "operations."

The FBI's search warrant for Lostutter's home states that he may have committed federal crimes such as "computer crimes" and "aggravated identity theft," as well as "identity theft, attempt and conspiracy."

Lostutter told HuffPost he received an email from the FBI saying he would receive a "target letter" indicting him for a federal offense as part of a federal grand jury trial. He has hired a lawyer from the Whistleblower Defense League, a legal activist group that defends journalists, whistleblowers and hackers.

If convicted of federal computer crimes, Lostutter could face up to 10 years in jail, Mother Jones reports. Meanwhile, convicted rapists Ma'lik Richmond and Trent Mays were sentenced to only one year and two years, respectively.

From the NYTimes article, I'm not entirely sure that the justice system "failed." The police charged the alleged assailants. It seems that the cops asked for witnesses several times. There is no indication that the police didn't intend to try to use the tape eventually at trial (there are admissibility issues that are likely involved which I haven't thought through fully), and in any case, releasing the evidence publically would just help the defense's assertion that the accused couldn't get a fair trial.It seems the most common complaint is that more accessories weren't charged, but I don't think it's unreasonable to focus on the case against the actual assailants. The prosecution, unfortunately, is almost certainly going to need the testimony of those who are possibly accessories. The lack of school-imposed discipline is another matter, but I'm having a hard time coming up with concrete evidence that the police aren't taking this seriously.

Oh, then I retract my answer. I thought I read that no arrests were made until after Anonymous got involved, but that appears to be wrong. :bag: It was the football coach, the school principal, and the superintendent who took insufficient action, not the police.

From what I recall, the police investigation lacked momentum until Anonymous got involved. It was, for example, weeks after the incident before they interviewed anyone.

That was my recollection too. That could easily be wrong, but I was under the impression that the police were going through the motions and the investigation was headed toward a white-washing.

That said, I have no problems going after somebody who hacked a school website (allegedly) and threated to release the SSNs of innocent third parties (which he admits).

10 years is the max he could face. the 1 & 2 years for rape is what they were sentenced to, not what the max was for them.
