Any immigration lawyer guys? (1 Viewer)

I have a friend who has her resident alien card and wants to pursue citizenship. However she also has a crap ton of medical and credit card debt and has consulted a bankruptcy lawyer. Would a bankruptcy preclude her from obtaining residency? She doesn't want to declare bankruptcy but she also sees no way of paying off these debts. But she would rather become a citizen. Any advice?

Tell her to declare bankruptcy.  If the citizenship guys question her about it she should tell them she was just trying to emulate the President.

my advise is twofold, i am a banker, not a Lawyer, but familiar with BK and the like.  to become a citizen i believe there is a morals clause, you must have good moral character.  a BK may affect this, but only if the debts were run up in a reckless manner.  but, you never really know.  BK should be a last resort.  these debts sound unsecured.  i would call and be frank with the creditors, a potential BK may make them more inclined to settle.  dont threaten, but negotiate.  a 13 will wipe these debts, but that BK will stick around for between 7-10 yrs.
