OH man makes plea in shooting of ex-Colts player

CLEVELAND (AP)—A man in Ohio has pleaded not guilty to aggravated murder 27 years after he fired a gunshot that investigators say caused a former NFL player’s kidney-infection death this year.

Forty-four-year-old Victor Gomez was arraigned Friday morning in Cleveland in the death of 54-year-old Michael Woods

The Cleveland-born Woods went to college at Cincinnati and played for the Baltimore’s Colts from 1978 to 1981.

Woods lost use of his arms and legs when he was shot in 1982. He died about six weeks ago.

Gomez was previously convicted of attempted aggravated murder.

A pretrial hearing on the new charge is scheduled for Tuesday.

He currently is serving a lengthy prison term in a separate case.

Former Baltimore Colts linebacker Mike Woods, whose promising NFL career ended when a gunman's bullet shattered his spinal cord in 1982, died on May 28, exactly one week after the 27th anniversary of his shooting. A big, physical linebacker, Woods became the University of Cincinnati's first all-American during his college career (1975-77) and was a second-round draft pick by the Colts in 1978. He missed his entire rookie season with a back injury, then started 36 of 48 games with the Colts from 1979-1981. "He was happy every day," his wife said today from the family home in Richmond Heights. "But he would get depressed around the anniversary of the shooting."

Was he "previously convicted of attempted aggravated murder" in regards to this case?

I was expecting it to read as such, but it all but did.

The facts don't seem to add up here. It'd be nice to know more to form an opinion.

 
If he was previously convicted, this would appear to be double jeopardy. I'm not a criminal lawyer though, and the death might be argued to be a new "wrong" that would give rise to a distinct charge. Regardless, the causation argument between the shooting 27 years ago and the death now is going to be a tough case to make for the prosecutor.
