What prompted all this? Has she ever attacked you before? What are the other couples saying? So bizarre....hope you come out clean here. What a nightmare.

Also I'm selling an Apple Woggerboggle that cost $7 googleplex new but I've seen them on CL for $4 gazillion and for any GMTAN friends, yours for $67.

She's never done anything like this before, but over the last month several people have noticed she's become erratic and rude. She's diabetic and takes antidepressants. It's possible her meds are off. Put some booze in that mix...

Everyone else there has said they'll provide me witness statements to support me, and she's not going to be welcome at future events

 
I'm looking to buy a couple of city/commuter bicycles if anyone has them for sale. I have an ipod Shuffle and three 16" wheel covers from a 2006 Rav4 (these will probably fit other models/years but I don't know).

Yeah, I've done that. Strangely, I was released with no conditions. Normally they enter a no contact (or no hostile contact) order.

WAIt's a mandatory arrest law. Call on DV, someone gets arrested. Assailt 4 means she had no injuries/no claim that I touched her.

They based the arrest on "unwanted entry" even though it was my cabin, the door was open and I had a key
So you go to jail on DV assault with no contact despite clearly being physically attacked? Wow, that's total :bs:

I'm sure it does, but that's serious garbage that they could take one look at your busted up face, see that she wasn't injured at all and was clearly drunk and take you on and charge you.

There's a lot of ##### guys out there and I'm sure a lot of them have gotten away with abusing women over and over, but it makes no sense that many cops will automatically blame the guy no matter what the evidence actually shows. That's some horrible police right there that should be in other lines of work. I know domestic stuff really sucks for police officers, but do your freaking job.

Gotcha. Sucks. Totally sounds like one of those situations where the cops don't know who to believe but the department likely has some informal policy of still making at least one arrest in a DV situation.

Good question. The reason these laws are so screwed up is that the police are immune from liability for false arrest but can be sued for negligently not arresting and then someone gets hurt. So they err on the side of arresting.

I would say suing the police is an obvious no go. Suing the crazy ex could possibly end up in a judgement in fish's favor, but I would say the lawyer costs plus the good chance that a judge would see a domestic thing and just punt would be a big deterrent in that as well.

But theoretically it seems like fish would have a case against her. Not only for his lawyer costs after she lied to the police, but I would say there would be a small chance at some sort of mental distress claim based on the panic and stress of his daughter being involved and fish not even knowing where she was or if she was safe while he was in jail. Probably low likelihood on that though.

Although this whole thing would play great on Judge Judy...

You know what sucks? When you're asleep and a crazed drunk chick starts kicking you and yelling at you in the middle of the night with two little kids present. And then while you're looking for your shoes she punches you in the face and splits your lip, then scratches the side of your face til blood is running all over the place. Then she finds your shoes and throws them over a balcony railing, all while yelling at you and your kid.

The best part is when campground security calls 911 and you get arrested for domestic violence because she lies to the police and says you started it and that she was just peacefully sleeping so then you go to jail not knowing where your daughter is and have to explain it to your ex wife on a collect call.

Then you get to sleep on a floor with 30 dirty hippies who got busted selling hallucinogenics at the Sasquatch festival, while hoping the Sheriff can find a judge willing to release you on a holiday.

Then you have to drive an hour back to the campground to get your stuff, leaving you with Memorial Day traffic that takes 7 1/2 hours to get through, so you can go to bed, get 4 hours of sleep and get back for a 9 am arraignment that really isn't set until 1:30.

So for a mere $3,500, you can retain an attorney who will interview the six witnesses the police didn't take statements from, all of whom (including a police detective) will testify that her statement is false and that she got drunk after you went to bed.

Then you can hope to get the stupid thing dismissed so you don't lose your law license.

Yeah, I *think* NYC has a law like this. We got a new Precinct captain in Hell's Kitchen a few years ago, and our block association was working with him to clean up the parks. We ventured into the DV topic because we have two women's shelters here. He said I f they file a DV report, somebodies getting locked up. If both have injuries, both get arrested, kids sent to CPS. They used to have flexibility...like file an information report, and send an officer around once a week to make sure things were cool. It was a way for patrolman to be more involved in the neighborhood, etc. With mandatory DV law, if they respond to a DV report, somebody is getting hooked. Or it's a no report.

 
Options now (all but trial are based on discretion of prosecutor:

X. Dismissal

/. Continuance for dismissal. Stipulated continuance of the trial date for like 2 years. If I manage not to get arrested in the meantime, it gets dismissed

iii plea down to a non-DV misdemeanor, like disorderly conduct

*. Trial

 
Options now (all but trial are based on discretion of prosecutor:

X. Dismissal

It's possible. Plus the ex contacted a mutual friend and said she thought I wouldn't get in trouble if she didn't press charges. Now that she understands that it's not up to her, she told him she wouldn't testify against me.
