Jerry Sandusky will get a local jury in his trial on child sex-abuse charges and will be allowed to visit with his grandchildren, a judge ruled Monday in giving the former Penn State football coach several victories.

Centre County Judge John M. Cleland also rejected a prosecution request that Sandusky be confined inside his home while under house arrest. Neighbors have complained that Sandusky, while outside his home, was able to watch children at a nearby school.

“The generalized concerns of parents, while understandable, cannot justify additional bail restrictions in the absence of some evidence from the commonwealth that the defendant's presence or behavior on his deck presents a danger to the community,” Cleland wrote.

The rulings follow a Friday hearing at which Sandusky took the stand.

Sandusky is accused of molesting at least 10 boys through a charity he founded, The Second Mile. Some of the alleged assaults took place at Penn State, where Sandusky would bring children on field trips. The former coach has denied all charges.

The child sex-abuse scandal rocked the university and the nation, eventually leading to the dismissal of the school's head football coach, the late Joe Paterno, and school president Graham Spanier; both were criticized for failing to act more aggressively in having law enforcement officials investigate Sandusky. Further, two Penn State administrators are awaiting trial on charges they lied to a grand jury investigating Sandusky. Both administrators have denied those charges.

The prosecution had wanted to draw people for the jury pool from outside Centre County, where Sandusky lives and where the university is located, arguing that it would be difficult to find a jury that hadn’t been tainted by the flurry of publicity surrounding the case. The defense, however, disagreed.

Cleland in his order said it’s not possible to know if a potential juror can be fair until questioned during selection.

“I am not persuaded the commonwealth has established the factual predicate to reach a conclusion that the ‘the most imperative grounds’ support granting its motion, especially since the defendant objects,” Cleland wrote. “The presumption should be in favor of at least making an effort to select a fair and impartial jury in the county where the defendant has been charged.”

If there are problems in seating a jury, Cleland said, he would reconsider his order.

The judge gave Sandusky permission to have visits with eight of his 11 grandchildren. One mother, who is divorced from Sandusky’s son, objected to her children having contact with the defendant. Sandusky’s trial is tentatively scheduled to start in May.

How can this guy be allowed a local trial, after what this #### city has shown us over the past 6 months? That town is going down as the second worst case of brainwashing in history, only taking a backseat to Jonestown. And now the judge is going to let the trail go on there? WTF?

 
So, if/when he's acquitted of all charges, will Sandusky be able to show his face in public again?

After the Casey Anthony trial a woman who looked like Casey Anthony was run off the road and a man with the same name got regular death threats.

And where will it rank among other highly publicized cases? Will it be more shocking than OJ and MJ?

I don't know, I think there's probably more local backlash than you think, especially with Paterno passing away. We'll see though.

I don't know, I think there's probably more local backlash than you think, especially with Paterno passing away. We'll see though.
That's what I'm thinking. This might backfire for Sandusky, as a lot of people probably blame him for Paterno's firing and disgrace.
 
Pretty sure the REAL Grand Jury found Joe Pa innocent of any charges. I'll take that over internet outrage 100% of the time. RIP Joe Paterno, you were a good guy, no matter what knee jerk overreactions on the internet want to say.

Yeah, I was wrong. Joe Pa was not charged, even better than not being indicted. Nice (sad) of you to find a post from January. Hint: Joe Pa didn't kill anybody.

What kind of endowment are they sitting on? I think this move was done to protect what lever nest egg is in place
 
Come Monday, Sandusky’s trial could receive its first significant piece of evidence. According to ABC World News, “intimate love letters” allegedly written by Sandusky to his accusers will be read once trial begins for the purpose of corroborating the testimony of the first accuser expected to take the stand, Victim 4.

The letters, which were allegedly written in Sandusky’s own handwriting, are expected to corroborate the testimony of the man known as Victim 4, now 28 years old, who met the coach through Sandusky’s charity, the Second Mile.The victim’s attorney won’t talk about the letter, but sources describe the letters as “creepy” and note that one was written in the third person includes a lewd title and is a love story between a boy and a man.

Ben Andreozzi, the alleged victim’s attorney, did say, “They have evidence to support his allegations, and there’s other evidence that has not been released to the public yet that I think will really resonate with the jury.”

Victim 4 was one of eight accusers mentioned in the original Grand Jury indictment last fall that broke open the Sandusky scandal. In the document, Victim 4 alleges he was sexually abused by the former Penn State defensive coordinator in while , Penn State facilities and during a bowl trip. Victim 4 also claims he was given numerous gifts from Sandusky, some of which the accuser is expected to show on Monday.

Sandusky is currently facing over 50 counts of child molestation charges. In all, eight victims are expected to testify against Sandusky during the three-week trial.

I didn't actually hear what they said on TV because I am at the gym but did they actually have a juror member wearing a Penn State sweater. That is a terrible sign IMO :unsure:

That was reported when they were all still potential jurors. There were 2 people. Never heard if either were selected.

I would like to think that is true but I really have no faith in that area since I believe the trial is being held in the same county as Penn State and Second Mile.
We discussed this earlier in the thread. Not only did he disgrace the school, but many Paterno fans will probably blame him for Paterno's fall from grace. IMO, keeping the trial in the same county as Penn State hurts Sandusky far more than it helps.

Thanks, didn't know that. Interesting decision then. I would certainly hope that most the jurors associated with PSU (and as everyone has said, in a small college county that's going to be a lot of them) would have a more negative view of Sandusky than positive. Guess we'll see.

Still does not matter. You can't just switch attorneys to get around Judicial estoppel.

Good column. We all need to pay attention to those around us, and ask questions when folks seem down, distant, or upset. It's way too easy too get caught up in the busyness of life and not take the time to try to help someone who is hurting. A good message for all of us.

The media lost interest once Paterno died...
So sad because that statement is so true.
:confused: It was one of the lead stories yesterday on abc's good morning america and again on their nightly news.
Yeah, locally, every station has a reporter on site and it's been the lead story every night since last week.

This story about the Penn State high up keeping a secret file on the Sandusky abuse allegations over a period of years and then allegedly lying in his testimony so many times the prosecution can't be bothered to debunk all of them makes the PSU Admin look even worse (if that's humanly possible).

Sounds like PSU president Graham Spanier is going to go down too. "It would be humane to hide this from the police."
