So Cruz is basically calling upon the Senate to reject ANY Obama appointment and wait until after the election when a Republican might win? Is there any historical precedent for that?
As someone else posted, that would okay to whoever the dem nominee is. Voters would galvanize over the GOP playing that game. And of course they are going to try holding it up.

Yup. More representative of what our country is becoming. Religion is waning here. That's something the right can't or won't recognize.

This is a turning point in American politics, a nation moving left may now start taking long strides.

Trump will order Obama to appoint a conservative and threaten him by saying if he fails to do so, Trump will just expand the court to 11.

Pretty much. It was a little messier than that. It also overruled a case from 7 years before. Get ready for all of the conservative jurisprudence of the last 8-10 years to get demolished if Obama can squeeze someone on the Court.

It would be political suicide for Republicans to try to fillibuster any Obama nomination for a full 8 months with elections pending. Obama could nominate Sri Srinivasan, a guy who clerked for Wilkerson and O'Connor, served in the Solicitor's Office during W's administration and was Principal Deputy Solicitor General under Obama before being appointed to the DC Circuit on 97-0 vote.

Or Obama could shoot for the moon and try Harold Koh or someone and hold Sri in reserve. That's what I'd probably do. Republican obstructionism probably helps the Democratic nominee.

How long before Obama has a nominee. Is this an extensive search beginning Monday or does he have a list already in place?

 
Well, Obama gets one last chance to really stick it to America. He's already done enough damage and now he gets to do even more.

Hopefully the Senate can stall and hope for a GOP victory this November.

There best action is for Obama to nominate Hillary to be Scalia's replacement.

Win for the Republicans because they will feel confident about winning the presidency and winning the long con to appoint more justices.

Win for the Democrats because the Republicans are a trainwreck and won't win anyway.

Win for Bill Clinton because he can cross "banging a Supreme Court Justice" off of his bucket list.

The only flaw in this line of reasoning is that the Clintons stand to lose a few hundred million dollars.

How so? Being on the SC hasn't stopped Roberts and Thomas from raking in the special interest money.

Doesn't it take the senate to approve the judge? With a republican senate I don't see Obama getting anyone seated. They will try and hold out until after the election, if a democratic candidate wins they will force a moderate pick or just go with 8 judges indefinitely, if a republican wins we will get scalia II.
I would love to see the Senate do this and hold things up. The DEMS would win the Senate hands down this coming election year if the Senate looks to do anything near holdign this thing up.
