There best action is for Obama to nominate Hillary to be Scalia's replacement.

Win for the Republicans because they will feel confident about winning the presidency and winning the long con to appoint more justices.

Win for the Democrats because the Republicans are a trainwreck and won't win anyway.

Win for Bill Clinton because he can cross "banging a Supreme Court Justice" off of his bucket list.

The only flaw in this line of reasoning is that the Clintons stand to lose a few hundred million dollars.
I beat you to it; I suggested he appoint Bernie.
But I was reading through the thread to see if anyone else had suggested it. If I were the kind of person who thoughtlessly posted every thought that popped into my head, I would have beaten you.

How so? Being on the SC hasn't stopped Roberts and Thomas from raking in the special interest money.

Alot of ignorance in this thread... and i'll assume it's from those who haven't actually read the man's decisions. Whether you agreed with his viewpoint, or not, he was a brilliant mind and a persuasive writer. I'll chalk this up to a loss for the court.

What's the running assumption on the appointees for the next president 3? 4? This is pretty big.

 
What happens to the cases being heard by the Supreme Court right now? Were they not going to start weighing in on immigration and such?
4-4 decisions revert to the decision made my the lower court.
My question is about upcoming hearings like the immigration one mentioned above.. I can't imagine they'd start hearing the case knowing that at best another judge gets appointed while they are in the middle of the hearing.. Any precedent on this :confused:

Their docket will not be changed. I would assume a new Justice would not vote on any case that they have not personally worked through.

There must be some antiquated law somewhere that allows for the lead custodian to serve as SC Justice until one is appointed. Disney movie maybe? Wasn't that what Stiller did in his last movie? Oh, that was a security guard.

Yup. More representative of what our country is becoming. Religion is waning here. That's something the right can't or won't recognize.

I was sure Ted Cruz was a Constitutionalist. Heck, why wouldn't he want the POTUS to choose the next justice? That's really weird.

I would be shocked if 10% of the people knew what Constitutionalist means AND cared enough to let it effect their vote.

 
So Cruz is basically calling upon the Senate to reject ANY Obama appointment and wait until after the election when a Republican might win? Is there any historical precedent for that?
About a dozen and a half justices have been appointed in an election year. Most recently Kennedy in '88

Interesting thing pointed out by legal scholar on MSNBC.

For any cases where the justices have voted on but have not issued an opinion, Scalia's vote no longer counts. So any cases where the vote was 5-4 with Scalia in the majority will now revert to 4-4.

Obama just announced he'll nominate someone. Would bet money it's another highly respected moderate left type.

High risk stuff not to confirm IMO. The deal Reps can get now (a moderate) might look very very different if the obstruction helps elect a Dem President.

I think Obama should nominate a moderate/liberal Hispanic. The Repubs blocking such a nomination might be the death knell for their party.

As I understand it the longest a seat had sat vacant pending confirmation is 125 days. This would be nearly 2.5 times as long.a wait. If I. Have bad information I'm certainly willing to amend my thoughts. Stonewalling a confirmation would not sit well

Please don't share this elsewhere.... Just spoke with my nephew who did some work with Scalia. He also worked in the West Wing so he's also pretty tied in to that scene as well. His guess is that Obama will appoint Sri Srinivasan. He described him as a little Left leaning to Moderate.

My nephew is Liberal but Scalia was his favorite Justice. He's pretty upset.

Just on social issues. On financial and commerce regulation issues it has often been near 9-0 or lined up totally differently in many decisions. People don't care about that stuff but it's much more important.

The flaw is that you assume Bill has not already banged an SC Justice.

That's a Court of Appeals position, not a Supreme Court position. The current Republicans have been blocking Court of Appeals judges for that long as well. I don't support doing that for either party, but it's completely different from a Supreme Court position.
