Labor Dispute Master Thread (1 Viewer)

If the appeal is denied then it's pretty quick. Article says fa could start very soon. Who are the big fas right now? Wouldn't this also mean that teams can work trades? Philly is sitting on a second round pick or a ticket back into the first possibly.

Dear Judges of The United States Eight Circuit Court of Appeals,

Please review this stay request tomorrow. Thank you.

Sincerely,

America

Uhmm...Even though I am all for the players. I think the shortest way for negotiation to satisfy both parties is for the NFL owners to win this lawsuit.

Now, there will be an appeal process, and which probably means more waiting.

Also to note, Union winning could possibly mean the end of draft and FA, which will result in significant less competitive football for the future. Snyder can finally play fantasy football with real players.

I'm hoping that I'm wrong, but things seem to be headed that way

I think the players' side has been playing up the these fears, but I don't think they have any interest in ending the draft or ending the current way the NFL does business. But to continue doing business the same way both sides will have to agree to do so. Right now both sides are still hoping for court victories.

Kesseler has been voicing for the end of the draft for a very long time. And if you listen to PFT podcast I believe April 21st episode with guest caller Jeff Ireland), Mike Florio explained it best. It is probably used as a negotiation technique, but it can get out of hand if judges rules for that, so that even though neither side wants the end of the draft, it can become something that is beyond the control of both sides. And then we'll see the end of rookie draft as we know it.

The NFLPA and players were perfectly happy with the arrangement they had (with the exception of wanting to knock back the rookie salary scale perhaps). They haven't changed that view. But pushing this fear will put more pressure on the owners, and Kesseler knows that.

This is rather alarmist. If there is a CBA deal reached that provides for a draft then there will be a draft. A judge can only strike down the draft as anti-competitive and illegal if there is no CBA - assuming a player challenges it in court.

There is no way they will be ending the draft anytime in the foreseeable future.

What union? Some of you guys don't even know what you're rooting for.
Certainly they do. They're rooting for NFL football players.
Then, why did they say "go union"? Not the same thing. There is no players union in the NFL. Or did we not understand what decertification meant? Or, do you agree with the owners that it was a "sham"? I'm confused.

That's funny. I'm for the owners but I think the quickest way for negotiation is for the stay to be denied, thus forcing unrestricted free agency with no salary minimum. I'd bet that May 16 negotiation date won't come quick enough for the free agents who have only been offered $100k contracts.

Boy this would make for a exciting next week if free agency and trading starts.
I swear, who more than Eagles fans are praying for activity to open up before 7pm ET on Thursday? They got Kolb either wasting on the bench or as a chip to convert into a 1st round selection...and that all hinges on if the courts can resolve things prior to the Thursday night or not.

Which is exactly why I believe the players have abused the law.

:goodposting: If they want these things to stay, then decertifying is a sham. Can't have it both ways.

Baloney. They've just gotten the best of the owners so far in this protracted fight. It's not illegal or abusive if your side is losing at the moment.

When they get back to work and NFL football is back...great.

Till then I don't give a #### anymore . The older I get the less important this becomes.

I'm all for this lifting of the lockout, but what does it really mean? The owners have appealed and thats gonna take time. I'm assuming they will like that as it gives them time to figure out what their next move is gonna be. Are we really any closer to assuring the start of the season? Sorry I'm just not that educated on all the legal maneuvering that both parties are doing.

No kidding. First round last year beat NBA playoffs by a wide margin in ratings.

I don't think there is any way they start the league year before the draft. If they do this will be the craziest weekend in offseason history

I not sure about free agency and trading starting soon. The NFL seemed confident they would get a stay from the 8th circuit. They also seemed confident the lockout would be upheld by the 8th circuit. Maybe that's what they have to say.

So all laws are good laws? Gotcha....but my moral compass is a bit more complicated than that.

per NFL.com

"But perhaps the biggest development is that Nelson has decided not to stay the decision, which could force the league to open for business immediately."

That's pretty much where we are at right now. Next steps is that the owners may or may not (most likely will) appeal. Big question is, will the court even accept that appeal. If it doesn't, free agent craziness begins. We'll know as early as tomorrow night.

Go Trade Association!

If a stay is not granted, business starts now. The NFL can appeal, but the lockout is not legal in the interim. Players will be showing up at the facilities first thing tomorrow morning and unless the appeals court moves are record speed, the players will have to be accepted or the players will have another barrel in their legal fight with the NFL violating the judge's ruling.

hey legal begals, why didnt the judge order a stay? or is it customary to only rule then give a stay if asked for one?
Not a legal, but my understanding is that Nelson believes that both players and fans are being harmed by the NFL not conducting regular business while the players and NFL figure out a contract. In the statement she claims this dispute is not normal private employer versus private employee as there are both tangible and intangible ramification beyond the two parties indispute. How often stay are grated the legal guys will have to weight in.
