Ok, I would like to hear people's opinions on how this situation should be handled.

Condensed version: 2 people bid the same amount of money on the same player during a waiver period last week. The player went to team A. The commish then over turns the waiver result and gives the player to Team B, stating that the tiebreaker is based on last years over all record. The rules actually state that the tiebreaker is based on over all record but doesn't specify which season, current or past. We are in the new season right now. It also doesn't specify which record wins, the worse record or the best. This is a very ambiguous situation and I would like the community's input. It all boils down to whether or not the intention of the rules were to reference last season's record or not.

If you come to the conclusion that it is, then it's clearly the same rule you have during your normal season, which I assume is that the worst record gets the tiebreaker on priority.

If you come to the conclusion that it doesn't, then you have no tie breaker at all that is applicable.

I believe in this situation, the commish ruled in it the only way that makes sense and should use it as a precedent for all future bids and clarify the rules.

This is an opinion that is irrelevant to the current situation. Their bylaws state nothing about draft order and can't be retroactively looked in that way.

 
Since its not explicitly spelled out, i think basing it off last yrs record makes more sense than a coin flip

 
Agreed. Last years record makes the most sense here. Next year make sure something is written in tbe rules to clarify.

 
Worst record last season should get the player via tiebreaker rule.

There should be another tiebreaker after record in case the teams involved have or had the same record.
