NFL suspends 6 players for 4 games apiece (1 Viewer)

Why wasn't grady jackson suspended? and clues?
One player who appears to have avoided suspension is Falcons DT Grady Jackson, who met with the league and filed suit against the makers of the StarCaps product in Alameda County Superior Court in California in November, seeking restitution for any potential lost salary and damages for their “false advertising and unfair business practices.” Jackson apparently won’t have to follow through with his suit, but the suspended players almost certainly will look into their own legal recourse.

Just when the Lions were on their way to a perfect season the Vikings do something to screw it up again.

Stupid Vikings.

Just my opinion, but I think this devastates the MIN D for Fantasy. The secondary as a whole is questionable at best, and is really well protected by that dominant D Line. What this will do is instead of 3rd and 7, 3rd and 9, where they can just pin their ears back and pressure the QB, will now become 3rd and 3, 3rd and 4. Those are dangerous downs, because the O can go either way, and the passing drops become a lot shorter. Less pressure, less sacks, less turn-overs... bad mix for fantasy.

My league's rosters lock once the playoffs start, and in my playoff prep, I'm dropping MIN for Dallas. Even with the Detroit match-up this week, I fear MIN is going to be in trouble.

All my opinion of course.

Wow. How could the NFL do this? Honestly?

I don't see Goddell lasting too much longer if he keeps doing things like this. The players union is going to be filing suits left and right.

This is a complete joke.

Schefter reported that the players could still file injunctions to stave off the suspensions.
Here is what Schefter said on his blog:
Just the beginning…

The suspensions that the football world waited for arrived Tuesday, when the league announced six players will be suspended four games for violating the NFL Policy on Anabolic Steroids and Related Substances.

The six players — Minnesota’s Kevin Williams and Pat Williams, New Orleans’ Charles Grant, Deuce McAllister and Will Smith, and Houston’s Bryan Pittman — each are suspended for the final four games of the regular season. If the player’s team qualifies for the playoffs, he is eligible to return to the active roster on Monday, December 29.

Moments after the suspensions were announced, one person close to the players fired back a text message that read: “I suspect that ALL will be appealed and ALL will be eligible to play since (Dr. John) Lombardo knew the supplement was tainted and didn’t alert the league or the Players Association.”

The league said the players specifically violated a long standing provision of the policy relating to the use of diuretics and water pills, which serve as masking agents for steroids and are potentially dangerous to the health of players.

The policy states that the use of so-called “blocking” or “masking” agents, including diuretics and water pills, is prohibited and that a positive test will not be excused because it results from the use of a dietary supplement that unknowingly contained a banned substance. Supplements are not regulated or monitored by the government and players have been warned about the risks of supplement use.

“You and you alone are responsible for what goes into your body,” the policy has always stated.

“Claiming that you used only legally available nutritional supplements will not help you in an appeal…Even if they are bought over-the-counter from a known establishment, there is currently no way to be sure that they contain the ingredients listed on the packaging or have not been tainted with prohibited substances…If you take these products, you do so AT YOUR OWN RISK! For your own health and success in the league, we strongly encourage you to avoid the use of supplements altogether, or at the very least to be extremely careful about what you choose to take.”

The NFL fired its shot Tuesday but this story is far from over.

It sounds like we need to wait and see over the next few days before overreacting since ALL players involved might actually play.

NESBIT SUES STARCAPS MANUFACTURER

Posted by Mike Florio on October 28, 2008, 10:58 p.m. EDT

Saints guard Jamar Nesbit, who already has been suspended four games for violation of the policy regarding steroids and related substances, has filed suit against the manufacturer of “StarCaps,” a weight loss supplement that allegedly contained Bumetanide — unbeknownst (what a great freaking word that is) to Nesbit.

Nesbit chose not to appeal his suspension. “Under NFL rules, you are strictly liable for what is in your body,” said his lawyer, Brian Molloy. “They don’t care how it got there, contaminated supplements or otherwise. So he did not appeal his suspension and focused his attention on going after the manufacturer of StarCaps.”

His lawsuit attempts to recover $235,294 in lost wages from StarCaps. Nesbit also wants compensation for damage to his reputation.

Nesbit’s complaint alleges that the manufacturer failed to disclose that the product contains Bumetanide. A November 2007 entry on the National Center for Biotechnology Information’s web site disclosed that Bumetanide was found in the StarCaps product.

An intriguing twist could come if Nesbit’s teammates (Deuce McAllister, Will Smith, and Charles Grant) are able to beat their suspensions via the appeal process. If that happens, the manufacturer of StarCaps could argue that Nesbit failed to mitigate his losses by not taking advantage of the available procedure for avoiding the appeal.

In English, Nesbit’s lawsuit could suffer if his three teammates successfully avoid their suspensions, since the StarCaps manufacturer will argue that Nesbit should have filed an appeal, too.

I support the idea that the players are responsible for what they put in their bodies. But this type of hard line stance could lead to other problems in the future. And old saying in theater goes, "Never walk down a set of stair in front of your understudy". With millions of dollars potentially at stake, we could eventually see a situation where a second stringer spikes the food of the guy in front of him to get more playing time. Or a fan of a rival team working at a hotel where players stay on the road adding a banned substance to the food of the big star of the hated rival. It's important that the commish takes these situations on a case by case bases.

Are you kidding? How many times do you think someone would have to spike a guy's food for it to show up on a piss test? These guys aren't tested every friggin day.
