I think what he means is much like calling someone racist.

If you do it for every instance it begins to lose its intended meaning.

The bloods/Crips/MS-13 whatever probably terrorize the US on a day to day basis more than any terrorist ever has in the US.

Do we want the CIA/FBI/Homeland security working on every case when Jamal tweets out a pic with a gang sign and a gun pointing at someone?

Guys, just use the brown test: if this had been Mohammed Al Safar tweeting bullets next to the pictures of elected officials, you don't think people would be calling this terrorism?

I think NRA should be investigated to see who actually posted the tweet, who authorized it, and those people should be prosecuted for making a threat against an elected official for political purposes, IOW terrorism. If they are innocent of wrongdoing let them prove it in courts.

Threats have never been protected speech and have always been a crime whether they come in a paper envelope or on twitter. But yeah this is a "viewpoint" expressed by the NRA. I think they should be able to make that argument in court and whatever the jury decides we'll go with, same as every other threat ever prosecuted in the history of our country. Cool?

Cool with what? Taking them to court? Sure. I think it's a stretch to call this a death threat, but if someone wants to take them to court over it that's fine by me. That's what the courts are for.

Sounds reasonable. But if an actual home-grown terrorist shoots one of those two people, someone at the NRA might be liable for damages.

Only who posted the tweet and those who approved it or came up with the idea. And I think that prosecution would make any other actions needless.

So you know, the same procedure as anyone who makes a death threat against an elected official.

it's clearly a crime and there are already protocols in place for handling.

Legal definition of death threat: Under state criminal codes, which vary by state, it is an offense to knowingly utter or convey a threat to cause death or bodily harm to any person.

I think a jury could go either way on this. The image certainly conveys a threat.
