In this case yes.  Check out her testimony, there is a whole bunch of red flags.  She was arrested in Louisiana several years ago for falsely accusing an ex boyfriend of domestic violence.  She attempted to break into Rueben's house while he was in it to confront him after he fled her when she said she was going to ruin his career.  The individual that she got to use his cell phone to call 911 talked about how calm she was with no signs of abuse.  Many other revealing statements that I have a hard time believing are all made up to get $$ from Foster.

Nice to be sure your preconceived conclusions are true no matter what is revealed.  Sure hope you are never on a jury....for either side.

 
It also appears the DA may have some explaining to do with the lack of investigation of some obvious things that were revealed prior to indictment...I would say I lean towards law enforcement/DA's in most cases until facts are shown to contradict their assertions.  In this case it sure looks like the DA wanted to make Foster an example and basically tried to railroad him.

I don't know either way...but none of the things you listed mean it still couldn't have happened....I thought she did have signs of abuse and that is what she was trying to say the video of her in another fight with somebody else created...even though we don't know if that video fight would match her injuries....obviously she is no angel, nor is he and it sounds like a ton of emotion involved...and to your last comment....let's not act like scenarios like this are hard to believe....things like this happen with athletes/famous people....things go unsaid....things get recanted....people take the blame....especially if on second thought someone is worth more to you out of jail.....heck shaddy/sketchy things like this happen all the time in the NFL and other sports/high profile professions....so much so Chris Carter thought it was important enough to tell all the rookies.....

Doesn't fit their predetermined narrative....basically in their minds all accusations of domestic violence are true and might as well lock up the accused person....no need for a trial.

Just because she did it before doesn’t mean she didn’t get paid to recant her story in this situation.  

It’s plausible she gets pissed about something, pushes his buttons, he beats her up....(exactly a possible reaction she was looking for)...thinking that’s the way to really “get at him” in the moment...he beats me up I ruin his career, blah blah, blah....then when both parties clear their heads and talk finances, they both realize it is in their mutual best interest for her to recant her story and go on with this whole I made it up cause I was pissed thing...and the topper....people will actually believe it since I have done something similar in the past... :shrug:

Whether she made the earlier part up she got paid to change her story.


Just because she did it before doesn’t mean she didn’t get paid to recant her story in this situation.

The DA is not even pushing the “Foster paid her off” conspiracy theory… only Twitter extremists are. Today, the lead detective himself acknowledged under oath that there is no evidence that Foster and Ennis were in contact during the 2 days between arrest and recantation.

Justice prevails and glad to see Lynch learned his lesson from the Brock debacle last year.  Innocent until proven guilty.  God bless America!

Look I’m not trying to start anything...he very well could be innocent....and if people want to choose to bury their head in the sand and act like her getting paid off to change her story is not a completely reasonable scenario, so be it...but we have to admit, ANYTIME somebody recants a story...eyebrows get raised...Didn’t click on any of the links and really could care less about the testimony...the testimony today in reality could potentially mean diddly squat because of what they all have to gain from it....her saying “i was lying, makes it so that NOW everybody thinks she is telling the truth and everybody will fall for it....because “oh my god nobody would get on the stand and say they made up the first story”....oh my you could get in trouble for that...but fact is, any trouble she gets in for a false report or lying to the police will be made up in spades by what she can gain financially for the slap on the wrist that she probably won’t even get....Chris Carter taught us that...its really not a judgement on anyone that thinks things looked a little sketchy here....we arent talking choir boys and 70 year old nuns...there are thousands of reasons for her to recant here...

nobody wants to have these conversations....cause we all want our Sundays....right..I’m not a holly roller....and thats fine...lets keep turning the other way as long as we get our Sundays baby....!!!

I come back to my original position "stickin ref", Foster is guilty until he proves his innocence....except he can't in your mind. You have to ask yourself what it would require for you to truly believe he is the victim.  If you did read the testimony of not just her, but others put on the stand then I think you clearly already know your mind is made up.  Like I said, I hope you are never on a jury for either sides sake.

Your line of thought is exactly why our legal system allows reasonable doubt to exonerate someone, but never to convict them. There's probably a good reason (maybe even thousands) for that.

 
Title of the thread even got changed to “it was a money scheme”...kind of ironic cause it is almost like this big double negative reverse psychology Oceans 11 kind of thing...everybody now thinks this lady is out a bunch of cash and in a bunch of trouble ....when possiby she really just made a bunch of cash...Chris Carter and Sapp even said...”we will get you out”...and that could be the mentality here...you go and say you were lying....we will take care of you later....I’ll say again....not sure this is what happened....but its not like its out of bounds with what/who we are dealing with....if Foster beat the #### of me....and I made a report and then they told me I would get a bunch of cash if I changed my story....I would flip in a heart beat....cause the payoff is probably worth whatever minimal consequence/if any I would face for making a false report..can almost guarantee everybody posting here raised their eyebrows when they heard she was recanting ,,,,and considered the the fact that she may be doing so for money...

So if the 49ers organization has coerced her into covering it up, they were either a) incredibly lucky (that she was already guilty of prior almost identical behavior) or b) have the ability to access/modify police/court records to support said testimony. Both seem overwhelmingly unlikely compared to the scenario that has been presented in court.

Well, if two renouned journalists such as Warren Sapp and Chris Carter suggested that she changed her story because she got paid, consider me convinced. Who could possibley question the validity of any statements made by those two geniuses?

There has been a lot of drama surrounding San Francisco 49ers linebacker Reuben Foster's February 11 arrest. Judge Nona Klippen is expected to decide on May 23 whether or not the case goes to trial. Meanwhile, Foster still has to deal with his initial offseason arrest, which took place a month before the February incident.

On January 12, the 49ers linebacker was arrested in Alabama and charged with second-degree possession of marijuana. Unlike the felony charges stemming from his most recent arrest, the marijuana charge is a misdemeanor.

Tom Pelissero of NFL Network reported on Friday that Foster is due in court on June 20 for his initial arrest.

The 49ers have a mandatory minicamp scheduled for June 12-14. Foster, however, has not participated in team activities since the charges from the second arrest were announced and is unlikely to do so until the situation approaches a resolution. The 49ers have taken a patient approach by letting the legal process progress before making any decisions concerning the linebacker's fate.

The NFL is likely to launch its own investigation into the incident, and Foster is still facing potential suspension. NFL spokesman Brian McCarthy told Bay Area News Group that the league is "monitoring all developments in the matter."

 
I can see the judge ruling this a felony since the prosecution seems to have it in for Foster.

The big story on Thursday was Reuben Foster’s ex-girlfriend recanting her statement regarding a physical attack by the San Francisco 49ers linebacker. The judge will rule this coming Wednesday whether or not Foster will stand trial, but it sounds like she will also address the gun issue.

Foster was charged with three felonies, including illegal possession of an assault weapon. The testimony on Thursday focused on the first two felonies, which included domestic violence and forcefully attempting to prevent a victim from reporting a crime. If the judge decides to believe the most recent statements by the accuser, it would not be surprising to see the two charges dismissed.

The gun charge has been a little less clear. The accuser originally told the police Foster had a pair of AR-15s, but it has subsequently been clarified as a SIG Sauer 516 short-barreled rifle. If it is determined the accuser lied about the domestic violence incident, that does not in turn make the search illegal.

However, according to The Athletic’s David Lombardi, there was a debate over whether Foster should be charged with a felony or misdemeanor.

The charge is a wobbler, which means the DA could choose to charge it as a felony or as a misdemeanor. The judge will decide where that stands when she decides what to do about the other charges. The decision is due at 3:30 p.m. PT on Wednesday, May 23rd.

San Francisco 49ers general manager John Lynch, along with Good Morning Football host Peter Schrager, announced on Wednesday that the team will hold another State of the Franchise event on Wednesday, May 23 at 7 p.m. PT. Schrager will join 49ers radio play-by-play announcer Ted Robinson as the hosts for the event.

"We know we're getting big time when they're bringing the Schrags out to work with Ted Robinson on this," Lynch joked. "That's awesome."

The event will be held at the California Theatre in San Jose with tickets costing $5. All proceeds will benefit the 49ers Foundation. Ticket information can be found here.

"It's a great opportunity for us," Lynch continued. "Last year was our first year, obviously, but a great opportunity for us. Our leadership team and some of our players, Joe Staley last year stole the show as he often does. But a great opportunity for our fans, The Faithful, to kind of get a behind-the-scenes look and see the personalities, my leadership group in terms of the front office – (vice president of player personnel) Adam Peters and (senior personnel executive) Martin Mayhew will be there, (EVP of football operations) Paraag Marathe. Kyle (Shanahan) is there, a lot of our top players.

"We also get to see some of the behind-the-scenes in terms of what people are going to see in the fan experience in our stadium this year. So it's a great event. We've got a great fanbase. It's just an opportunity to share an evening with them. It will be lots of fun."

Last year's two-hour town-hall-style event took place at the Santa Clara Convention Center and was streamed live from the 49ers' official website, app, Facebook page, and Twitter.

The girl lied.  That has to be the case undeniably.  The question is, which version of her story is the lie?  I’m not sure how you judge one of her stories to have any more credibility than the other.

I generally side with the female accusers in these things and when the partner recants or refuses to cooperate, I do believe they have been paid off.  But in this case there were way too many red flags prior to the hearings.  Then in the hearings we find out she had been arrested previously for doing the same accusation on a previous boyfriend.  Sorry but this time I am believing the jilted lover story.  And you have to believe two people lied if you believe she was paid off (which I normally do).  If you do not believe her original story, then you only have to believe she lied.

Interesting that you are so reliant on the girlfriend’s past but you apparently don’t want to factor in Foster’s past or pedigree in any way.

 
Just dropping in with an honest opinion on this Foster situation. The ex lying is why a lot of fans and people start defending these athletes and other famous people. There's unfortunately just like the scumbags who are guilty, there's plenty of scumbags who will make false reports for an easy pay day. I forget the name of the Texan's player but he was dating and IG model and he broke up with her because he realized she was a total loon. GF apparently started scratching and hitting him in the car and the dude did nothing but take it. EX left the car. There were some stories that she was so mad about the break up she was trying to get him to react and hit her so she could get a nice payday and ruin his life. Dude didn't bite one second of this. This isn't to say Foster doesn't have a past and doesn't defend these guys who think they can do whatever they want either. Just more of an example why many people question these victims so much. Obviously there's scummy people on both sides. Glad Foster hasn't been cut yet until SF knows all the info they need first. I'd hate to see a guy lose his career or job because someone chose to make false accusations because of the dudes past issues and many would believe her. If Foster is guilty F him but if not I hope he learns better judgement and tries to put himself in better situations. Don't date bat #### crazy girls.

Whether she's been previously jailed for a similar offense is pretty easy to prove or disprove. Belief doesn't matter here regardless of one's position. If she indeed had been guilty of said offense before, I'd say it's evidence enough to cast serious doubt in her original accusation.

On the weapons charge, Judge Klippen’s reasoning was there was no violation of federal statutes, and the gun was purchased lawfully.

San Francisco 49ers unveiled a new design for the team's alternate uniforms at the State of the Franchise event on Wednesday night.

The new uniforms resemble the throwback versions the team wore for most of the 1994 season, complete with a throwback version of the helmet. San Francisco won the Super Bowl at the end of that season. Those uniforms were part of the league's 75th anniversary and were a throwback themselves to the jerseys worn by the team during the 1955 season.

The uniforms will be worn for one game during the upcoming season.
 

 
Foster gets his marijuana charge dismissed after taking a course and paying a fine.  Sounds kind of like traffic school after a speeding ticket.  Will be interesting to see if this helps with a potential NFL suspension on the original charge.  Probably not, but guess it can't hurt any.

Players have to follow what is in the CBA. It does not matter what is legal/illegal with state or federal law.

Wonder how long the NFL will maintain their no weed smoking policy.  Just seems so primitive considering its uses in pain management.  They will prescribe opioids but you can’t smoke a blunt. So backward. 

But, since those are the rules for now, these crazy kids need to follow them. Too much at stake to try to skirt them.

I believe some players are smoking weed for pain management. They just stay clean in the off season. The
drug policy is an I.Q. test. If you can't follow it, find another job. Don't get caught with weed in the car or in
public and your good to go.

Not entirely.  There is no "caught with it" in a state it's legalized in, because it's, well, legal.  The player would never be detained, arrested, or charged for something that's not a crime.  The CBA doesn't address possession except insomuch as it's a law being violated, which would fall under the Personal Conduct Policy.  What the NFL/CBA do disallow is the use of pot.  That would be covered under the Substance Abuse policy.

That's if it doesn't become public. Ask Laremy Tunsil about his high school social media mistake. The video of E Eliot
in a head shop will be remembered. O Beckham won't be catching any breaks if he steps over the line. The players

The question was if it mattered to the league.  None of those players was disciplined for those scenarios.
