RB Ezekiel Elliott, LAC (6 Viewers)

Here is a tweet from the DW guy that some have sources here, but yes, no time frame but its clear they were told to submit briefs, otherwise the NFL wouldnt have rushed it in today. Doesnt mean that they will rule, but does point to the fact that they may by this weekend.

With briefing complete in #Zeke emergency motion, and no scheduled court dates this week, 2nd Circuit could decide on basis of papers alone.
Thanks.  I’m still not sure what this means, though.  With all the people following this (Dash, Wallace, Brush, etc) you would think there’d be some report of the 2nd circuit meeting or which 3 judges are considering the briefs, etc.  Most of the news that broke out of NY this last week was later in the day, though, so maybe that’s forthcoming?

They are closed for business to the public, so the docket wont be updated. All this discussion is behind the scenes stuff done through clerks and lawyers. Judges do not need to hear oral arguments to rule, it is at their discretion in Emergency requests.

Are there any out there like me who hope the stay is denied so he can start serving the susp and only miss week 14 of the playoffs? IF he plays this week then the 2nd denies his injunction, its over. He will then miss week 15.

Thought of that, but at this point I just want as many games as possible. No guarantee's to get to the semi's or finals.

That makes sense.  Thanks.

Just a reminder, judges do what they want!

BREAKING: Second Circuit grants Zeke Elliott's motion for a brief administrative stay. He will play Sunday.

CA2 just "certified" its order. Bottom line: Zeke plays Sunday & 3-judge panel will decide motion on expedited basis

Do they?  One judge decides one thing and three days later, another judge decides just the opposite. Seems that this part of the legal system is just seeing who can get paperwork finished in time to find a judge that agrees with them.  Between the Brady back and forth and this nonsense, it's making a mockery of our judicial system.

This is just embarrassing right now. Why did Brady quit and Zeke gonna go to every court in the land LOL.

It's funny because he's going to be suspended AT SOME POINT, he keeps putting it off another week... like death.

Good for the Cowboys.  Bad for Zeke owners if the 2nd Circuit rules next week to deny him the PI.  Means playoff bound teams only get him Championship week.

This is so dumb
It's how it should work.  While there's doubt about what the outcome might be, you can't let damage happen.  It's like when there's a bulldozer on your front lawn but you are fighting the demolition order in court.  Once they roll through your living room it's too late for the court to rule in your favor.  That's what "irreparable harm" means.  Once Zeke misses a game there's no getting it back.  They are going to make sure every T is crossed and I is dotted before letting it go through.  That's the protection you'd want if you were in jeopardy, and it's the protection you'd want for your children if they were.  It's how our justice system works and while it's not always perfect, sometimes it gets it right.  This is one of those times.

Jesus, this is so dumb. Zeke is going to appeal himself right out of the playoffs (real playoffs, not fantasy).

I understand fighting this from an economic perspective. Missed games means missed paychecks and missed incentives. That's something you generally want to avoid. But the suspension is still on when playoffs roll around, he's bound to cost himself more money than if he took this suspension at any other point during the year.

I understand if he believes he's innocence and this suspension has been levied unfairly, he should fight it, but at this point that's not even what he's fighting. This whole thing is so idiotic.

At least I get to trot him out there for one, maybe two more weeks, and then fully drop his ### when this thing comes back into effect.

They have to make the playoffs first

I don’t think it’s his choice. It’s the NFLPA fighting for their rights.

For those wondering about the merits...the judges had them submit briefs, this has a lot to do with the merits. Otherwise they would not have undermined a judges ruling, the statement about the merits is typical regarding and admin stay, kinda of a protection of sorts for peopel thinking a decision has been made. I compare it to the "dont read too much into my questions as siding with one way" type lines. They say it, but we know its foll of bs.

If this process has proven anything to me, it's that the legal system is absolutely bonkers, and there is no such thing as a legal expert. Everyone is throwing opinions at the wall, hoping something sticks, only to have the wall get set on fire and burn everything down with it.

I see some quoting the experts and their predicitons...have we learned still not to do that yet? lol

There is no one on twitter or an expert who has a clue, the 3 judges most likely dont even know how the others lean yet.

I get it, and that's likely the only reasoning that makes sense. The NFLPA is fighting for their rights so that they have an easier path to fight the the CBA in the future. Still, this whole thing feels just so stupid.

Before the Zeke peeps ask: This is an ADMINISTRATIVE STAY. Don't read too much into it re: the merits of the case
Basically they read the briefs only and decide to hear it in court Tuesday, where they go over the facts of the case again (Which means it comes down to Brady again). Why Tuesday?

Pete Brush‏ @PeteBrush  5m5 minutes ago

Next circuit motions day is Tuesday. It seems Zeke's motion will be heard then. He might play this wknd. Might be suspended next wk
.

I haven't read the original decision or even a summary of it.  I had assumed that the Appeals Court would reject the latest request out of hand so why bother.

Only thing I am guessing is that the most recent judge decided based on precedent that it doesn't matter how unfair the process is, arbitration is arbitration, so get lost.  Now maybe the Appeals Court wants to give a little wiggle room to that, so that if the process is egregiously unfair, the courts can still get involved.

At this point, I am desperately hoping he plays week 9 and 10, then after that what happens, happens.  At least I'd be able to cut Zeke if he got suspended later and could use the roster spot for something.  Of course ideally he plays all year.

To me, the only part of this process that could be considered egregiously unfair was withholding the lead investigator's notes from Zeke before the first hearing.  In criminal prosecutions, any potentially exculpatory evidence the prosecution has must be given to the defense, and not doing so is prosecutorial misconduct.  These judges might be looking to enforce something similar here.

I just posted what it means. It's an administrative stay based on the paperwork.

I'm definitely going to need a Schoolhouse Rock "Injunction Junction, what's your function?" video made to help me process all of this.

OMG. I traded the suspended Zeke 2 days ago...so I basiclly owned Zeke for the only 2 days he wasn't valuable. At least I also moved Fuller with him.

:sigh:

I had just gotten used to the fact that I would keep Elliot on the bench until week 15...Now, I have to decide if he is worth keeping on the bench until championship week...short benches, but I am past most of my byes.
