Red Light Camera Ticket, pay or no? (1 Viewer)

I know there have been discussions on these here before and I did a "little" searching first.

I was in Chicago a few weekends ago with my daughter for a dance competition (live in Michigan).  I got a letter last week with pics and a link to a video showing I ran a red light.  At first, I didn't even remember doing anything remotely close to running a red light.  After watching the video, I remembered.  I was turning right, had two cars in front of me and the first car in line must have been surfing facebook or the FFA because he damn near sat through the green arrow.. Took off and it turned yellow while he was in the intersection.. I had cars behind me laying on the horn because of this ##### and the light turned red before I could get through.  It was a right turn, no traffic was coming, but technically, yes, I ran the red light.  

The yellow was almost non existent.. went from green arrow to red with a "flash" of yellow it seemed like.  What are my options?  It's $100 ticket..

What happens if I don't pay it? Should I stay out of Chicago forever?

 
The ticket isn't to you (John Doe) and won't impact your insurance since they can't prove you were the driver.

From experience, if the car is leased, the bill goes to the bank that owns the lease and they just add it to your monthly nut. In this scenario you just have to pay and move on. Not positive how it works if you're the owner of the vehicle though.

These tickets from cameras are the biggest crocks of #### ever.

Try going to court. I've heard of that working in MD a few times. Since you can't face your accuser in court, you could win.

 
I think if you view the video they know you got the ticket. In AZ, if you completely ignore your photo tickets they have to have someone physically serve you. My brother had over 20 tickets he never paid and nothing ever happened. But I think you'll have a hard time saying you didn't get it if you viewed the video.

This was an issue in NJ.  Turns out one of the makers of the cameras had to settle a suit as the yellow times had not be certified.

From the start, however, the program was riddled with controversy. The biggest issue was in June 2012 when the DOT temporarily suspended the program after doubts about whether the yellow-light timing was too brief at some intersections.

The program suffered other high-profile set backs.

In December 2012, one contractor, American Traffic Solutions, had to refund a total of $4.2 million to 500,000 drivers who received tickets at 18 red-light camera intersections because of the timing of the yellow-lights had not been certified.

 
I think if you view the video they know you got the ticket. In AZ, if you completely ignore your photo tickets they have to have someone physically serve you. My brother had over 20 tickets he never paid and nothing ever happened. But I think you'll have a hard time saying you didn't get it if you viewed the video.
Never watch the video.

 
There's a famous story where a man receives one of those camera tickets in the mail showing him running the red light.  

But since there's no other physical evidence the man sends a photograph of a check for $100.

The police then show up to his house and shoot him in the face.

Or something like that.  I don't really remember.

 
I got one several years ago and never paid it.  Some law firm sent me some letters requesting payment then they gave up.  Nothing happened.

 
Can you see yourself in the video?   If yes, pay it.  If not (if it's just your car and you can't make out who is driving)....

To Whom it May Concern,

I received a letter claiming I committed a violation of a speeding law in (city) on (date). As per the instructions, I am writing to plead ‘not guilty’ to this charge. Although this option is said to result in this matter going to court; it is my suggestion that the charges simply be dropped. This suggestion comes out of respect for tax payers, and my request that their hard earned money not be wasted in such proceedings. As there is no evidence of my involvement with this alleged ‘crime’,  and as I am not granted my 6th amendment right to face my ‘accuser’ (a camera); I see no way the government could prove my guilt beyond a reasonable doubt. I also see find no legal requirement for me to implicate someone else in this process, as it is the government’s responsibility to prove a person’s guilt. It is also my 5th amendment right to remain silent on the matter.

If it is the government’s decision to move forward in this matter, I would request copies of any evidence the prosecution may have of my involvement in the “offense”; as well as, all maintenance records for the camera(s) involved.

Yeah, that thought went through my head briefly as I was putting in the notice # to see the video.. I really wanted to see it because I honestly didn't think it was me because I couldn't remember running a red light.

edit:   I am aware the above is the snail mail equivelent of "AM I BEING DETAINED?!?!?!?"  but you're dealing with a court clerk and not a potentially angry cop who can ruin your month on the spot.    It may work.  It may not.   But I don't think it will make things worse.

Every state handles red light tickets differently.

AZ doesn't give a #### other than collecting your $100 and if you can dodge them for 90 days it is forgotten about. No insurance points, no credit ding, no warrants. I ignored a couple and never had any issues even when pulled over for future violations. I did have a buddy who wouldn't answer his door for a few months because every time someone knocked he thought he was about to get served :lol:

LA apparently is really strict with them, or at least certain cities are, and they will boot your car if they scan your plate years later and you have unpaid red light tickets.

NM and NC have ruled them illegal and taken down all of there cameras.

Your best bet playin4beer is to talk to locals in your state (MI I'm guessing) and find out the repercussions of not paying. The most responsible thing to do would be to pay it, not out of civic duty or any such nonsense, but because you don't want to get pulled over some day months down the road after you have had a few beers due to your tags being flagged.

Kutta, have they taken down the cameras on the 10, 101, 202, etc? I thought I heard all of the in town cameras were removed but they left the highway cameras intact. It has been a while since I've been back to Phx.

Good idea... Sounds like I should check with my sister with fake boobies... She's dating a captain or lieutenant or something like that... higher up than a regular joe policeman I guess...

Actually I had a post about it years ago when she had it done... complete with before and after pics..  Fully clothed of course, I'm not a sicko.. ;)

 
In chicago declared illegal by a judge. Chicago might have to pay back fines. Something along the lines of due process not granted and the yello times too short.
