[UPDATED] Landlord 1 - Tenant 0 (1 Viewer)

Alias

Footballguy
I moved out of my apt. yesterday but there is still a lot of crap I need to throw out from old place (bed, trash, 200 lb TV).

The management company that manages my building has been hounding me to move out early since they have a new tenant lined up for April 1st. My lease is until March 31st so I should have some bargaining power here.

The way I see it I can give them a few options, let me know if there are better options.

1. They can give me my 2.5 months security deposit back and accept the apartment "as is" meaning they are responsible for cleaning everything out.

2. They can prorate my rent for this month, giving me an immediate refund (~$375) and I will hire a company to remove the bed etc... (it's a 2 flight walk-up). Additionally they will have my security deposit check in hand to do an inspection and release the check to me this Friday as well.

3. They can wait until March 31st, giving me about 2 weeks to remove the stuff from the apartment myself.

Out of the three options I would want them to take option 1, which I think they may want as well since they already have a crew that they want to bring in and do work. So maybe my best bet is just give them option 1 and if they want to inspect the apt. first, I can negotiate to option 2.

FREE TV By the way if anyone is in or around NYC and wants a 36" Sony XBR (2000 model - no HDTV but SUPERB for EDTV) for free, let me know and you can come haul it away - includes the headphones it came with it and the stand ($500 value)

I think this is the same TV that I have: Ebay Listing

Weber Grill (I do not have this 1, it is the one from a year or two ago, but same features)

http://www.weber.com/bbq/pub/grill/2005/charcoal/cg_p.aspx

For the grill you would need to disassemble it outdoors, and bring it in through the window. I think I paid about $400 for the grill new

If you don't care about leaving before the 31st...tell them you want the security deposit back in full when you leave, plus your prorated rent. Your doing them the favor, make them pay for it.

Why would you be giving the TV away for free?
Because it weighs 180 pounds - I might be able to get a hundred or so for it, but I would rather not deal with it - I was thinking of giving it to the Salvation Army - I believe they pick it up and I might get a tax credit for it?

I have friends in NYC right now. Can I send them by for the TV? :)
If you are serious you can swing by at lunch time. I also have a 5 CD changer you can have (saw your other post) AND an Onkyo Receiver. You would have to take the stand too though - came with the TV.

I'll stay posted on the grill if thats ok, if its not gone by tomorrow, I'd love to hop on it, but if someone can get there today, a bird in the hand.

It's a sweet grill - I never used the gas hookup, I just did it the old fashioned way with the charcoal. I would take it with me, but I do not have any outdoor space at my new apartment.

UPDATE - they are going to have to inspect the place before they give back any security - so that idea is out the window. It looks like the bulky items might be ok (the new tenant may take the TV) - the grill is still up for grabs, but he may take that too if nobody else wants it - but it would be a shame to let that puppy slide.

how clean does this place have to be when I move out? Anyone know nyc / NY law? This is my first apt. in New York. Do I need to clean the bathroom / inside the fridge? I doubt they can withhold security deposit for that stuff.

Alias, where are located in NYC? I can pick the TV if you still have it.

Why wouldn't you return it the way you got it?

yes, they can deduct for cleaning fees. you should clean - sweep, empty fridge and the like - the entire place. it's a hassle, i know...

So check this out - I stop by the apt. to see if they took the TV or not, only to find out the TV is still there, but they decided to steal my Carver Monoblock amps - which I just found a buyer for $900. I am going to unload on this guy tomorrow, what a crook!

I'm in Nyack. How close are you to there and what items are still available? I might be able to come by tomorrow.
30th and 2nd Ave in ManhattanI have those monoblocks that I am selling for $900 for the pair (I paid $3k for them when I was in college) - they output 550 W per channel - some serious wattage, you probably want to get them serviced - I believe you can send them to Sunfire.com (the new carver) - you just need to get an RMA first. I already have 2-3 offers on these so the price is not negotiable.

Onkyo PreAmp - was going to bundle that and a Sony 5 disc CD changer with the pair of amps.

Two Boston Acoustics bookshelf speakers - make an offer - they are 3 way speakers, not sure of the model, I can check tomorrow (rated at 150W I believe)

20" Toshiba TV - but you don't want that, the picture I think is crap (over 10 years old)

36" Sony XBR - weighs 180 pounds - you are going to need a friend to help you carry it down two flights of stairs - this comes with the original wireless headphones, remote control and TV Stand - all for Free

Weber Grill - linked above - Free - but you probably need to disassemble before taking it off the deck (through the window)

Do landlords ever return the security deposit? I thought standard procedure was to make up a list of repairs and then keep the security deposit, not do the repairs, and repeat the procedure all over again with the new tenant.

It wasn't very clean when I moved in, in fact for my new apartment I had to clean it as well.

Why did you rent it then? More demand then supply? Down here that type of condition would leave a place vacant indefinately.

welcome to nyc - way more demand then supply - I had to pay 15% of the annual rent for a broker's fee for my apartment - the place was clean, but the fridge needed cleaning inside, floors needed to be swept and mopped, bathroom needed to be cleaned, etc...

I would like the preamp. I have a Carver amp that has been sitting collecting dust. It is not real easy to find a preamp for cheap. I bought a reciever off of ebay to use as a preamp for it. LMK. Thanks.

Let me verify it is a true preamp first, it might have been a receiver (less tuner) with preamp outs - but you may not care. It all boils down to if the person that buys the mono's wants it or not - I will let you know.

Cool. I am trying to find someone in NYC who can pick it up for me unless you would ship it to me. And possibly the TV if not spoken for yet. Thanks and good luck with your move. Dennis.

Shoot me a PM, dude, I live in NYC as well, have a car, and can take as much away tomorrow or Thu as you like. Dunno what you have left, but I cvan find a home for all that gear.

How did I get redirected to craigslist? :confused:

I called earlier today and spoke with someone else - I told this person that my TV was not removed and that my amps were missing and was told Tyrone will not be in until 2PM.

I just called to speak with Tyrone - the lady that picked up said he is going to call me back. :hot:

I called back and got him on the phone he said they (his friends not him) went to take the TV but it was too big and they were going to come back for it. I told him that they took my amps and I need them back ASAP. He thanked me for telling him and told me he would call them and make sure they return it. If he doesn't call me by 4:30 I am considering calling him back for an update and talking with his boss if I do not hear the answer I am looking for, and then may pay a visit to the police station.

I can't make this crap up...

So he calls me back, turns out some lady was going to pickup my 180 lb. TV, the super of the building let her into the apartment. He saw the amps and assumed I didn't want them so he took them to his other building and put them in storage. Somebody that works for him took them out of storage (all in a period of 24 hours) and now "they are trying to track this guy down and if they cannot find the amps then they will pay for them." he asked me how much and I told him I have someone that will pay $900 for the pair.

Ok after what happened yesterday they do not want to deal with removing the TV, he told me to call the Salvation army or something.

So does anyone want this TV?

Sony XBR 36" - in good condition, comes with wireless headphones and TV Stand (stand was worth $600 new - I paid like $4k for the TV back in 2000). You would need to pick it up and have a strong friend with you to lug it down two flights of stairs - the TV weighs about 180 lbs. Let me know by the end of the day or I am having the Salvation army take it away - did I mention it's FREE?

Ok TV is getting picked up by the Salvation Army.

I just got off the phone with the guy from my landlord's office.

Now the story is, the super took the amps because he thought I did not want them, and he put the amps in storage at another building next to some pieces of electronics equipment that were supposed to be recycled.

Apparently the amps were taken with the rest of the electronics equipment to get recycled and there is no way to get them back.

The guy from my landlord is telling me the super will pay for the amps but the super knows a thing or two about electronics and said the amps did not work. This wreaks of :bs: The only way he would have known they do not work is if he happened to have a preamp, audio source (CD Player) and speakers in this storage unit and hooked it all up before they accidentally got recycled.

Anyway the super wanted to negotiate the replacement price on the amps he stole. I am holding firm on my $900 since I have an email from a guy that was willing to pick them up the same night I put the ad on CL, I just faxed that to the guy at my landlord's office.

Stick firm on that Alias. Make sure you leave an upper decker in the toilet when you leave.

I made sure to tell Tyrone (guy at my landlord's office) that I WILL be filing a police report if I am not repaid the value of the amps. Hopefully that will light a fire under his butt and pay up.

I'm way late on this I know, but the TV is gone? It's awfully tempting to make a trip into the city...

Bet the amps just happen to *magically* get saved from being recycled now.

Salvation army is picking it up tomorrow - sorry dude - it is a beast, you can buy a better TV that weighs a fraction of this one and get HD (this set is not HD capable, but does make a SWEET EDTV).UPDATE - If my amps do not show up tomorrow my landlord is doc'ing the Super $900 from his paycheck and will pay me directly. :thumbup:

Tell your landlord you are a FBG. You've got a team of a hundred lawyers on your back.

*** another update ***

I spoke to my contact at the landlord, when I asked him about the check for the amps his response was, "hold on a second while I transfer you to my boss so you can schedule a time to pickup your security deposit"

L = landlord, A = Alias

A: I wanted to confirm that in addition to a check for my security deposit I would be getting a $900 check cut for the amplifiers that were taken.

L: amps what amps?

A: I was told you would be cutting me a check after you dock his pay

L: Oh the amps the super stole, we are not responsible, we will talk later

A: I was told you would be cutting me a check after you dock his pay

L: Well they have not paid up yet, we will talk later

~~~~~~~~~~
My question is when I do go visit him to collect my security deposit what information can I provide to him to encourage them to pay up?
My thoughts -
I will be filing a police report and your company will be the prime suspect for my stolen amps - Keys were given to your firm and are held responsible for items stolen. Tyrone who works for you told me the super stole the amps and that your firm was going to reimburse me and now you are changing your story.
