The real question seems to be what charges the FBI will recommend filing and how many close Hillary aids will be included.  There are really so many options.  Many potential perjury traps with the upcoming interviews.  Maybe bribery/selling influence.   Obstruction of justice is in play.  Let's not forget mishandling of classified data.  

 
I thought we were in dire need of one which would keep an appropriate thread title. Tim will be in denial even after Hillary is fitted for her orange jump suit.
Works for me. But ever since we learned she deleted 30,000 emails, I sort of thought the Hillary 2016 thread WAS the "Indictment Watch" thread.

Good to see you resorting to high quality sources like Media Matters!  i was a bit concerned I may have jinxed the whole indictment thing by starting this thread, but your double-dog reverse jinx posting has me more confident than ever. 

 
I heard on the news yesterday that the state dept was dropping their investigation. It took some research on my end to find out it was because they were letting the fbi take control of the case. It's amazing how things get spun.

Yeah.  At this point the FBI does not really care what the state department thinks.  I kind of doubt the FBI major focus is the classification of the material.  There are lots angles the FBI maybe taking.  If I were an aid to Hillary, I would be more than nervous. 

 
Lynch will never prosecute her
It would be incredible if she did being not only a Democrat, but a former Clinton appointee.  But Lynch has some integrity compared to Holder, which I know is not saying much.  But if the FBI does recommend charges, it will be enough to derail her nomination, IMHO. 

 
No it won't. Never underestimate the ability of partisans to deny reality, IE Trump supporters currently.  Dems will just continue to support her and say it's a bogus indictment

I'm not sure what all happened with these emails but I trust that you guys will get it all figured out and come to a consensus by page 8.  I'll check back.

I was kind of also thinking that the Hillary supporters may require a safe-space for when the indictments comes.   Tim thread would be that space and this thread we could openly discuss the reality of events without the fear of offending the faithful.  

 
Can we bet here on whether she'll be indicted? Considering how certain the OP is, I'm thinking I could get good odds on betting that she won't.

Of course having a former Clinton appointee indict Hillary would be an amazing hurdle to jump, but based on the seriousness and the level of effort the FBI is putting into this, there probably will be indictments recommended.  

 
I'll just throw this out here. It seems like a pretty neutral recitation of the facts. It is from Reddit - however it comes from a poster named "NebraskaGunOnwer", nonetheless it seems dry and tidy enough that it's worth posting.


The known facts of Hillary Clinton's server is already worthy of indictment

2009 - Hillary brings online a private server located in her home in Chappaqua NY.

2009 - 2013 - During Clinton's tenure as Secretary of State she never used a provided .gov address.

Summer 2014 - The congressional committee investigating the attacks in Benghazi requested copies of Clinton's emails during her time as Secretary of State relating to the attacks. Thus revealing the existence of the private server.

December 2014 - Clinton turns over 30,490 emails she deemed work related. Soon after it is revealed that she deleted 31,830 other emails that she described as personal in nature. She deleted these emails after they were requested, and two years after leaving office.


"I chose not to keep my private personal emails — emails about planning Chelsea’s wedding or my mother’s funeral arrangements, condolence notes to friends as well as yoga routines, family vacations, the other things you typically find in inboxes"

In a letter provided to the committee, Kendall said Clinton would not be turning over the server to a third-party for review and that the emails no longer exist on the private server located in her New York home. “There is no basis to support the proposed third-party review of the server that hosted the hdr22@clintonemail.com account,” Kendall wrote. “To avoid prolonging a discussion that would be academic, I have confirmed with the secretary’s IT support that no emails…..for the time period January 21, 2009 through February 1, 2013 reside on the server or on any back-up systems associated with the server.”



March 2015 - The first publication that Hillary used her private server exclusively.


"I opted for convenience to use my personal email account, which was allowed by the State Department, because I thought it would be easier to carry just one device for my work and for my personal emails instead of two."



August 2015 - Reports first surface of an FBI investigation into Hillary Clinton's server. Hillary turns over her server

March 2016 - Bryan Pagliano, Clinton's IT staffer who setup the server, is granted immunity in return for cooperation.

Clinton, on her private server, wrote 104 emails the government says are classified

At least 2,079 Clinton emails contain classified material

Inspector General Released Memo


“These emails were not retroactively classified by the State Department; rather these emails contained classified information when they were generated and, according to IC classification officials, that information remains classified today. This classified information should never have been transmitted via an unclassified personal system.”



Before starting in her role as Secretary of State, Hillary had to read and sign this agreement NDA Agreement


  1. Intending to be legally bound, I hereby accept the obligations contained in this Agreement in consideration of my being granted access to classified information. As used in this Agreement, classified information is marked or unmarked classified information, including oral communications, that is classified under the standards of Executive Order 12958, or under any other Executive order or statute that prohibits the unauthorized disclosure of information in the interest of national security; and unclassified information that meets the standards for classification and is in the process of a classification determination as provided in Sections 1.1. 1.2, 1.3 and 1.4(e) of Executive Order 12958, or under any other Executive order or statute that requires protection for such information in the interest of national security. I understand and accept that by being granted access to classified information, special confidence and trust shall be placed in me by the United States Government.
...I understand that if I am uncertain about the classification status of information, I am required to confirm from an authorized official that the information is unclassified before I may disclose it...

...4. I have been advised that any breach of this Agreement may result in the termination of any security clearances...



Let me stress these final points.

There are many other aspects of this investigation that have potential to result in indictments.

Clinton and her staff using unsecure Blackberry's after being denied by NSA and State

Clinton Foundation receiving millions from middle east countries after Hillary negotiated record breaking arms deals for them

Ultimately, there is so much of this that we don't know. The FBI has gotten access to the deleted emails through Platte River Networks which didn't have the clearance to handle them. Employees at Platte River feared a coverup was happening.


“Any chance you found an old email with their directive to cut the backup back in Oct-Feb,” one Platte River employee asked another. “I know they had you cut it once in Oct-Nov, then again to 30day in Feb-ish.” “Starting to think this whole thing really is covering up some shaddy ####”



Just looking at the facts we know, it is clear that Clinton and her aides have broken the law.

Title 18 Section 1924


Whoever, being an officer, employee, contractor, or consultant of the United States, and, by virtue of his office, employment, position, or contract, becomes possessed of documents or materials containing classified information of the United States, knowingly removes such documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than one year, or both.



Title 18 Section 793

Pretty much all of it


(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer— Shall be fined under this title or imprisoned not more than ten years, or both.



UPDATE

I wanted to add one more piece of evidence that is almost more cut and dry. Clinton emailed regularly (alt source) with Sidney Blumenthal, he had at times emailed GAMMA compartment info to her, essentially information at the highest level of classification. It requires no markings, and can only be viewed in SCIFS or other secure channels.

If we look at Title 18 Section 793, It was Clinton's responsibility as Secretary of State to make a "prompt report" as this is a felony. Sidney Blumenthal was an Employee of the Clinton Foundation and did not have the clearance to handle any of this.

Unbeknownst to Hillary, his AOL account was compromised by the Romanian hacker "Guccifer" who was recently extradited to the US. If Hillary had "promptly reported" this breach into our highest level intelligence, it might have dampened the leak.

- I'm not going to argue one way or the other, I just thought this might be useful albeit I'm guessing from what is a likely conservative, anti-Hillary Reddit poster.

However the links there seem verifiable enough if anyone wants to tackle them. The only part I have highlighted is the part about the non-disclosure agreement because it seems to me that is the element which gets to the crux for most legitimate arguments, the "knowingly" part and "gross" part in secs. 1924 & 793.

Tom DeLay? Seriously? He has friends at the FBI?  I won't believe this until Dennis Hastert confirms it.

Yesterday on Today Hillary told Matt Lauer that it's just a "security review" and that these happen all the time. I have a question: when Hillary says "security review" what is she talking about?

Can someone provide a link explaining what a security review normally is, outside any connection to this situation?

I was yelling at the TV when she said that and Lauer didn't nail her on it. A security review with how many FBI agents assigned to the case, really?

From Whitewater to the Lewinsky affair, David Kendall has been there for the Clintons. And now LawNewz.com has learned that the longtime Clinton attorney is also representing Hillary Clinton in the FBI’s probe into her private email server. He will likely not be far when she is interviewed by the FBI, which is expected to happen soon. Kendall knows a thing or two about classified information: He helped former CIA director David Patreaus avoid felony charges when Patreaus allegedly gave “black books” to a mistress who was writing his book.

Several reports indicate that the FBI investigation has entered its final stages. So it is no surprise that Clinton would need a lawyer by her side, and who better than the man who has been loyal to the Clinton family for more than twenty years. The choice of Kendall is not shocking as he’s also been handling the State Department and Senate’s inquiry into her private emails for months now. There was some speculation that as the investigation reportedly intensified, she may hire another attorney to deal with the FBI’s probe specifically, but Clinton is staying with a friend she knows well.

Kendall is known to be somewhat media shy and usually avoids the spotlight (he turned down an interview for this profile piece). He first got to know Bill and Hillary Clinton as their classmate at Yale Law School in the 1970s.

Kendall joined the white shoe Washington D.C. law firm Williams & Connolly in 1978. On his own website’s bio, it says “David Kendall has had a checkered legal career. His acquaintance with the legal process began when he was arrested several times (but convicted only once) in Mississippi during the summer of 1964 while attempting to register voters.” He started off his career defending civil rights cases at the NAACP Legal Defense & Education Fund. He won the famous Supreme Court case, Coker v. Georgia which declared it unconstitutional to execute someone who committed the crime of rape.

But unequivocally, what thrust him most into the (unwanted?) spotlight was his defense of the Clintons over the last two decades. According to a 1998 Washington Post article that detailed the key players in President Clinton’s Lewinsky scandal, Kendall certainly has his critics:


Second-guessing Kendall has become a bloodsport in Washington where some of his fellow lawyers fault Kendall for not having Clinton come forward earlier with the truth about Lewinsky, for letting him testify … They also blame Kendall for pursuing a legalistic argument — that receiving oral sex did not constitute a sexual relationship — that has proved widely unpalatable.



Last year, he ran into media scrutiny again when he kept a thumb drive that contained potentially classified emails from Clinton’s private server at his law firm.

“In most situations like this you’d expect that a warrant would be issued and the Marshals and the feds, FBI, somebody would go and get the thumb rive and take it somewhere where it would be considered safe by the government,” national security attorney Edward MacMahnon Jr. told Fox News back in August.

Despite his forays with controversy, Kendall has a reputation as a dogged attorney with a great deal of integrity. He’s represented a wide range of white collar, and corporate defendants including Arthur Andersen in the University Savings Case in Houston.

Washington D.C. insiders suspect that Kendall is working closely with a team of attorneys as the FBI probe reportedly wraps ups. FBI director James Comey has kept the details of what their probe entails — and if Clinton is even a target — under close wraps. In fact, agents working the case have reportedly been told they will be polygraphed from time to time to avoid leaks. If charges are even recommended by the FBI, U.S. Attorney General Loretta Lynch would also need to sign off on them. Kendall clearly is well aware this case has implications far beyond the legal matter at hand. He is certainly no novice at waging legal warfare for the Clintons, and this case will  prove no exception.

TBH I was thinking Kendall might actually have to get his own counsel and would be conflicted out because he too would be under the microscope for mishandling classified data. If he is actually representing Hillary himself I'm thinking there is no such concern. Otoh I guess there isn't anything he could be asked a witness which he could also be asked as an attorney, but then I'm sure he will be objecting and claiming that questions cannot be answered on the basis of privilege for just that reason. Almost everything Hillary did was with attorneys, Kendall and Mills especially. - eta - Samuelson's an attorney too. They can all try to say they're just not answering questions because everything's privileged.

That is how she constantly skirts the law.  Hillary knows what it takes not to get caught.

 
Team Hillary’s final e-mail defense: mass amnesia


It was another week of news poking fresh holes in Hillary Clinton’s tattered e-mail defense. At this point, the only cover she has left are all the ongoing stonewalls.

One landmark event came Wednesday, when presidential spokesman Josh Earnest for the first time referred to the FBI’s probe of the e-mails as a “criminal investigation.”
