What would happen to you if you tested positive for drugs? (1 Viewer)

Obviously this stems from the Josh Gordon suspension and debate about the penalties for recreational drugs in the NFL and other work places.

Say you were charged with possession of marijuana, whatever your state's laws which would penalize you with a fine but no jail time (for NC, 1/2 oz or less). What would your employer probably do? Would you lose your job? Be put on suspension or other similar sanction?

In my job, you'd probably be fired. We might put you in jail although that's unlikely with possession of a small amount, especially if the civilian court is handling it. Presume firings for cops, teachers, and other positions of trust, but is this accurate?

 
In my line of work, the only way you would get tested is if you had an accident. Then you're kinda hosed if you test positive.

 
I work for myself now, so no worries. I just retired from a job as a high school administrator. No school in my state tests teachers (or admins), so nothing.

Forgot about that.. I think in our company we have a mandatory drug test for work place accidents. Considering we drug test new applicants, I'm assuming that a positive test would result in a minimum of not paying workers comp.

It's funny because when I used to play disc golf a lot guys used to always offer me hits of their weed. I don't smoke but have no problem with it. I would usually just answer "Aw man...I can't. I'm a teacher." Usually the reaction would be "Oh, yeah. Guess you can't get high, huh?" :lmao:

 
I'm not sure how they would handle it. I'm personal friends with my boss who is the President. He'd be pretty disappointed and give me a stern talking to, but I don't think I'd get fired.

 
Most employers don't have the authority to "throw you in jail" if the civilian court doesn't, so chances are the military response is going to be a different animal than 99.9% of civilian job responses on a number of fronts.

 
Good chance my employer wouldn't even find out, so nothing. If they did find out, no idea. Based on my track record I'd think I could save my job, but they might have no choice but to let me go.

 
No clue. I was drug tested when I hired in 13 years ago but I don't know anyone who has ever been tested again or had any trouble because of drugs.

Of course if I was in the union that the hourly guys are in I could deal drugs and I would get sent to treatment before eventually being hired back.

sure, but that's why I'm asking the question.

Presume your boss did find out, whether through word of mouth or the cop that issued the citation is buddies with your boss.

 
Probably some type of probation and mandatory testing for a while. Unless I tested positive after an accident.

 
Me? Nothing would happen. But I'm guessing for many if it's a work situation you're probably going to be fired because you either had to pass to be hired for your new position or just dropped four ton steel beam on a truck or something along those lines. Two out of three situations I've seen where drugs have been an "issue" with somebody, they were offered the option of going to rehab and having their job waiting for them when they got back.

 
I'll tell you one thing...if I test NEGATIVE for drugs, that test kit must be expired or made in Taiwan amiright???

 
I presume we're talking about illegal drugs here. Once marijuana is legal, the debate should be over -- employers shouldn't have the right to information about an employee's use of it.

After Hobby Lobby, I'm not so sure you'd be right even if every state legalized weed.

I wish that was true, but don't think it's going to be that way.
Not in my line of work it won't be. Mary Jane will still be a security risk, so unless I find another line of work I'll have to stick to Busch Light.

 
Employers should have to apply for special exemptions to the no-testing rules that we should have. Accounting firms and football teams and a host of others wouldn't qualify for it.

I work for Uncle Sam and he frowns on things like that. Been here 27 years and never had a drug test though. Not that it matters, they would only find alcohol in my system.

And besides, you think they won't use the same insurance argument they use to ban tobacco?

 
Not sure but it will never happen as I won't take the chance.

I had to pass a drug screening as part of my interview, so I assume there are major ramifications for failing. But I've never actually taken the time to look as it doesn't really concern me. So I guess the answer as to what would happen if I failed one... I'd be looking to hire a lawyer to fight the false positive.
