Last Tuesday, Senate Minority Leader Mitch McConnell was asked whether he would try to pass a national abortion ban if the Supreme Court overturned Roe v. Wade, as it appeared poised to do, according to the leaked draft opinion that had been publicized the night before. ....By Thursday, however, McConnell was apparently willing to say the quiet part out loud. Asked by USA Today whether a national ban “is something worthy of a debate,” the top Senate Republican said Republicans might indeed entertain the idea, according to the interview, which was published on Saturday. “If the leaked opinion became the final opinion, legislative bodies—not only at the state level but at the federal level—certainly could legislate in that area,” McConnell said. "And if this were the final decision, that was the point that it should be resolved one way or another in the legislative process. So yeah, it’s possible....”
As NBC News pointed out, “It’s unlikely that any legislation to outlaw abortion—or enshrine it nationwide—would gain 60 votes in the Senate in the near future”—circumstances that render Democrats’ plan to force a vote to codify abortion rights into federal law this week all but doomed. Some Democrats, such as Sen. Bernie Sanders, have proposed changing the filibuster in order to pass legislation that codifies Roe into law with a majority vote. But “even if Democrats could somehow eliminate the filibuster and muster 51 votes to codify Roe,” The New York Times notes, “the move could backfire; a Republican majority in Congress and a Republican president could then ban abortion nationwide with 51 votes....”
In his USA Today interview, McConnell insisted that if Republicans retake the Senate in this year’s midterm elections, he would not end the filibuster to pass legislation on abortion. “No carve out of the filibuster—period,” he said. “For any subject.” But McConnell could change his mind on the filibuster at any point....

Rep. Mike Kelly’s (R-Pa.) Heartbeat Protection Act would create a federal ban on abortions after a heartbeat is detected.
Rep. Jody Hice’s (R-Ga.) Sanctity of Human Life bill would “declare” human life as beginning when sperm fertilizes an egg, and that as such, those fertilized eggs would have constitutional rights.
Rep. Alexander Mooney (R-WV) Life at Conception Act would provide 14th Amendment protections—namely, the right to life—to any fertilized egg.
Rep. Mike Johnson’s (R-La.)’s Child Interstate Abortion Notification Act would make it a federal crime to transport a minor across state lines for an abortion without parental consent.
Rep. Debbie Lasko’s (R-Ariz.) Dismemberment Abortion Ban Act would prohibit most second-trimester abortions across the country.
These bills have widespread Republican support. Each has at least a dozen cosponsors. Mooney’s bill has more than 160. A conservative House Republican caucus—the Republican Study Committee, of which roughly 75 percent of House Republican are members—also supports this entire slate of legislation....
.....These Republican-authored bills stand no chance of passing in the current Congress, with both chambers narrowly controlled by Democrats. Nor is it likely that any of these bills would be signed into law by Democratic President Joe Biden, even if Republicans were to win big in the November midterm elections and take back control of both congressional chambers. But these anti-abortion bills do indicate GOP intentions. Essentially, they form a roadmap showing how the party may try to govern the next time they have the power—in both the White House and in Congress—to do so....
Through Article 1, Section 8 of the Constitution, Congress has the power to regulate interstate commerce: essentially, it can intervene in state matters that have substantial effect on the national economy....That doesn’t mean Republicans wouldn’t try to push through their bills. The Constitution gives Congress the authority to enforce the 14th Amendment, which forbids states from depriving “any person of life, liberty, or property, without due process of law.” Republicans could therefore argue that Congress has the power to enforce 14th Amendment protections on behalf of fertilized eggs and fetuses. The Supreme Court, though, has also ruled that Section Five of the14th Amendment does not grant Congress the power to create new rights or expand existing rights....Theoretically, Congress could also argue the Commerce Clause gives the legislative branch broad authority to enforce abortion laws—either codifying the right to an abortion, or enacting a nationwide ban—if the justification for either law was based on how such a law would impact the national economy....

Let's look at the current landscape. Team Blue has the sitting POTUS and a majority on both ends of Congress. Biden, whom was the VPOTUS under the Obama regime, like his boss, Cool Guy President, did exactly zero about the Freedom Of Choice Act when the Democrats had a super majority back then. Promised to deliver on abortion rights and then didn't lift a single damn finger about it. Biden did absolutely nothing about abortion rights until he was cornered when Roe was overturned. One could argue he's still doing nothing. Like everything else in this disaster zone of an administration.
If the GOP retakes Congress at the Mid Terms, they will still be roadblocked by Biden, however if Team Red in 2024 has the sitting POTUS, a super majority in Congress ( or enough numbers to kill the filibuster) and the reality of a Conservative leaning SCOTUS still exists ( bolstered by Trump's three FedSoc Conservative Catholic choices in Kavanaugh, Gorsuch and Coney Barrett) , it's entirely possible that the GOP will push for a widespread ban on abortion and codify that into federal law.
So Biden could push for killing the filibuster, but it risks that being used against Team Blue later ( Just like nuking the judicial filibuster did. Thanks Harry Reid.) He'd also have to cut a massive deal for Manchin which might not be possible at this point.
Did Mitch McConnell and Mike Pence really say they'd go for a federal abortion ban? Despite the screaming of the activist complicit MSM, Cocaine Mitch simply said anything is possible, everything is on the table to be discussed and Pence just gave more typical ambiguous political double talk that can be interpreted in one of four different ways.
Team Blue then has concerns that even without a widespread federal abortion ban, the various bills that the GOP could push through if they have enough numbers, will chip away abortion access to the point where it functions almost exactly like a nation wide abortion ban. But the counter context is most Democrats are still in support of the Women's Health Protection Act, with it's broad overreach far beyond what most polled Americans say they want regarding abortion laws and abortion rights.
And of course, our favorite, Nancy Pelosi, has stopped begging for 15 dollars and creating an On Demand Liquor Store for Congress long enough to ignore that the right to bear arms is actually within the text of the Constitution and abortion is not.
Will The GOP Push For A Nation Wide Federal Abortion Ban In The Near Future at the first chance they get when they have the needed majorities to do so?
