But I agree that his statement about democracy being threatened by the global right was overbroad. The problem isn't global. Ex-FBI official says law enforcement needs to take upcoming right-wing rally in DC in DC 'very seriously.’

Homeland Security Intelligence chief John Cohen told CNN last month that online extremist rhetoric is strikingly similar to the buildup to the January 6 attack, with increasing calls for violence linked to conspiracy theories and false narratives.

CHICAGO (WLS) -- A new court filing obtained by the ABC7 I-Team lays out new information from the accused leader of a plot to kidnap and kill Michigan's governor.

Federal law enforcement officials say Adam Fox was the top henchman of a militia plot targeting Michigan Governor Gretchen Whitmer and others.

According to court documents, Fox is preparing an entrapment defense, alleging that the kidnap scheme was concocted by a man known as "Big Dan" and other FBI undercovers whom Fox claims were informants run wild.

Commando drills, secret Midwest militia meetings and plans to kidnap the governors of Michigan, Ohio and Virginia - possibly through public executions - were manufactured plots by government informants according to Adam Fox, the accused leader of the alleged violent uprising.
 

In the latest court filing, Fox alleged at least three FBI informants "invited and encouraged him to participate in the events that they now claim are overt acts in support of the crimes."

Fox and his attorneys claimed it was done in a manner that "can only be described as predatorial."

Fox is asking for text and telephone data relating to the informants, especially someone nicknamed "Big Dan," who he claims was his primary contact.
 

Fox maintains the plot to attack Whitmer's summer home or her family's boat, the hand-written notes and the plan to blow up a bridge near the governor's home were all based on contact initiated by the federal informants.

Fox claimed those informants made up stories, and illegally encouraged criminal conduct, although he said he never did anything criminal.

In the court filing, Fox claimed an informant whom he thought was just a right wing sympathizer encouraged him with marijuana and to "take another hit." :lmao:

Other defendants in the case say there were 12 FBI informants working on them a year ago; they've all asked for cell phone and data records as well.

Prosecutors have not yet replied to the filing that includes a volatile new allegation: that this was not just a plan to attack a single governor. Fox said FBI informant "Big Dan" pushed for a synchronized militia attack on "governors in multiple states... shooting rounds into the homes of their respective governors at the same time." Fox also claimed the suggested plot was to mail spent shell casings to each politician.

A second federal judge in Washington questioned whether the lead felony charge leveled by the government against Capitol riot defendants is unconstitutionally vague, as 18 Oath Keepers accused in a conspiracy case urged the court on Wednesday to toss out a count carrying one of the heaviest penalties against them.

U.S. District Judge Amit P. Mehta asked how federal prosecutors distinguish felony conduct qualifying as “obstructing an official proceeding” of Congress — punishable by up to 20 years in prison — from misdemeanor offenses the government has charged others with, such as shouting to interrupt a congressional hearing.

“Essentially, what you said is, ‘Trust us,’ ” Mehta said. “. . . And that is a real problem when it comes to criminal statutes, to suggest, ‘We know it when we see it, and we’ll pick and choose when it is an appropriate exercise of prosecutorial discretion.’ ”

Prosecutors have brought the obstruction charge in many of the most notorious cases, including against members of the Oath Keepers, Proud Boys and Three Percenters groups who allegedly conspired and prepared in advance for violence. The government has also leveled the charge against scores of individuals not accused of attacking police or destroying property but facing some of the most egregious allegations — such as occupying the Senate chamber, sitting in the vice president’s chair and targeting government officials.

Prosecutors have sought to distinguish such acts from protest-related civil disobedience that rarely results in prison time and more politically charged offenses such as sedition.

However, defendants in at least eight cases have moved to dismiss the count. They assert that the joint House and Senate session that met Jan. 6 does not qualify as an official proceeding of Congress; that the law is unconstitutionally vague on its face or as applied; or that it does not cover individuals’ alleged illegal actions, among other things.

The challenges rejoin a long-standing debate over what Congress meant when it overhauled an obstruction-of-justice statute in 2002, when as part of the ­Sarbanes-Oxley corporate responsibility act it broadly expanded a provision to cover “whoever corruptly . . . obstructs, in­fluences, or impedes any official proceeding.”

The Justice Department has argued that Congress intended a broad “catchall” provision for obstructive acts, passing Sarbanes-Oxley after a corporate fraud crisis wiped out hundreds of billions of dollars of shareholder value, including the early-2000s collapse of Enron Corp. and accounting giant Arthur Andersen.

Hundreds of people stormed the Capitol. Most won’t face hefty prison terms, legal experts say.

Congress’s whole point in enacting such general clauses is to cover “matters not specifically contemplated,” because lawmakers do “not know what inventive criminal minds” might come up with in the future, Assistant U.S. Attorney Jeffrey S. Nestler said in the hearing Wednesday.

But some legal scholars question whether the expansion applies only to financial fraud or to traditional ­obstruction-of-justice crimes such as destroying documents.

As U.S. District Judge Randolph D. Moss did last month, Mehta noted that the Supreme Court in 2015 rejected an ­expansive reading of a related law, tossing the conviction of a Florida fisherman who destroyed ­smaller-than-20-inch red grouper to impede U.S. wildlife inspectors. The court ruled that when Congress barred the destruction of any “tangible object,” it meant documentary evidence, not fish.

“It seems to me — and I say this after having thought about this a fair amount — this statute potentially suffers from the same problems,” Mehta said.

Mehta, who was appointed to the U.S. District Court for the District of Columbia in 2014, said he could easily follow the high court’s plurality opinion and toss out the charge. Like Moss, Mehta said the government must be able to put individuals clearly on notice how “corruptly” obstructing or influencing Congress differs from ordinary trespassing, parading or disorderly conduct in the Capitol — lesser charges that are punishable by no more than six months in prison.

 
What qualities a country as going off the deep end?
, Benjamin Franklin was asked what kind of government do we have? "A Republic," he replied, "if you can keep it." Today we remember those sad  tragic events that occurred 20 years ago. Our country became and was so united and worked together to best deal with those foreign terrorists attacks. IMO our Republic is more threatened by our division and by those who don’t recognize what a threat questioning our election results without evidence is as well the threat J6 was than it was on Sept 11, 2001.

While I agree with the statement, I would change "questioning" to "intentionally fomenting mistrust in the absence of any evidence".

Pretty sure anyone trying to take over the Capitol and stop Congress from doing it's job again is going to have a lot more to worry about than whether the cameras got their good side or the AI is able to make a match.

Yeah, I don’t think anything like J6 will happen, but it is nice to know exactly who supports the actions of those arrested.

There is not a bottomless pit of fringe extremists on the right side of the aisle. I suppose that would be a pleasant narrative for some of the radical woke lefties here, but it's just not true. Many of the fringe extremists were swept up in the Capitol Riots. The fringe extremists on the left side of the aisle however were simply bailed out or law enforcement/courts in Big Blue Cities were given orders to catch and release.

January 6th was a massive tragedy and an idiotic move by Trump and a few thousand fringe Republicans. It was used to smear 74 million Americans ( more to be honest as it was also a narrative to push more blame on poor rural Christian white Americans)  However Trump has been cast out of the daily media cycle and there was no real catch and release of Capitol Rioters.

You may be right.  It’s funny though.  The Democrats we’re doing to get massacred last time and the time before that too.  All I heard was about the “red tsunami” and then they lost the house.  Then the Senate, and then the POTUS.

Lying about elections and stuff. With any of the countries I listed, there shouldn't be much argument. Look them up individually on Wikipedia and you'll see how the right-leaning parties in each of those countries have trended toward becoming anti-democratic in recent years.

Top security officials to reinstall Capitol fence ahead of far-right rally

US Capitol Police are not expected to request National Guard for Trump Justice for J6 rally — but will reinstall security fence and authorize the use of deadly force to protect Congress.

With no President to grant them permission, and the clear message that if you storm the Capitol you might get shot, this will be a model for “peaceful protest.”

I would be shocked (and saddened) if there were any violence at this farcical rally.

The difference is that the President and his appointees aren't going to leave the Capitol defenseless, and aren't coordinating with the protesters and members of Congress to make sure they get into the building.  So that's plenty of distance.

Also the odds are a zillion to one that if they attempt to break into the capital building or beat up a police officer with a US flag that President Biden isn't going to say "we love you and understand but you've got to go home"
