I just had a trademark application rejected for the following:
Section 2(e)(1) Refusal – Merely Descriptive
It's a (4) STANDARD CHARACTER MARK application, and I'm going to appeal, because the examining attorney is assuming a word in our name is descriptive when at best it is suggestive.
I just spent the past few hours writing a draft for an appeal (more of a brain dump really), explaining why the word can at best be only suggestive of what we sell, but I know that lawyers prefer to talk with other lawyers. So I'm looking to hire a lawyer to advise me on my argument, write in in lawyer speak, and submit it.
