He was arrested after a "gaze" test, whatever that is. It was a DUI Driving Under the Influence, not DWI. No bloodwork, no breathalyzer. He said it was a sleeping pill, so a DUI may be correct, but to say he was drunk, no one knows except for him. A sleeping pill can really mess you up.

Even if you are under the influence of narcotics be it legal or illegal it's still DUI ( same thing as DWI btw). With that being said if he wasn't actually caught driving and took no breathalyzer or sobriety tests a good attorney will get it reduced to something like negligence. Either way very poor judgement on his part not to take a cab or get a ride home.
