Uh, isn't that the end of the trial? Admitting to being 1 of 3 at the scene of the murder makes the joint venture law kick in, right? Unless he immediately hightailed it to the police station to report the murder. Which he didn't.

 
Watched a bit of the coverage of this tonight. :lol: at the defense saying that video they have of him from the cameras in his house show him holding an iPhone instead of a gun.

Twenty years ago I watched the OJ trial intently and felt there was no way he good be found not guilty. So at this point, I can honestly say anything is pooooooooooooooossiiiiiiiiiiiiiiiiiiiiblllllllllllllllllllle (to quote Kevin Garnett).

I agree that the prosecutor seemed vague, and didn't provide many counter-arguments to specific evidence. It was more him asking the jury to keep an open mind, that the prosecution only told one side of the story, etc. He did try to poke a few holes in the defense's case by saying that renting cars was normal for Hernandez, and suggesting that the gun he was seen holding on video could have been a iPhone or remote control instead.
interesting tactic. Usually prosecutors want the jury to believe their version is the only logical explanation and the truth.


(Most states have a hearsay exception that would apply in this situation, but not Massachusetts.)

Argue how much weight to give the texts but dang they really should come in.

Was this before the judge reminded the jury of the joint venture law?

Fee certainly will earn his fee if he can swing an acquittal out of this.

That is what I don't get. I always thought being an accomplice is the same as pulling the trigger.
It is in Massachusetts if it can be shown that you conspired to commit murder. I am no lawyer, but from what I heard, to not be considered a co-conspirator, AH would have had to fully cooperated with the authorities and rated the other guys out to law enforcement. Essentially, he would have needed to say "I didn't do it" and hand over the guys that did. Specifically, you can't claim that 2 years later and not cooperate in the investigation. From the talking heads, it sounded like you have to declare your allegiance from the get go . . . either you are cooperating and distancing yourself from the others or you are lumped in with them.

This is wildly incorrect. I hate Ray Lewis as much as the next guy, but Hernandez makes him look like a choir boy. Lewis is just a scumbag who was hanging with some thugs that got into a fight and it got out of hand. He should've served time, his buddies should've been convicted of at least 2nd degree murder, but Hernandez... He orchestrated a murder, and probably committed two others, which we'll get to after this one. He also shot a friend in the face. He is a thug like the NFL has never seen.

Would be epic if we find out later there was a mistrial because it's discovered after the fact one of the jurors was holding in dynasty.

I'm not buying that Ray Lewis didn't stab anyone. Even if he didn't he helped cover up two murders. That's like saying Charles Manson is better than Hitler.

And they might have won two with him in the lineup given that Belichick had crafted the team around two TE sets, lining him up in the backfield, having him as a running back, etc.

I have seen countless murder convictions beaten by high priced lawyers who make prosecutors look like fools. They don't even have a murder weapon and the defense has already gotten key evidence ruled inadmissible.

I don't need to be an attorney to have a pretty good idea how the system works given the history of how many trials I have seen where the convicted was acquitted. I'm sure you had OJ and Casey Anthony pegged for the slammer too.

He won't skate. The gun charges are a lock. The current murder charge seems pretty darn solid, and there will be other murder charges to follow if he's not convicted on the current one.

 
People holding Hernandez were always incredibly stupid because the murder case didn't even matter, from a fantasy perspective. The gun charges were a home run from the beginning and enough to end him.

 
FWIW, I don't own him in any dynasty leagues so whether he skates or not means nothing to me. The gun charges will be a lot easier to prove than the murder charges. I agree even if he beats the first murder rap there may be two more waiting for him afterwards. A lot of people have beaten one murder rap, three will be tough.

I still think the Lloyd murder case is far from solid for the prosecution. The double homicide I have no idea as they haven't disclosed much about that. It won't matter much if he's convicted in the Lloyd case.

Either way the guy is a thug who should be put away forever but so was a certain Raven player/ESPN analyst who is very much free today so who knows? They are both on the same level IMO regardless of some defending Lewis for whatever reason. I have seen too many people walk in murder cases that looked like locks in the past to think he doesn't have a chance at beating it.

We had a guy who worked at our local landfill unload a 9 mil. into another fellow employee in broad daylight in front of witnesses.

A grand jury wouldn't even indict the guy, claimed he was being harassed by the other guy. Crazy stuff happens, I've seen it time and time again. Nothing surprises me any more.

Judge Garsh found “credible evidence” that the juror had “discussed evidence and formed an opinion about it.” Specifically, Judge Garsh found that the juror said that “in the absence of a weapon if would be hard to convict” Hernandez.

It means that the juror may have been a so-called “stealth juror,” who lied about her lack of opinions about the evidence in order to get onto the panel. As noted by the Courant, the defense previously expressed concern about “stealth jurors.” Ironically, this is one that could have delivered an acquittal, or at worst a hung jury.

The next question is whether there are other stealth jurors. Like the number of licks it takes to get to the Tootsie Roll center of a Tootsie Pop, the world may never find out.

I think even if Hernandez somehow beats these murder charges (slim chance, but just like this person getting on the trial - weird stuff happens in high profile cases), I don't see the NFL ever letting him play football again.

The woman also lied on her prospective juror questionnaire about the number of New England Patriots games she had attended.

I heard an interview with a legal-eagle covering the trial and he seems pretty convinced Hernandez will escape murder charges. He predicted that after all is said and done AH will get about a 30 year sentence and be eligible for parole after 15. That assumes he won't be convicted on the other murder charge.

 
This is the first of 2 murder raps he will have to beat. The other one supposedly is an even better case against him....i heard.

 
Maurile, am I off in thinking having the murder weapon probably doesn't really make much difference in a case like this?

depends how truthful she is. Is she goes up there and says I never took a box from the house, don't know what they're talking about and I love my man....it may complicate things.

If she's truthful, stick a fork in him because she likely disposed of the murder weapon.

How does the law work if they promise immunity? Can they revoke it if she lies on the stand?

Can you explain to us or link to us those legal analysts who thought Hernandez would be able to get around his DNA being on the scene and the requirement that anyone who is even an accessory to a murder is as guilty as the murderer if they don't come forward and cooperate immediately?

I live in New England, there has been a lot of speculation locally about how strong the case was by people who know a hell of a lot more about it than anyone in this forum including myself. The girlfriend testifying is new to everyone, she had been holding out but the prosecution must have broke her.

I'm sure all these know-it all's who knew nothing about the case going in and had him convicted said the same thing about OJ, Casey Anthony, Ray Lewis, Oscar Pistorius and Robert Blake too.
