I find this turn in events incredibly interesting. McPherson is going to need to call experts in his lawsuit claiming that he would have been the next coming of McNabb "but for" the injury and therefore lost a huge payday. The defense will likely claim that he was destined to never be more than a journeyman regardless of the injury.I wonder what Jim Haslett and Sean Payton would/will say when called to the stand as fact witnesses regarding McPhersons' pre-injury prospects?
"The December 15 complaint, a copy of which you can find below, notes that McPherson was listed on the Saints roster as a quarterback and "was going to play in other significant capacities for the Saints." However, "as a result of the wreck," McPherson was forced to miss the entire pre-season as well as the NFL season, since he was placed on the team's injured reserve list. McPherson contends that the Titans are culpable for damages since the club allowed "its mascot to operate motorized vehicles on the field while players are present." The lawsuit, which seeks $5 million in compensatory damages and $15 million in punitive damages, does not specify McPherson's injuries. According to his page on the Titans web site, T-Rac (who was named after Tennessee's official state wild animal) lists drag racing in his motorized chariot as one of his hobbies. And his favorite saying is listed as, "I didn't do it!""

well the guy sure had a ton of talent. He could probably pull off that he'd be an average player if allowed time to develop. 20 mil is relatively low for a career of an NFL star like McNabb or Peyton or Brady etc.If 20 mil=(career)Average NFL player makes this much in salary+bonuses, makes that much in apparel sales etc. I think he's got a decent case for a lawsuit. 20 Million is going to be a tough row to hoe. That said, he's likely going to win the case in some regard. Perhaps the settlement can be a roster spot backing up Vince once Collins is shown to pasture. They could do worse then having a similar style QB. I was the one advocating a late round pick of Reggie McNeal for that exact reason.
He actually only wants 5m in compensatory. The remaining 15 is in punitive damages. He is suing the Texans (for allowing the mascot to drive on the field recklessly), not the mascot.
I think the problem in the suit is since he is already back on the field competing for a starting level Arena job. His stab at most of the 5m will be proving that absent the injury he would have been an NFL mainstay, and now he is just an Arena League guy with the injury ...
Seems to me a hard case to make ... but I agree he will get some sort of settlement offer.
