Need Advice On Son's Virginia Traffic Citation (1 Viewer)

Son was involved in a fender bender but received a ticket with violation code 462-853 (reckless driving with notation of failure to maintain control).  Very minor accident, minimal damage.  He has a court date of June 26th, do we need to lawyer up for this?

His residence is in Maryland.

If it's Fairfax County, he's guilty.  They love them some money.

 
Plead not guilty. At the hearing you can go in and talk to the cop beforehand. They will drop it to something much lower and you pay a fine. Happens every day.

 
This is his first traffic violation but reading the internet Virginia seem pretty known for their ridiculous traffic laws.  It was a very minor fender bender but my son is worried about the max penalties ($2,500 fine/6 months jail, etc).  How realistically does he have to worry about that if he's polite and admits he made the mistake?  Son is 23 btw.

SHTICK: Tell him he'd better get used to pounding rocks and making license plates.

SERIOUS: They're not tossing him in the crossbar hotel for that. Fine/points are more the issue.

 
 I live in New Jersey, and got a reckless driving ticket on I-95 in Virginia for doing 81 in a 70. I looked into it and  reckless driving is a misdemeanor in Virginia.  I ended up hiring a lawyer for $250 and getting it knocked down to 79 in a 70, which is just a speeding ticket and had to pay an additional $250 fine. 

 
Call the DA and ask if they can change the ticket to a non-moving violation.  I've done it many times but never for an accident.  They get the $$ and your son doesn't get points. Also, you avoid having to hire a lawyer and go to court.

 
Looks like 46.2-853 is simply a failure to maintain control ticket. That's a pretty standard ticket for a crash, at least here in Ohio. Reckless seems like a strange wording to put on it, but who know.

Yep, rear-ended someone because he was likely being a jackass.  This is no way an attempt to exonerate my dumb son.  He will pay whatever needs to be paid, just trying to help him through the path of least pain since he will end up feeling a decent amount of pain through whatever fine he has to pay and insurance rate increase.

Haven't thought of this, I think I'll have the boy try it.

This is what I did for an 82 in a 70, which someone above mentioned is driving to endanger in VA. Was honest with the DA and explained I lived in MA. at the time and is there anything I can do to make it right without having to go to VA.

They had me write a letter to their office and reduced it to 79 and I just sent citation and Court fee to them by mail.

 
A friend of mine got a speeding ticket in VA (he lives in PA).   I think the fine was something like $200-$250.   However for some reason he had to appear in court.  He got a lawyer in VA to get out of the appearance.  I think the whole thing set him back $700-$800.  He says he thinks he was scammed by the lawyer and state of Virginia but he was happy he didn't have to go.

This was pretty much my experience that I posted above. Apparently, exceeding the speed limit by 10+ MPH over the posted speed limit is considered reckless driving in Virginia. I tried to haggle over the phone to get it reduced, but it wasn’t happening. It’s all a big money grab. Now I put the cruise control at 70 and cruise in the center lane through Virginia. Lesson learned. 

 
Surely I can't be the only one that ended up in here because on the home page it cuts off the most recent thread as "Need Advice on Son's Virgin..."

 
Lawyer up and plea.  Son may not even have to go to the hearing, lawyer can on his behalf.
