With Henry's future stuck in an unusual legal entanglement, it is not known how long the troubled star running back will play for the Broncos. It will probably be weeks before his fight against the NFL over his urine samples is settled. But for now, all that is clear is that Henry will be available to play today for the 2-2 Broncos against the San Diego Chargers at Invesco Field at Mile High.

Henry - who practiced Friday for the first time last week because of knee and ankle injuries - proclaimed that he will play today. Coach Mike Shanahan said if Henry doesn't have an injury setback, the NFL's leading rusher will be in the starting backfield.

His time could be running out. It appears the legal skirmish between Henry and the league will take several weeks, but probably less than a month. If Henry is suspended for at least one year, he can appeal that decision, and play through that process, which usually takes a couple of weeks.

The dispute is over Henry's samples, which were positive for marijuana. Because he is in stage two of the league's substance abuse policy - he has already served a four-game suspension for marijuana use - another failed test would result in a year's suspension.

When the NFL suspends players for a year, it makes it an indefinite suspension, with the player having the opportunity to apply for reinstatement after a year. The player must go to counseling and is tested regularly while on suspension. If a player tests positive a fourth time, he receives a lifetime ban from the NFL.

Each specimen is broken into two samples, an "A" and a "B" sample. Henry's lawsuit is based on the NFL not allowing one of his experts to test the "B" sample. However, there were indications Friday that the first sample might be reviewed as well.

In his complaint, Henry was adamant his sample was not positive.

While Henry's case may be a longshot, there might be some viable arguments that could be made by his attorneys to get the test reversed, some close to the situation believe. The case is in Brooklyn federal court and there is expected to be a hearing on the matter this week.

Neither Henry nor Shanahan would discuss the legal matter. Shanahan said he was "disappointed" with the situation but couldn't discuss it at length because "it's touchy."

Shanahan did say he is well-versed in the situation and would talk at length about the matter once it is settled. He said he spoke with Henry for almost an hour Thursday night. Shanahan said neither he nor anyone in the organization knew about the case until Thursday.

NFL spokesman Greg Aiello said the league will not have any comment on Henry until a decision has been made, but Aiello did say he did not expect an announcement before the game against the Chargers. NFL attorney Sean O'Donnell declined to discuss the case.

Steve Zissou, one of Henry's lawyers, said he couldn't provide a copy of Henry's court filing in the state court system in New York. Henry's other lawyers didn't return calls.

Dave Smith, an attorney at Denver's Mountain States Employers Council Inc., a management advocacy group that helps companies in contract negotiations, said the resolution of the Henry matter depends on the terms of the contract between the NFL and its players union.

"It really deals more with the collective bargaining process," he said. "It depends upon the parties involved and the issues."

In Colorado, private employers can terminate workers for illegal activity even if it doesn't occur during work time. For example, if an employee breaks laws regarding drug possession or drunk driving, the employer can fire them. And private employers have the right to conduct random drug checks, even if such a policy isn't written down in advance of the worker's hiring.

The Broncos gave Henry a five-year deal with $12 million in guarantees. The Broncos may attempt to retrieve most of that $12 million but, according to the league's collective bargaining agreement, all signing bonus and option bonus money that can be retrieved is a prorated portion. Because the $12 million is split equally between the signing bonus and future option bonus money, the $6 million owed in signing bonus is where the proration could come from. The option money likely would not be paid.

Shanahan said Henry was dealing with the situation "like a man." Some teammates said they are behind Henry.

"We don't know the full extent of the story," wide receiver Javon Walker said. "We support him. He's our teammate."

The ESPN Fantasy show just said they will have "big news" on Henry after the commercial break...

My guess is that its nothing new. I'll post what they report ASAP

I agree...i have read NOTHING that says he is ''Starting'' today , only that he is playing or in the line up :unsure:

So, I did read a rumor on thesouthstands.com (Denver Bronco fans website)Apparently a Denver radio station is reporting that Shanahan intends to bench an unnamed Bronco for today's game.

I agree...i have read NOTHING that says he is ''Starting'' today , only that he is playing or in the line up :confused:
I haven't read anything saying that Cutler is going to play......should I worry?Come to think of it...I haven't seen where ANY player is "confirmed to play" today!!!What do I do now?? :unsure:It's pretty simple....IF a player is "available to play".......and that player isn't listed as "not playing today"...or "will be used only in a pinch"......I'll go out on a limb and guess that he IS playing today...Let's all watch together and see if my theory pans out! :shrug:

Well now...THAT's as clear as mud!"the NFL's leading rusher" of WHICH year?

"Stating in the backfield"? WHO'S backfield? Will he take the snaps? The DEFENSE has a "backfield" too, ya know!

"Starting" ..but will he be "PLAYING" more than the starting play??

Realistically, if you're Shanny and the Denver organization, don't you run him (Henry) into the ground as long as you can knowing there's a good chance he'll be suspended in the near future? It's like a rental car at this point so who cares if you run the crap out of it. That being said, he's only found the endzone once this year for those of us in TD heavy leagues.

As long as you purchase the 9 dollar insurance, you can run it into the ground. Do the Broncos have insurance? I guess if they are confident in Young and Bell and Co. they are. I'd run his ### into the ground to win this game, but thats just me.

Mort just confirmed that not only is Henry going to play, but he's made it known he's willing to submit a hair sample and participate in a lie detector test to prove his innocence. ;)

 
THat the same Mort that said Eli was out 4 weeks...or same ESPN that said Maroney would play last week? But I do trust him, so whatever.

I hate to try and read anything into this but that's a rather curious choice of words. Suit up and play. Why not just say "Henry will start." I'm probably reading too much into it but I find that an odd choice of words.

What would the hair sample prove?That its not his urine?So he cheated to beat the test and it didn't work?

This was my thought too. This is a big divisional game for Denver. If you only have the leading rusher in the NFL for another week or so, why wouldn't you get the most out of him as possible for the time you have him? On the same token, if you are Travis Henry, wouldn't this give you extra incentive to have a great game? If I know I'm going out I'd rather leave it all on the field to show everyone i'm the leading rusher. My guess is that Henry plays with an extra chip on his shoulder and has a great game.

This suggests to me that he may not have failed the test outright, but that they think the urine is not his, ala the Whizzinator. Hair follicles could be used to check his DNA against the DNA of the sample. Just a guess, but I don't see why else hair would have any relevence.

Wow, seriously, this is big news. I believe a hair sample is a indicator of what at least a year. Question is will his experts be there. :excited:

It is my understanding as one who is by no means a part of the medical profession, but rather one who has experimented with some of God and man's finer creations that evidence of drug use remains in your hair for substantially longer than it stays in your urine or blood. I believe a hair sample is also a more conclusive way to test for the presence of drugs.

You might want to brush up on hair folicles and their relation to drug detection in the system before spouting off about it.

Nothing's obvious when it comes to Shanahan. :thumbup: I agree that Henry is 99.9% certain to start. I've been posting that for the past two days. I still find the choice of words to be rather odd, though. But that's me. :popcorn:

Hair test is infinitely more accurate than a urine test - and, if you pay enough for it, can pinpoint WHEN was the last time that substance was in the body.

I was wondering if it is in there longer. Regardless, it's just another move to delay his execution from the NFL. It buys him more time if he can get this lame test done. He's guilty. This is all lawyer moves to kepp him on the payroll as long as possible.As you can see:Fox Sports' John Czarnecki reports Denver Broncos RB Travis Henry, who has filed suit in federal court questioning a positive marijuana test, could be facing a year's suspension. He filed suit in order to delay the league's actions because he has received only $1 million of his $6 million signing bonus. The next payment of $1 million is due on Oct. 15. Henry wants to be on the roster in order to collect.Delaying as long as possible to collect as much as possible.
