"no, I didn't destroy it but the store did under my request so private information is not exposed"

When he went and got a new phone, he asked specifically for the retailer to get rid of it.

Just a minute. So, it wasn't a personal assistant that destroyed the phone?
I may have missed something--why does that matter?
So instead of turning it over, and worrying that info may be released, he gives it to some schlep at the Verizon kiosk?

No danger there of that guy selling the info right? :wall:

Here's a good one...

Mike Kensil - NFL VP of Game Operations

Kensil, a huge figure in this scandal, was the VP of Football Operations for the Jets from 1977 to 2006. He was there when Bill Belichick re-signed as Hc of the NYJ. His father, Jim Kensil was the President and CEO of the Jets from 1977 to 1988.
Why hasn't anyone brought this up before?

Yeah you wouldn't think a celebrity of his status would just turn it over to the guy at the phone store and not be worrying about personal info being leaked.

Lol that people first questioned Brady for "destroying" his phone and are now questioning him for not destroying it.
I'm not sure why people are making a big deal out of this; it seems like people are trying to suggest that NFL made up the fact that Brady had his phone destroyed. They did not. Brady's own testimony isn't 100% clear about who he directs to destroy the phone, but he is very clear that he gives the order to have his old phones destroyed.

He says in his appeal testimony that he had his phone destroyed. At one point he refers to the person he directs to destroy the phone as "the guy who swaps them out for me," then later he specifically says yes when asked if he provided it to his assistant with the directions to destroy the phone.

Brady says this has been his policy ever since he's been in the NFL (actually as long as he's had a cell phone). Yet he can not give a credible answer about why he has his previous phone.

So he wants people to believe that he didn't just conveniently destroy this phone the NFL wanted info off of, but that he always has destroyed them, but he can't explain why his previous phone was destroyed. That is another hole in his story that forces you to doubt whether he is being totally honest.

He does explain the timing of getting a new phone, the new iphone had just come out. Whether you believe him, or just think it a coincidence, its his version of the events.

Just came out? It came out six months before he got it...it came out before he got his previous phone even

But the new iPhone hadn't just come out. In fact, it came out right before he had gotten the phone he destroyed. So, that explanation is another hole in his story, further straining his believability.

Besides, that still doesn't explain why his cell phone policy (which he claims he's had ever since he's been in the NFL & not just a result of the NFL requesting info off of that phone) is to destroy his phone when he gets a new one, but he just happens to have the previous phone, intact and not destroyed.

Both sides have glaring huge holes in their stories. I don't believe for a second either side is being entirely genuine in anything they are saying. At this point, both sides would be wise to settle this thing and get this out of the news sooner rather than later. The longer this goes, the worse they all look. Brady should take a one game suspension and let the NFL "burn" the evidence like they did the last time NE decided to screw the pooch.

The relativity of what he meant is debatable but likely a waste of time. Also, I haven't read anywhere that its his policy to get rid of his phones regularly, I assumed as much when the league leaked that he had destroyed his phone as it made sense. But to my recollection, Brady was very vague about it, saying that at any time he has a number of phones. In fact, in his testimony he made it clear that he doesn't routinely get rid of phones.

Again, a lot of people aren't going to just buy that it was a coincidence, I don't think it was either. But I don't think it was nefarious, he said he wanted to get a new model, so he did - hes Tom ####### Edward Patrick Brady Jr. and he do what he want to.

He provided all the information from other phones of his, it was that one specific phone. On top of that and to the contrary of what Well's reiterates whenever free to do so, the Brady camp did try to give Wells information from his phone, and you will remember how little detail Wells cared about, that he just wanted something. Well when the Brady camp got a compiled list of all numbers the phone he got rid of had ever come in contact with and the names that belonged to those numbers, from his service provider - they refused to accept it.

Despite having literally all of the communications from everyone else involved with the investigation, and as lax the request from Wells, they didn't want it. Because by then, they knew they had nothing and the objective changed to discrediting Brady.

This (the bolded) is completely false, unless he contradicted himself during his testimony, and I missed it.

Appeals transcript (might be the link you gave me)

http://www.scribd.com/doc/273547523/Tom-Brady-Appeal-Hearing#page=20

Page 87 of the transcript, page 26 from that link:

His lawyers asks him:

Q. Okay. Now, have you had a practice, and tell me when it began, how long ago, of destroying or, I guess, asking somebody to destroy or get rid of your cell phones periodically?

A. I think for as long as I have had a cell phone.
He goes on later to explain, after saying he has contacts, pics, and other info he wouldn't want anyone else to get, specifically saying that he has the phones destroyed (page 91 from the appeals transcript, page 27 from the link provided) :

A. So I have always told the the guy who swaps them out for me, make sure you get rid of the phone. And what I mean is destroy the phone so that no one can ever, you know, reset it or do something where I feel the information is available to anybody.
He very specifically says, then emphasizes, that he has his phones destroyed. Do you know where you saw him say otherwise? I'd like to see it.

With regards to Brady saying he has multiple phones, that's false as well. He is asked specifically by Goodell if he has multiple phones and he says no.

(page 89 of the appeal, page 26 from that link)

COMMISSIONER GOODELL: Do you have multiple phones?

THE WITNESS: No.
Again, if you have a link to Brady contradicting himself, I'd love to see it. But he's pretty clear here: he has always destroyed his phone when he's done with it, and he does not have multiple phones.

It's important for him to have everyone believe that, because that makes his story about destroying the phone a coincidence, a not a plot to destroy evidence the NFL wanted. But he has no credible explanation for why he destroyed his phone on that particular date (since his story about the new iPhone just coming out is false) or why he still has his previous phone which should have been destroyed months earlier, per his "long-standing" cell phone policy.

When you get right down to it, I don't know who is responsible for Tom Brady's texts being released to the media, but that invasion of privacy of someone I am not even a fan of has me close to saying "suck it" to the NFL, and walking away from it as a fan for good.
I've been getting more and more disgusted with the NFL every year. Every year its something else. For years it was just getting too expensive. Ok, not a big deal because I can watch at home. Then the league started injecting politics into things. There is really no reason for the NFL league to be wearing pink to promote breast cancer awareness. Colon or testicular would be much more appropriate for a league of male athletes. Still not too big of a deal overall. Donating to charity is good, I'd just prefer the NFL not sensationalize it as much with all the pink gear.

Then last year it got totally out of control. Having to watch the 'stop the violence against women' commercials on EVERY break was too much. At this point we are all being lectured by the league about something that 99% of fans have no involvement in. It's the NFL's problem that a few of it's employees are stupid and violent. It's not ME. If you want to make a statement, fire the employees. Don't get into my face about it as if I'm battering my wife. The NFL had several major scandals around this, and throwing it out to the fans as if they are the problem was insulting.

Now this. Another scandal. The NFL executives bungled this thing from day one, leaked lies to cover their own asses, and threw their Brady under the bus. Totally sick of the NFL executives at this point and tired of the way they are handling all these scandals. They couldn't mess things up any more if they tried.

And yet it remains a gold mine. The game is great. I'm riveted to see if Chip Kelly falls on his butt or will change the league. It's like the league and the game are different things. Five games in Mexico? Blow up the magnificent symmetry of the season? Expand and destroy the perfect playoff structure?

So true.

If it weren't for my enjoyment of Fantasy Football, I would have walked away a couple of years ago.

The League and their double standards on so many levels is an embarrassment.

Guys,

Let's not get bogged down with the NFL's shenanigans. We're busy internetting the facts of the precise timing and manner of Brady's phone's demise. Stay on topic please.

Peace,

Add me to the list of people that believe the Patriots push every edge possible.

Read the Spygate book. It's numbing. Had that been investigated and vetted properly, the integrity of the games played was going to be front and center. Longstanding filming, signal stealing, etc. Let's not forget the league office destroyed all of this evidence on site in New England. Why do that unless you are afraid these could get leaked if they were transported to the NFL offices in New York?

The owners initially wanted the Patriots to be burned at the stake, but eventually backed down as they realized that they would likely be destroying the cash cow that is the NFL at the same time. They stepped aside for the good of the game, but many were pissed to do that.

Goodell warned New England at this time that they need to get their house in order.

DeflateGate and the Patriots using the TE eligible rule not as intended just raised the fervor of every other owner. The Colts ratted out the Patriots before the game was even played. Take that in for a second. Of all the things they could possibly tell the officials to look at, they said to watch the balls - They will be under-inflated.

Then the balls come under-inflated. No matter if any of this sticks or not. The NFL teams (through Goodell) have said enough is enough. Players not on the Pats roster aren't coming to Brady's defense. It will be interesting to see how this plays going forward. I think the other owners expected Kraft and their star player to just accept the punishment (much like they all had to do with Spygate). Kraft did his part initially, but Tom has thrown a big wrench into this going away quietly.

and when things like this don't go away quietly, said organization is causing detriment to the league. Even if Tom wins against the NFL, the other owners are likely pissed. Kraft might have been a big deal before this fiasco among the owners, but I hardly doubt that is the case now.
are you referencing Brian O'Leary's book? The guy who self-published the book and who has no contacts within the NFL?

"If it doesn't fit you must acquit."

That's pretty much where we are with Pats fans at this point -- hanging onto every possible legalistic technicality and ignoring the obvious, common-sense evidence that shows Brady and the ball boys did exactly what they're accused of.

Which, since it's not a court of law, is what Goodell is basing his punishment on. Whatever the NFL might say for PR purposes.

Read the Spygate book. It's numbing. Had that been investigated and vetted properly, the integrity of the games played was going to be front and center. Longstanding filming, signal stealing, etc. Umm, Dave, stealing signals was and is LEGAL, it is\was common practice, while filming was not as common its not as if other teams never did it. You understand it was done in plain site and easily mitigated by even the most rudimentary counter measures.

Let's not forget the league office destroyed all of this evidence on site in New England.

Honest to god, what do u think was on the tapes Dave, babies being sacrificed? Seriously tell us, I would love just one conspiracy theorist to tell us what is it on the tapes that would have been so earth shattering? I think I have asked u before and didn't hear back so I don't expect you will come back and elaborate on what you imply\allege; instead you will leave it to imagination and innuendo which is a good move since smears are much harder to fight when you do it that way.

Why do that unless you are afraid these could get leaked if they were transported to the NFL offices in New York? I agree the tapes shouldn't have been destroyed there and then, but I don't agree with your ipso facto logic. So you believe that because the league didn't want tapes of Jets coaches picking their noses leaked to the press then that proves these tapes contained earth shattering evidence of the most reprehensible behavior? Again I ask you, what do u think was likely on the tapes? How about worse case scenario of what do you think might have been on the tapes?

The owners initially wanted the Patriots to be burned at the stake, but eventually backed down as they realized that they would likely be destroying the cash cow that is the NFL at the same time. They stepped aside for the good of the game, but many were pissed to do that. Haha, yeah that is one theory, another is it was much ado about nothing....

Goodell warned New England at this time that they need to get their house in order.

DeflateGate and the Patriots using the TE eligible rule not as intended just raised the fervor of every other owner. Haha, using the TE as not intended, IE you mean creatively coming up with a legal formation their opponents weren't prepared for; those bastards.

The Colts ratted out the Patriots before the game was even played. Take that in for a second. Of all the things they could possibly tell the officials to look at, they said to watch the balls - They will be under-inflated. Then the balls come under-inflated. Are you talking about the Patriots balls or the Colts balls? You do know both teams balls were under-inflated, even with the rat colts setting up the sting and likely making sure their balls were on the high end, their balls were still under-inflated as well. Take that in for a second indeed.....

No seriously, just stop for a second, put the pitchfork down and think about it............

No matter if any of this sticks or not. The NFL teams (through Goodell) have said enough is enough. Players not on the Pats roster aren't coming to Brady's defense. Oy,,, like fish in a barrel: http://espn.go.com/nfl/story/_/id/13388599/tom-brady-new-england-patiots-being-unfairly-punished-antonio-cromartie-new-york-jets-says

It will be interesting to see how this plays going forward. I think the other owners expected Kraft and their star player to just accept the punishment (much like they all had to do with Spygate). Kraft did his part initially, but Tom has thrown a big wrench into this going away quietly. Yeah, gee, he doesn't want to plead guilty to something he didn't do; imagine that. I will agree with you that brady should just go along as soon as you provide some (ANY!) evidence you think u have that Brady knew or directed balls to be deflated post inspection. It will be a long wait since there is ZERO evidence. I have as much evidence that you are a space alien as you do that Brady knew or directed anyone to deflate the balls post inspection.

and when things like this don't go away quietly, said organization is causing detriment to the league. Even if Tom wins against the NFL, the other owners are likely pissed. Kraft might have been a big deal before this fiasco among the owners, but I hardly doubt that is the case now. You know the whole thing could have gone away quietly Dave, the other nfl owners for the most part never ever wanted this to happen. However, former jets employees working in the nfl office (kensil. gardi) who sadly are as biased as many on this board spread lies and leaked false information to espn. Once the 11 of 12 balls were under 2 PSI lie was out there and not immediately correct by the nfl league office it was over and there was no possibility of this going away quietly, but it is laughable to blame NE for this when it was the butthurt ravens\colts, kensil, gardi, espn all conspiring to make sure it didn't go away quietly.

NE is the team everyone loves to hate and I'm fine with that, it's what happens when you are such a dominant team for 15 years and play in 9 out of the last 14 AFCCCs.

Think about that for a moment ;)

What spygate book are you talking about?

That's pretty much where we are with Pats fans at this point -- hanging onto every possible legalistic technicality and ignoring the obvious, common-sense evidence that shows Brady and the ball boys did exactly what they're accused of.

Which, since it's not a court of law, is what Goodell is basing his punishment on. Whatever the NFL might say for PR purposes.
Yeah, but the NFL has also done a poor job of handling this. They deserve some criticism for the early leaks, for mischaracterizing what Brady said about his conversations with Jastremski, and stuff like that.

None of that makes Brady any less guilty of course, but Goodell is going to look like an idiot if his bungling of the case ends up getting his suspension vacated.

Guys,

Let's not get bogged down with the NFL's shenanigans. We're busy internetting the facts of the precise timing and manner of Brady's phone's demise. Stay on topic please.

Peace,
Waiting for the new thread of 1,000+ posts opining on Brady's (or...ah...G's) pool cover choice.

Yeah we wouldn't want that little thing called evidence to get in the way,

What little fact Dave spoke of I addressed, but most of what he wrote is just unsupported innuendo and rumor which I challenged him to support; thanks for playing though.

The funny part is you are railing against conspiracy theorists in the first part...and end with a conspiracy theory of your own.
Haha, nice try I guess, but what Grigson, Gardi, the NFL league Office (likely Kensil & or others) and ESPN did, and didn't do is verifiable fact not theory. What little fact Dave spoke of I addressed, but most of what he wrote is just unsupported innuendo and rumor which I challenged him to support; thanks for playing though.
But the conspiracy part is why they did it (you have the facts on that by chance? Link?), not what they did. So I guess I now challenge you to support your innuendo and rumor or just admit :potkettle:
Um, no, conspired doesn't mean why

Tiki Barber thinks Goodell should lose his job. I agree and think it's possible. We'll have to wait and see how it plays out first before knowing the likelihood of this .

Tiki Barber was not in studio earlier this week, but now that he’s back, he needed to get some things off his chest about Roger Goodell.

According to Yahoo! Sports columnist Dan Wetzel – and others – Goodell manipulated Tom Brady’s DeflateGate testimony to paint a picture more favorable to punishing the NFL’s Golden Boy, a prospect that has left the NFL on shaky ground and Goodell’s credibility, or what remained of it, in shambles.

Barber unloaded on Goodell on Friday.

“Forget what he’s been punishing,” Barber said on CBS Sports Radio. “This has nothing to do with Tom Brady. It does, but it doesn’t. I want to put that aside for a second because whether you think he’s guilty (or not), it almost doesn’t matter. What happened in this case was Roger Goodell hired Ted Wells to do a report. Now we subsequently found out that NFL lawyers were working with Ted Wells to compile this report, even though it was supposed to be independent. . . . When Ray Rice had this altercation with his girlfriend in the elevator, the story then was that Roger Goodell was saying ‘I didn’t ever see the video. I had no idea that this actually happened.’ Now, Because of what just came out with this Tom Brady thing and DeflateGate, it now (makes me) question whether Roger Goodell was lying to save his ### then, too.

“And so, for a long time, I wanted to be behind Roger Goodell,” Barber continued. “I wanted to say, ‘I understand this is a no-win situation and you’re not used to handling these things.’ But I feel like he’s lying and compromising himself. And I wonder if this is worth his job. He has probably compromised his job. You can’t go lie and undermine a player and an owner and then think the other owners won’t say ‘Hey dude, we can’t trust you anymore. You got to be gone.’”

As Brandon Tierney pointed out, the NFL did not handle DeflateGate with an innocent-until-proven guilty mindset. Instead, it was almost as though the NFL decided from the start that Brady was guilty and then sought to manipulate and tweak information just to prove its position – which is the complete opposite of what this country was founded on.

“There is a rule of law,” Barber said. “That’s why we live here. The rule of law matters. Process mattes – and you can’t just change the process and think nobody’s going to find out. It’s almost like he’s got a dictatorship going on. What I say is rule, and I’m going to make it up as I go along and you cannot protest – and if you do protest, it’s going to be harder on you. That’s what this feels like and it’s not okay with me. I know some people will sit back and say, ‘Yeah, but it’s a private enterprise, they make billions of dollars, they can do whatever they want.’ Tom Brady has rights. The Patriots have rights. And you can’t just stomp on them because you have an agenda you may not be telling anybody about. . . . Roger Goodell is not explaining himself. He’s either being incompetent or he’s being specifically and maliciously evasive – and it’s just not okay. I used to have trust in what he was doing. I don’t anymore, especially since this transcript came out and it reads like someone who just doesn’t care. It’s my way or no way.”

Tierney asked Barber if he thought Goodell should lose his job.

“Yes,” Barber said. “All this stuff is coming out now – it looks ugly for Roger Goodell. I don’t trust him as the commissioner of the National Football League anymore. So to answer your question, yeah, I’d fire him.”

If Mortensen wasnt such a hack he'd disclose the source that lied to him (cough, Kensil). If your source lies to you to manipulate you, you burn them. Of course that only applies if you care about your reputation for integrity.

No disagreement here.

If OJ's Patriots fans were making that argument it'd be a good one.

Personally I think Goodell decided to railroad a guilty party. Nobody covered themselves in glory here.

Not that I care, just bugging Icon.

And by the definition there has to be coordination to have a conspiracy. Since appearance doesn't cut it for Brady (you know, the part you keep asking for actual proof, not circumstantial), I am sure you have a link to prove your allegations.

Memos filed. Significant piece of new information in the NFL's memo:

Finally, the NFLPAs argument that Brady lacked notice that he could be disciplined for being generally aware of others misconduct is a straw man. The Commissioner did not discipline Brady for merely being generally aware of a violation of the playing rules. Rather, as the Award makes clear, the Commissioner suspended Brady (1) for having approved of, consented to, and provided inducements in support of a scheme to tamper with the game balls after they had been approved by the game officials for use in the AFC Championship Game and (2) for having willfully obstructed the subsequent investigation. Award at 13, 17-18.
Brady wasn't just "generally aware". Roger found him to be an active participant. No wonder Brady didn't settle.

Summary of Brady's memo:

1) Disregards the notice requirement under the law of the shop:

1a) No notice that he could be punished more than a fine for equipment tampering

1b) Was punished under the Competitive Integrity Policy, but had no notice of it as a basis for punishment

1c) No notice of "generally aware" disciplinary standard

1d) No notice that punishment could be imposed for failure to turn over a personal communication device

2) Punishment violates CBA's fairness standard -- this is basically the science argument and the ideal gas law argument

3) Deprivation of fundamental fairness, because (a) commissioner refused to consider the argument that Vincent was improperly delegated to, (b) NFL had access to files, but Brady did not, © Brady denied right to examine co-investigator Pash.

4) Goodell was an evidently partial arbitrator

Summary of NFL memo:

1) League disciplined under the conduct detrimental policy, and had the authority to sit under the CBA, and employed the collectively bargained procedures

2) Decisions about law of the shop are legal questions left to the discretion of the arbitrator and cannot be second guessed by courts

3) Arbitrator gets wide latitude in construing notice under the CBA, and Commish rejected notice arguments based on among other things Brady's credibility

4) Brady was not disciplined under "generally aware" standard, the commissioner went beyond wells and found Brady actively participated in deflation

5) Prior precedents are not applicable -- this violation was a deliberate attempt to subvert game officials' authority on game day with respect to equipment, and also involves withholding and destruction of evidence

6) The fairness arguments are foreclosed by the CBA or are quibbles not striking to fundamental fairness

7) Roger was very fair, and in any event, the NFLPA agreed to let him sit in the CBA so cannot now complain about it

And he's got this to say: Was Tom Brady Ambushed?

That's pretty much where we are with Pats fans at this point -- hanging onto every possible legalistic technicality and ignoring the obvious, common-sense evidence that shows Brady and the ball boys did exactly what they're accused of.

Which, since it's not a court of law, is what Goodell is basing his punishment on. Whatever the NFL might say for PR purposes.

Ivan as previously documented you don't have any evidence that brady is guilty of anything. I can't stop you from repeating your "wishful thinking" opinion ad nauseam (your a Bills fan, who can blame u), but I can keep pointing out the fact that you don't have any "real" evidence" Brady is guilty of anything other than not turning over a personal cell phone (for damn good reason) he wasn't in any way obligated to.
