Hardly seems necessary. All they have to do is trace the Richard in those pics back to Favre. I'm being serious. Nothing the NFL can really do to Favre that will cause him any grief or amount to anything. Now his wife is a different matter. She knows if those pics are him or not and I'm sure that's the only person he's worried about.
I think that this could be an "actionable" offense under Goodell's personal conduct policy. Per the story these two were not having an affair. Brett was pursuing her and in his efforts to do so sent her (an employee of the team at the time ) an unsolicited email photo of his "Johnson". Sean Salisbury got fired from ESPN for doing the same and this would certainly be a fireable offense at any public corporation. Again even though she didn't press charges, they were not a romantically involved couple.

This could easily be proven via electronic forensic evidence and voice forensics and a physical examMoreover, two additional team employees allege that they also received lewd text messages from Favre
#1, how could it be proven? #2, the investigation won't be completed while Farve is still playing..
