Any lawyers in the house?

Short story is father had home in his name alone and step-mother had legal documents changed well after he had Alzheimers. State laws of intestacy would have 1/2 of property to spouse and 1/2 to descendants as I understand the rules.

Does anybody win here? I imagine it comes down to proving his competency after the fact - and I'm sure the lawyers working with the evil step-mother had to have those bases covered?

Is there equity in the house? Did she refinance the mortgage? She sounds like the type that wouldn't have money to collect from even if you win?

 
Almost like mine but you actually may have some legal recourse. Dad buys house. Leaves it to his wife in will with his two kids and her one kid as beneficiaries when she dies. He died first, she changed will to leave everything to her kid.

I would not assume this. If his alzheimers was advanced, I doubt if he can legally consent to anything. You need to press the issue and you need a lawyer, assuming there is enough equity to worry about. Read up on the laws in your state too. Just because she might of had a lawyer involved, doesn't mean squat.

Same for my father. She also went to the bank claiming to be my aunt who had safety box rights to try to take the contents.

I think not. If you're talking about me you misunderstand. I assumed my dad would outlive her and leave everything to charity so it wasn't the money. I have enough of that to get by. It's the slap in the face from a dead woman who I thought I knew.

No joke... she didn't tell his children, cousins or even his brothers because she didn't want them at the funeral.

My mother got by on less than $9 per kid in weekly child support and rented a tenement. Everything I own I earned for myself. Father owned multiple properties including beach front and time share in the Caribbean. Over perfumed step-mom used to parade around in fur coats.

Greedy? No. Vengeful? I'll give you that.

I am not sure I would include a time share in the owning multiple properties category. More of a cash drain than anything

Fighting over an estate truly brings out the worst in people. I plan to die broke. Just toss my body in the woods and let me get eaten by wolves.
