The matter has become even more complicated since the Simons are also suing the other two boys Richard Esch, 17, and 16-year-old Jake Roberts, Cameron said.

This is a routine matter that would have been settled long ago, he said. But now, with her lawsuit, a relatively uncomplicated insurance process has become much more complicated this is just prolonging the familys pain.

Because of scheduling difficulties, a pre-trial proceeding is not expected until August.

A Facebook sight called Stand by Sharlene Simon states: It appears that the insurance adjusters are getting close to a settlement in the case. One of the chief stumbling blocks is the amount of long term care for the PTSD that Sharlene has incurred as a proximate result of the bicyclists negligence.

None of the allegations have been proven in court.

 
After reading through the thread, let's go ahead and just say that the insurance/legal system sucks, but it is what it is.

I grew up in Northern Ontario. Going 90km/hr in an 80km/hr zone is pretty standard practice. Normally if you keep it at or below 95, even if you go by a cop with the radar on, you've got nothing to worry about. Also, for the speed limit to be 80, we are talking about a highway. I did way dumber things than hop on my bike at 1:30am with my buddies and ride 3 wide on the highway and survived, but I can't see how the lady that hit them is at fault in any way here.

 
Is it the complete lack of facts as to how the accident happened that leads you to the conclusion that she is not at fault?

 
It's just my opinion. But on a dark highway with no lighting in the middle of the night, I can't say for sure that I would have seen them either.

I haven't read this in a while, but didn't she avoid all toxicology testing?
I think that was refuted back on page 1 or 2.

ETA I'm not saying I am on board with all the lawsuits, just that my opinion based on what I logically understand to have happened is that it was most likely just an accident.

Missed this thread completely the first time around. This was like reading the podcast Serial for a little while - except with a bunch of uninformed morons doing the reporting. I did enjoy the BB-Henry exchange in the middle. Good stuff.
