Since I subscribe to the Non Aggression Principle -- but am not a pacifist -- if I were convicted of murder, it could mean only one of two things:

1. I was framed and did not murder anyone

2. I killed in self-defense, but the cops and the prosecutors conspired to charge me with murder.

Therefore, I would not choose death. Instead I would fight for my eventual release. I might even Call Saul to represent me in the appeal.

If I'm innocent and there's any chance I can prove it, I choose death because there's a better chance I'll be able to get my conviction overturned and go free.

If I'm guilty, or if there's no chance I can prove my innocence, I guess I choose life in prison so I can write about my experience and turn it into, hopefully, a screenplay for a wacky sitcom.

You didn't ask whether we'd rather die. You asked whether we'd rather be sentenced to death. Totally different because being sentenced to death may give you the better chance of going free without dying.

Hard to say how many really would opt out. I'm guessing few. I'm out, I know that for sure. #### that ####. No way I am going to prison.

I'd bet that a poll of actual inmates would be the other way by a landslide simply because they are demented and think that they should not be in prison at all.
