Another tree thread but friendly..for now (1 Viewer)

So long story short.

A tree from my neighbors fell and busted up my fence and a part of my deck.  

Neighbor was really nice etc. We exchanged info both called insurance... anyway according to my insurance my insurance will cover it because it wasn't negligence etc...

My main question is this. There is another big tree that was next to this one that I want to cut down.   The branches reach into my yard so I know legally I could trim it but the trunk is in his.

It's like a 100ft tree.  Who should technically pay to have it cut down?

I don't mind splitting the cost but was wondering.

Eta: The tree is part of a wooded area on that back of the property

If you want it down and he doesn't care but gives his permission, you pay.  

If he also wants it down offer to split with him.  

Got a similar situation. Tree is behind my house, but leans toward the neighbors and is tall enough to take out 1/3 of his house if it fell that way.  It looks healthy so neither of us is itching to cut it down now, but he said if I ever get ready to do it he'd pay half.  I told him I didn't really want it down, but if he wants it down I wouldn't stand in his way.  But it's not worth whatever half the cost is to me to drop it, and he's not willing to pay the full amount himself, and so it stands.

I think your best bet is to initiate splitting the costs of getting that 2nd tree down. If he agrees good. If not, ball is in your court to pay the whole bill.

You sure the whole tree didn't blow over today with the wind in SJ/Philly area?

I would start hanging random heavy items on the side of the tree facing his house.  

Take up an "abstract art" hobby where you hang random pieces of iron and concrete from your tree.  Piece by piece over months/years.

It did blow over today because of the wind.

However, the tree looked completely healthy.

However after some investigating it looks like carpenter ants started to get to it. There was a small pocket of chewed wood.

These trees have been there from the beginning and are probably 100 ft tall. When I first moved in I considered cutting the one still standing down because the branches are over my yard. But didn't want to pay the money.  Yeah I know I could pay to trim but they are 60 ft in the air.

Anyway after today I'm concerned a little. If that one goes it will take out my house

 
My next door neighbor asked if he could trim back part of one of my trees that was overhanging his front yard. I said fine, since it wasn't much of the tree, and he was trimming his tree down pretty far anyway, and that was that. This was also before hurricane season last year, and trimmed trees mean less wood flying around if a hurricane does come stomping through.

 
I have a huge Green Ash in the front yard. We planted it when the house was built in 1999. Of course, with the Emerald Ash Borer, I have to have a tree care service come once every 2 years to drill it and put in some juice of some sort to keep the borers away. I love the shade it gives, but damn shoulda gone with a Maple.
