Bad Cop Shawn Glans: "You Wanna F***in Resist?" (1 Viewer)

The two guys were seen coming from a wooded area, wearing black hooded sweatshirts, and carrying a rifle.
I did not understand the article to say they were carrying a rifle. I understood it to say that there was a rifle lying in plain sight in the back seat of their locked vehicle. Perhaps I got that wrong.

No, I think you're right.
Here is what I read from one of the numerous accounts...

The video was captured by a young man who filmed his friend's encounter with Glans early Friday in Halfmoon. Glans confronted the pair after he said they walked out of nearby woods to their vehicle, which was in the parking lot of a business. Glans noticed a .22-caliber rifle on the back seat. The sergeant said they were wearing dark clothes and acting suspiciously, although they broke no laws.

Yes. None of those things change the Constitution or the cop's right to hit them.
I am not defending the d-bag's actions. I am merely providing the details as to why he wanted to search the guy's car.
I think we understand why he wanted to.

Yes. None of those things change the Constitution or the cop's right to hit them.

Right. That doesn't say they were carrying a rifle.
 
How does an officer that has already cost you a multi-million dollar settlement for crippling a guy with his car have a ####### job? Oh and why isn't his ### in jail really?

They had to pay out 6 million IIRC. Cop paid nothing and was never punished as far as I can tell.

 
Now if the police ever wanted to earn the respect of the community they would come down hard on these guys. Except they always get a slap on the wrist and move on.

I have some sympathy for the Cop. I will not condom him. It cannot be easy going through life with the name Glans. Imagine the ribbing this guy took.

it was pretty brutal watching that video. The guy tells the cop to go ahead and get a search warrant and the cop slaps him upside the head and takes the keys from him to search the car? Not good.

 
Well, presuming the cop wrote a report on the matter, and did not include him slapping the kid for refusing consent the cop will be sustained on the following, presuming his Department uses more or less the Model Directives:

Untruthfulness - In most Department's this is a firing violation. Prosecutors have a Brady obligation to turn over to Defense counsel instances of untruthfulness. That makes the Officer impeachable in every single thing he does. Without his integrity his observations are not testimonial evidence, they are ####.

Use of Excessive Force - Absent major injuries this tends to not be a firing offense the first time, or two, but eventually it is. This holds the Department open to civil suit, and with more and more Cities and Departments being self insured this is bad. Also, with the publicity of this any suspect who is charged with resisting arrest can be expected to claim he knew the Officers propensity and had a right to flee, or to struggle to get away from this brutal and unstable man. I know Defense Counsel who will subpoena the wife to ask whether he has again been unstable prior to any arrest he made of my client. Now the Court will not let that in, but the act of subpoenaing his wife is likely to unhinge the guy, making him an apparently needlessly hostile witness.

Constitutional violation - He is demonstrating a fundamental misunderstanding of search and seizure law. This alone would get many Cops three days off without pay and temporary removal from all secondary employment until such time as the Officer has successfully completed some remedial training under the guidance of a Field Training Officer, generally around 30 days.

Holding the Department in disrepute - A catchall.

I do know that most people do not like the hand behind the head move. They tell me that is too much glans for them.

He has rights just like ever other criminal.
It's my understanding he was never charged despite the facts being pretty clear,

In the smartphone era, how do policemen not have this internalized? Are their methods just a holdover from the '90s, and not enough policemen are hip to the risks these days they take when performing illegal searches?

I was surprised Glans was not aware he was being recorded. Only saw stills, but it looked like the buddy doing the filiming was pretty close.

Second police agency suspends officer accused of abuse

The Saratoga County sheriff's officer who was suspended without pay on Friday for allegedly slapping and cursing a man while on duty has been suspended from a second job in light of the incident.

Sheriff's Sgt. Shawn Glans has worked part-time for South Glens Falls Police Department for at least 12 years.

South Glens Falls Police Chief Kevin Judd said Monday that Glans has been suspended by his agency pending the outcome of the Sheriff's Office investigation.

Glans worked 78 hours over the past 12 weeks, Judd said.

Meanwhile, the Saratoga County Sheriff's Office and Saratoga County District Attorney's Office will hold a press conference Monday afternoon to release more information on the investigation of allegations Glans roughed up a young man.

The press conference is scheduled at 2 p.m. at the district attorney's office in Ballston Spa. Here is the article about the incident on which if focuses.

Police are expected to announce whether the young man who was confronted by Glans plans to file a complaint against the officer.

Glans is accused of slapping the young man, Colin Fitch, in the head as he tried to convince him to open a parked car where police had spotted a rifle.

The encounter happened early Friday morning behind the Wal-Mart store in Halfmoon.

A video recorded by a man who was with Fitch was posted on the Internet hours later, leading to the suspension of Glans.

Cops are union members too.

 
Yea he was arrested and charged with "official misconduct and harassment" according to the Times Union. I live about 10 mins south of there so I'm hearing about it constantly.

I could understand a cop getting upset and snapping if they worked in a high crime, stress filled area, but Halfmoon is a pretty low key suburban town... not exactly Compton.
Yet no assault charges. At least he doesn't keep his job. Wonder if he'll still be eligible for a pension?
