Bill Cosby needs a new Media Manager (and to stop raping) (1 Viewer)

He's going to be retried ... a mistrial is not an acquital.

Most here know that, but I wanted that clear for anyone who might be seeing on social media that Bill Cosby beat the charge.
Of course they're going to say right after the verdict that they're going for a retrial.  Doesn't mean they actually will go through with it.

 
Not sure if true but I heard it was also up to the victim as to if that would have a retrial. If she doesn't want to then no go.

Then what game are the prosecutor and judge playing when they talk to the press about it?
 

Prosecutors said immediately they would retry the case, and Judge Steve T. O’Neill said he would try to schedule a new trial within 120 days.

The new trial is very likely to draw the same judge and may again pull a jury from a county far from this suburban Philadelphia area. Constand, whom Steele praised as “showing such courage,” is expected to again be the key witness in the retrial.

Maybe not, but he sure won't if the DA doesn't insist that he's going to retry the case. I haven't heard the actual jury count.  If his lawyers talk to the jury and discover it was 11-1 for conviction, it could convince him to take a serious look at it because he might not be so lucky the next time. On the other hand, if they find it was 11-1 for acquittal, maybe the DA offers illegal distribution of narcotics and drops the assaults.

I am curious as to whether the jury-voting count is something that lawyers for either side might typically find out in advance of the general public. I honestly do not know.

Big case with a chance for re-trial - you want to know what evidence/arguments worked and what did not - it may impact how you approach the re-trial - albeit in front of new jurors.

But he said the seven men and five women on the panel were nearly evenly split after 52 hours of deliberations, a deadlock that prompted Montgomery County Judge Steven T. O’Neill to declare a mistrial on Saturday.

This is going to make a re-trial difficult to justify imo.  Now, its high profile so that helps, but this does not look like a case of a lone holdout - where a better jury pool might change the outcome.

The juror was the second to offer a window into the deliberation room of the case, and his account appeared to contradict the first. That juror told ABC News on Monday that 10 of the 12 panel members were prepared to find Cosby guilty on two of the three counts against him.

The juror who discussed the case Thursday said that at one point deep into deliberations, there had been a 10-2 vote to convict Cosby of drugging and sexually assaulting Constand, but that three panel members later changed their votes and wanted to acquit him.

Votes were split “up the middle: young and old, black and white, men and women,” he said.

That will encourage the prosecution.

Another juror reported that it was 10-2 in favor of conviction.

Norristown, Pennsylvania (CNN)Bill Cosby has been convicted of all three counts of against him in his indecent assault trial.

The jury reached its decision Thursday. The panel began deliberating Wednesday around 11 a.m.

Cosby was convicted on three counts of aggravated indecent assault for drugging and sexually assaulting Andrea Constand in a Philadelphia suburb in 2004. The 80-year-old former comedian faces up to 10 years in prison on each count, but would likely serve them concurrently.

The jury deliberated for more than 14 hours over two days to reach the verdict.

AP just tweeted that he launched into an expletive-ridden tirade at the prosecutor after the verdict was read.  I need to see a transcript of that.  He always worked pretty clean, I think this is the most shocking thing about this entire circus.

Montgomery County District Attorney Kevin R. Steele asked that Mr. Cosby’s $1 million bail be revoked, suggesting he had been convicted of a serious crime, owned a plane and could flee, prompting an angry outburst from Mr. Cosby, who shouted, “He doesn’t have a plane, you #######.”

 
I remember fondly listening to his album Wonderfulness as a boy. 

My fond memories aside I am glad that he will be held accountable for his crimes.  I hope his victims find some solace and some healing in the verdict and his eventual sentence.  Seems justice was a long time coming in this matter, too long, I am sure, for the many victims who have had to live with this all of these years.

I saw them on some channel last weekend.  I commented to my wife that it seems somewhat off that everything Louis CK has ever done has been scrubbed from Netflix and HBO, but Cosby Show was running all afternoon on TV Land (or whatever TF channel it was.)

Yeah, I might very well have. I just don't remember, just like one-quarter of the stuff I post here. I just saw an old Kanye/best album thread get bumped and was like, "I started that?" Too much incendiary booze in my life, my man.
