Well, the next guy this happens to because Mayweather isn't in prison probably will care.

The payoff is allowed for a civil suit. The prosecutor doesn't get to negotiate a settlement with the victims - he/she's in charge of protecting society.

It depends. If they're using confidentiality as leverage, then you go through a private attorney and don't call the cops. Also, once you're on the record with the cops as to what happened it makes it more difficult to call them off. Plus civil discovery will essentially be put on hold with an active criminal case.
