They had 4th and 4, not 4th and 70.Not from your own 30.So shouldn't you be trying to score one yourself rather than putting your D out to face a team that has already posted 38 points?It is if a tie breaker comes down to net touchdowns.

4. Best won-lost-tied percentage in games played within the conference.
5. Strength of victory.
6. Strength of schedule.
7. Best combined ranking among conference teams in points scored and points allowed.
8. Best combined ranking among all teams in points scored and points allowed.
9. Best net points in common games.
If you are making a play to try and win a 7-9th tiebreaker you are screwing the pooch. Especially when there is nothing you can do about the 6th tiebreaker Strength Of Schedule. You have a point, it's just not a good one.

What's your point?The demanding of more evidence is in reference to any NOTES associated with the illegal taping now or in the past.The RF deal was a part of the original complaint but got glossed over in the wake of the videotaping. And when Goodell announced the punishments he said he was still investigating the issue with the Pats. Bellicheat and Pats fans are the only ones saying it's over, Goodell has been investigating this even after he announced the punishment.
