Josh Gordon’s petition for reinstatement is denied

For weeks, the NFL had nothing to say about the potential reinstatement of receiver Josh Gordon. Now, the NFL is saying plenty.

According to Mary Kay Cabot of the Cleveland Plain Dealer, the NFL has denied Gordon’s petition for reinstatement. Per Cabot, Gordon can apply “later in the year.”

The report caps a 24-hour period in which protracted silence regarding Gordon ended in a major way. Gordon reportedly failed a drug test last month, and the league reportedly wanted to wait 2-3 months before reinstating him in order to see whether Gordon could stay clean during that time.

One source with knowledge of the application of the process for handling reinstatement requests after a minimum suspension of one year tells PFT that the issuance of a denial letter could mean that there was something more than one failed test, and that the league won’t simply wait another 2-3 months before reinstating Gordon. In at least one prior case, the NFL delayed reinstatement for a few months without issuing a decision denying the petition. By issuing a formal denial of the request, the door to his return is much more firmly and clearly closed.

Because a simple failed test would be a simple resolution.  There are no simple resolutions in this story, my friend.

What's going to happen here is that between now and August 1st, we going to get some workout photos on Instagram, some 'work hard' blurbs on Twitter, and a few :pray: emoji.

Then, August 1st, we going to get an application for reinstatement.  The next 60 days are going to be @Soulfly3 confidently discussing his upside, @Bayhawks laughing at him, (among many, many others), @Chaka trying to get everyone to take the high road, @Otis checking in to see how his guy is doing.  There will of course be the usual Johnny Protests around, that want to get into a geo-political discussion about legalization.  

Please do NOT engage these people.  

Soon after Gordon applies, the tin foil hat crew will show up, posting wild theories about why Gordon's application hasn't been processed yet, A and B drug samples, Goodell's clear hatred of Josh Gordon.

At some point, the application will be addressed.  I know what you thinking:  What happens then, Mr. Know-It-All?  

I have no idea.  This story is crazy.  

 
If true, that's like 100 days from now.  So he could still theoretically be reinstated for the 2016 season and play?  With all the "breaking news" of the past 24-48 hours, nothing has really changed.....
disagree, I now know I can cut him come june when are cuts are due. I honestly thought he would be cleared by summer, with this news I am not wasting a spot with him.

nah, i was operating under the assumption he was playing this year. Now i'm operating under the assumption he won't be.

 
CLEVELAND, Ohio -- Josh Gordon's petition for reinstatement from his indefinite drug ban has been denied by the NFL, a league source told cleveland.com.

The Browns' receiver can apply for reinstatement later in the year, the source said.

The NFL has no timeframe for when Gordon can reapply, but profootballtalk.com and NFL Network both reported that it's Aug. 1, which is right around the start of training camp.

It means Gordon's availability for the 2016 season is in serious jeopardy, because the league can still decide on his case "when appropriate'' after his application. Normally, they try to make such decisions within 60 days, but it's up the discretion of Commissioner Roger Goodell.

The league will need to see a serious commitment from Gordon to his program, including a possible stint in an inpatient rehab facility.

The news comes one day after Mike Garafolo of Fox Sports reported that Gordon had failed another league-administered drug test. Garafolo reported that Gordon tested positive for marijuana, and that both the A and B samples were diluted as well.

The amount of marijuana in the samples was less than the 35 nanograms required for a positive test, according to the report. But a diluted sample that contains traces of a banned substance constitutes a positive test for a player in Stage Two or Stage Three of the program. Gordon is in Stage Three.

Gordon, who was indefinitely suspended in February of 2015 for a positive alcohol  test and sat out all last season, had applied for reinstatement around Jan. 20, and the NFL generally rules on such matters within 60 days.

But Goodell said at the NFL Annual Meeting two weeks ago that he'd only meet with Gordon "if appropriate" based on an update he expected to receive from his staff in the next week or two. Garafolo reported that Goodell likely knew at the time that Gordon had failed the test.

Over the past month, the Browns have made it increasingly clear that they weren't counting on Gordon for the 2016 season. The tone changed shortly after the NFL Combine in late February, where Browns Executive Vice President Sashi Brown said the club would welcome Gordon back if he were doing the right things.

But at the NFL Annual meeting last month, coach Hue Jackson admitted that he was game-planning without the All-Pro receiver.

"I always learned something a long time ago -- you never worry about something you never had," Jackson said. "I've never had any contact with him, so I'm going to plan on what's in our building now and go from there."

That same day, Brown grew weary of questions about Gordon in a small group setting with local beat writers.

"I would just say probably enough Josh chatter," Brown said. "I know he's intriguing but really for us, we're focused on the guys that are on our roster and if Josh comes back, great, and if he doesn't, we're ready.''

On Monday, after reports of the failed test surface, Gordon took to Twitter to indicate that it was a non-story.

For the reading impaired, this means the earliest Gordon can apply for reinstatement is August 1. Meaning that the investigation process would start all over again from that point. This puts his availability for opening day in jeopardy even if he stays clean (which is always questionable to begin with).

He ain't playin this year. Even if he gets his life together and comes back in 2017, it'll have been 4 years since he was relevant on the football field.

Take what like a man? He can apply for reinstatement a month before the season starts. 

You have my absolute word, if he doesnt get reinstatement on that attempt, it's 100% over. No ifs, ands or buts. 

 
So he can apply on August 1st, which will lead to a several month review, which will reveal they need several more months to collect information.

With all this talk of the "NFL" looking bad here, I ask again, why don't the NBA and MLB look bad for their players getting popped for using weed?  Weird. 

The NFL looks bad, Gordon looks bad, and the soap opera continues, which the NFL seems to embrace actually.

I just told you. When he applies on Aug 1, and if it gets turned down, it's over.

My happiness does not hinge on Bayhawks believing whether or not my feelings on Gordon will change. 

I made my statement, and that's that. If you want to attach some sort of incentive to it, have at it. I'm game for whatever.
