Seems like lynch is going to trial and pleading not guilty. Wouldn't this save him from a suspension this season?

 
It certainly buys him some time and I've read that it could prevent a 2012 suspension, but I honestly don't know if it'll be enough to put off a suspension before late December. We're talking almost 6 months here. Would really suck for Lynch owners if he's handed a suspen around wk 14...

 
Anyone with lots of experience with how the legal system treats this if he pleads not guilty? Is this usually a very long drawn out process?

 
His DUI is in California, where the courts are very backed up (and things are getting worse in that regard).

In a civil case, it's pretty much impossible to get a trial date that is less than ~11 months after a complaint is filed, at least in San Diego.

Criminal cases should theoretically move faster because of the whole right-to-a-speedy-trial thing. I'm not sure how far out trial dates are typically set for DUIs when the defendant isn't insisting on speediness. My guess is there's a decent chance that Lynch's lawyer could string it out past the 2012 season if he wanted to, but that's just a guess.

 
From most of the stuff I've read anyway this is his first offense of the drug category, so it is not likely he would get a suspension anyway. That is what it seems like anyway. Only Goodel knows for sure though.

Right.First, he may not be convicted of a DUI. He may go to trail and be acquitted — or, more likely, he may plead down to a wet reckless.Second, if he is convicted, it may not be until after the 2012 season.Third, this appears to fall under the substance abuse provision of the CBA (according to Florio & Mort), not the personal conduct policy (where he has a prior offense). I believe that the penalties for first, second, etc., offenses under the substance abuse provision are governed by the CBA without a lot of discretion on Goodell's part. And I don't think a player can be suspended for a first offense (without aggravating circumstances). So even if he is convicted before or during the 2012 season, that doesn't mean he'd be suspended. (This is likely his first offense under the substance abuse policy. We don't hear about first positive drug tests, so it's possible that he's failed a drug test before. But it doesn't sound like it based on what he and his agent and attorney have said.)All in all, I'm personally assigning a fairly low probability to the chance that he'll be suspended this season.

FBG expert adp (ppr) for lynch is 65. Wouldn't this ranking be considered very low with the likelihood of no suspension?

IIRC, the wiggle room for Goodell (if he wanted to suspend Lynch) is that the CBA contains language for dealing with players designated as multiple offenders of the personal conduct rules AND/OR the substance abuse policies. Given that it's been 3 years since Lynch got in trouble for anything (at least that we know of), Goodell may not look to pursue anything. IF it is Lynch's first substance abuse policy infraction (the leauge does not release info on all infractions), he might catch a break. But at one point Lynch was investigated by the police for marijuana possession. I don't know if that led to anything by the NFL or not. Bottom line, at this point it's not cut and dry in either direction.

 
umm is it just me or does it seem illogical (even silly) to list a DUI as "substance abuse" infraction and not a "personal conduct" infraction?

boy the player assoc really pulled one over on the owners if this is the case

or maybe it was just an owner's concession so they could get something else

 
recently drafted Lynch late in one of the Anarchy leagues in the Mock Drfat Forum....I think since this is criminal he will play all year....had this just been a conduct thing (ala Ben) he might get suspended...the fact that he actually got "arrested" seems to work in the favor of Lynch and his fantasy owners....

and the icing is that with this hanging over his head.....he may not fall into the "I signed a big contract so I have no motivation" things others have mentioned....I am willing to bet there are some clauses in his new contract that will make it in his "best interest" to plays balls out this year since his current contract could be affected by what happens when this does go to trial....

I think you missed what I was saying . . . if it were only considered a criminal matter, then Lynch would almost certainly be suspended. But since it is considered substance abuse, that might save Lynch from suspension.

thanks David...I wasn't really responding to you specifically or discounting anything you said....just making a comment on how it relates to THIS season and a possible suspension...I understood what you were saying....if he gets convicted of a crime, but it is not really considered a criminal matter by the NFL cause it is trumped in the NFL's policies by "substance abuse" then that was some good negotiating on behalf of the players side...bottom line: I would imagine that it is in Lynch's best interest right now to NOT have this resolved in a timely manner....at least be able to play this season and more importantly get PAID for doing so....I think nothing gets resolved and no action is taken by Goddell until after the season....which leaves us with a motivated Lynch, who may have some things in his current contract that when he is found guilty or whatever, it may wipe out his current contract....therefore he will play hard realizing he may eventually be facing a suspension going into next year and he is going to have to be "so" good that a team is willing to not only sign him, but do so knowing he will miss a few games....that's what I'm going with anyway since I drafted him... :banned:

Yep - I got him at 5.10 in the 16-team Anarchy League 6 myself. Insane value that late, even if he only plays 12-13 games, let alone the entire season. RB 20 at pick 74 overall? He was taken immediately after such luminaries as Shonn Greene, Fred Jackson (who I actually like) and Frank Gore. :shock:
