Car accident questions w/ artpad illustrations UPDATE (1 Viewer)

Involved in a minor accident today. On a 4 lane highway, changing from 3rd to far left lane to second to left lane and got hit by car moving from left lane to second from left lane.

She tapped my driver's side rear door with her bumper. Her headlight was cracked and I have a ding near where i had another ding. Damage couldn't be that much.

Pulled over and exchanged info. My question is: is it even worth filing a claim? Quick discussion with lawyer friend and he says most likely outcome would be 50-50 fault. If that is the case then my rate would go up? Or do i file just in case she decides to, in order to protect myself? In my haste I completely blanked in getting her number so no way to get in touch with her. I own the car, not a lease. Her car was a beater. She is on parents insurance. To be honest I'm not sure if I'd even fix the ding more concerned if i need to cover my ### in case she files a claim.

Just got a call from my insurance company, she already filed a claim! C'mon. We have the same insurance company. When they called I gave them the ol', "oh hi. I was just about to call you guys."

You can still settle.

You can ask her to get and give you three estimates and you can choose one and pay it. Have her sign something and be done.

How many accidents and tickets have you had recently? Less then three moving violations or accidents in the past 3-5 years you should be fine.

Cops would tell me to call insurance and leave them alone. "We're pretty busy out here, champ." Can't call 5-0 out here for that unless someone is hurt I thought. I probably wouldn't have done anything about it but she was on her parents insurance and I'm guessing they called it in.

If I saw her coming in my drivers side mirror and literally said out loud "oooh, don't hit me" before she hit me, it's gotta be her fault, no? No way i could be at fault here. Damage is to my door!

 
No idea who is at fault, but that is the best use of ArtPad I have ever seen. Make sure you send it to your insurance company.

 
If you were in the lane, and she hit you with the front of her car I can't see how it would be your fault.
I'm not sure if I was all the way in the lane or 90% there. I would say with 100% certainty that I began my lane change before she did.

 
how fast were you going at time of the collision? the artwork is unclear on that.
I'd say about 45-50. There was slower traffic upcoming in my lane hence my decision to change lanes. The freeways were about to split as well and I wasn't sure if I needed to get a lane further to the left.

 
What are the odds I'm listening to Back Door Man by The Doors and get hit in the back driver's side door? Gotta be at least Five to One.

If we're talking a $1500 estimate, that's a different story and maybe you use insurance if you don't have/want to pay the extra rack to get it fixed.

If you could see her coming and did not take evasive action then you may be partially at fault. You might as well ask the insurance to assess your damage if your premium will go up anyway. I think they may give you a few hundred bucks even if your car only has a small dent.I filed a police report once. I was going straight in the left lane when the traffic light changed to green and the guy in the middle lane made a left turn into my car. A cop was in the intersection directing traffic and saw the whole thing.

In the spirit of safety i thought the only thing I could do was stay in my lane and pray she saw me in time. If I jerked it back into my old lane i think at the very least I would have had to jam the breaks. I could have killed everybody if I did that.

If she's at fault then your premium doesn't go up, get it fixed.

If you're partially at fault and your premium goes up then get it fixed.

So if it's determined she is at fault then I get an estimate and they cut me a check? No way i'd get it fixed if that was the case. if they determine 50-50, can I refuse payment in lieu of my rate not increasing? if it's my fault then I'm SOL anyway.

I think the only thing on your side is you both have the same insurance company. Otherwise, it is harder to get another company to agree you have zero fault.ETA: Some states have different rules. You may check on that first.

It's roughly 3 or more moving violations and/or accidents where you were deemed at fault in the past 3 years before your premium goes up. If you plow through a crosswalk full of kids and the bus they got off on all bets are off.

You should have called the police. Any type of accident on the road while driving, especially at that speed, is an automatic call to the police no matter what the damage. Forget the cars, what if she started complaining of some "neck pain"? It's not too late to file a report so I'd do that pronto. But, going to be hard to assign blame I'd think after the fact.

As pointed out above, find out the cost to fix vs. deductible. Depending on your insurance company, you can ask them what it would do to your rates if you filed and you're found partially at fault. Most can answer you before actually filing a claim. If you're not at fault at all (i.e. where the police report can help), then it won't touch your rates.

Finally, I'd wait until MOP and Tim weigh in before making any final decisions on what to do.

People stink, there's no guarantee if she said she wouldn't report it that she wouldn't. I guess if it's drivable you could wait and see what your insurance company rules on fault, etc. (I think) you can split fault, or either of you could be liable for the others' damages based on what the insurance company determines.

Worth a call to your insurance company to check further, they won't ding you for asking, only if they have to put money out on your behalf. They hate paying money.

I just did a state case search. He's clean.
I was told it could go up 30-38% after only one accident.

Drivable? It's same as before except for a ding in the door. I wasn't going to do anything but she filed a claim so now I gotta set the record straight.

Dude, save your breath. I think these people live in the sticks or have one up their ### with the call the Feds shtick when there isn't an injury.

Lol , the very first thing the cops ask is "Is your car is drivable? Yes? Move yo ####, ninja!!!

 
when I got in a car accident, we both drove to the nearest police station and filled out an accident report. you could still go and do that yourself.
