Don't talk to the police (1 Viewer)

Sound advice.

I am reminded of the Ron White comedy bit wherein one of the punch lines to a long story was that though he had the right to remain silent he lacked the ability to do so.

Good advice. My lawyer told me years ago.. If they find you standing over a dead body holding a smoking gun, don't say anything other than "I want my lawyer".

Even that may demonstrate intelligence and situational awareness which could be used against you. Better to remain silent, other than a few barks while you #### in your hand.

Actually, what is the appropriate course of action if you're being questioned? Obviously don't say anything, but after that? Assuming you don't already have a lawyer what do you do? How long can they hold you if you aren't talking? Etc?
"I want my lawyer" then wait for your lawyer.

cliff notes?
One of the best points, and he makes it very early on, is that it can not help you in any way to speak to the police.

"Anything you say can, and WILL, be used against you in court"

And nothing you say can or will be used FOR you.... it can't. It will be objected to as hearsay and the judge will say, "Sustained". So, zero upside.

If you just pushed somebody off a cliff, don't talk to the police.
Also, if you DIDN'T just push someone off a cliff, but the police suspect you pushed someone off a cliff, don't talk to the police.

Pretty much this. Even you if you're 100% innocent, you could mistakenly say something that makes you SOUND guilty. This could get you charged. Sure, you'll probably be found innocent, but only after you spend an obscene amount of money and lose your job defending yourself.

Don't you have to at some point request a lawyer?
Yeah, but I wouldn't do it while holding a smoking gun standing over a body while being recorded on a body cam.
Are you kidding?? That's the BEST time to do it! Holding a loaded gun, showing that you're not afraid to kill...Who's gonna turn down your request for anything at that point? Actually, requesting a lawyer in that scenario seems like small potatoes. I'd ask for a Lamborghini.

Spit it out, Atticus.
I have no idea what you're asking me to do here.

What if all you did after you were arrested is pray? Would that ever come up in court so it could influence the jury?

You always want to lead with "am I free to leave."
