"Marshall Trial Update X: Watley letter to Goodell

by Mike Klis on August 13, 2009

Done-Done!

This has to mean something to this case.

During cross-examination, Harvey Steinberg, attorney for Broncos receiver Brandon Marshall, asked Rasheedah Watley about the letter she wrote to NFL commissioner Roger Goodell.

The letter was dated July 29, 2008. The incident in question, remember was March 4, 2008. In the letter, Watley wrote that Marshall didn’t assult her on March 4, 2008, and that she was pressured by her family members to make the (battery) claims.

Watley responded to Steinberg by saying Marshall “begged” her to write it. “”It was a mistake,” she said from the witness stand. “”I shouldn’t have done that. I thought it would help Brandon.”

This can't be good for the plaintiff. A letter, written by her, totally contradicting herself? Not gonna do wonders for her credibility with the jury.

So basically she'll lie if you ask her to or she lied to begin with. One way or the other she isn't telling the truth which if you're a juror you certainly would have to take into account....

How absurd is this......we follow a court case so we can see if we need to make plans to have or not have one of our stud players.

LMFAO. Boy we are sick people.

Not me!! I hope he goes to jail for years!signed - the guy with Eddie Royal on his roster

Eddie Royal is better with Marshall on the field. Orton will not lock onto Marshall like Cutler, and Marshall draws a crowd allowing Fast Eddie to do his work.

at any rate here - wasn't Marshall suspended a game last year for this? Why would the commish suspend him 2 times for the same crime?

Not sure if that is true. Maybe in the old system with the old QB.But Royal is now playing in Marshalls position. Certainly would bode very well for Royal as the sure fire #1 for the Broncos.
Are you serious? Of course Royal is better with Marshall on the field. He is a dynamic receiver that can stretch the field like only a hndful of guys in the league. He demands double coverage often times pulling a saftey out of the play, further opening up the middle for Royal with cheese. Let's not forget who is the more talented receiver here. Sure, Royal could have more fantasy points this year in a Wes Welker type role, but please let's not ever act like Royal is the number 1 over Brandon Marshall. It's almost laughable. Wes Welker is the number 1 in NE too!! Sorry for the rant.

Living in the ATL and being BOMBARDED with all the Vick s### as of late (and not being a Falcons fan nor a Vick fan) I can say this...the Commish will do whatever he feels is appropriate. Long story short, if Marshall is deemed guilty look for another suspension tacked on. That is the new regime.

As a Marshall owner in only 1 league and Royal owner in many others... Fantasy Wise I was sweating that Marshall get BN'd for 4 games or even half the season, I hate women beaters. But after hearing this, I'm not sure what to make of it. Besides a bunch of witness that seem to be related to the woman, is there any other proof? Pictures, police report filed a couple of days later, anything like that? Also, if this woman did write that letter to the league on July 2008, why the hell was Marshall even suspended?

Summary of first day. Doesn't sound like she has any hard evidence, whereas the defense has some solid ground. I'll be shocked if he's convicted, even though I'm not convinced either way if he did anything or not.

ATLANTA, Ga. — By this evening, an Atlanta jury is expected to decide whether Brandon Marshall is a violent, abusive boyfriend or the victim of an extortion attempt by a disgruntled former girlfriend.

While the truth may lie somewhere in the complicated middle, those were the two disparate arguments presented by lawyers Thursday on the first day of Marshall's trial in Atlanta on a misdemeanor battery charge, the result of a fight with his former girlfriend on March 4, 2008.

Prosecuting attorney Robert Bembridge is expected to conclude the state's case against Marshall this morning before turning the trial over to Marshall's defense team, led by Denver-based attorney Harvey Steinberg. Marshall is not expected to testify.

The six-person jury should begin deliberations and return a verdict by evening, just hours before the Broncos kick off their first preseason game at San Francisco.

Whether the Broncos will have to play regular-season games without Marshall, the team's No. 1 wide receiver who had more than 100 catches in each of the past two seasons, could hinge on what those four women and two men decide.

If Marshall is convicted — it will take a 6-0 vote to find him guilty — he could face additional punishment from NFL commissioner Roger Goodell, who already suspended him for one game last season after his initial arrest on the domestic violence charge.

The prosecution presented four witnesses Thursday: the Atlanta police officer who responded to the initial 911 call to Marshall and Watley's downtown condominium; Watley's two younger sisters, who came to the condo after the fight; and Watley herself, who was on the witness stand for nearly two hours before Judge John R. Mather excused the jury for the day.

Watley said the fight between her and Marshall started when he saw a text message on her cellphone from another man, and escalated into a physical confrontation. Watley told jurors that Marshall pushed her, threw her over his shoulder, tossed her onto the bed and hit her in the mouth.

Under cross-examination from Steinberg, Watley admitted that she bit Marshall on the back and poked him in the eye during the altercation.

Watley also described, in detail, four other violent incidents with Marshall, two in Colorado and two in Atlanta.

"I couldn't tell you how many incidents," Watley said. "More than I can count on my hands."

In her testimony, Watley said it wasn't until after she and Marshall had broken up for good that she realized she had been in an abusive relationship. She wore a purple ribbon, the symbol for domestic violence awareness, pinned to her black blouse when she took the stand.

"I felt like he didn't know he was an abusive person," Watley said. "What he did to me was wrong. I want him to get help."

Steinberg, in his opening statement and in his cross-examination, tried to convince the jury that Watley was solely after Marshall's money by showing a $500,000 shakedown letter written by Watley's first lawyer and asking her about driving a 2008 Jaguar owned by Marshall.

"She knew how valuable that relationship was," Steinberg said in his opening statement.

Steinberg also tried to hurt Watley's credibility by presenting a letter Watley wrote to Goodell in late July 2008, in which she denied that Marshall ever abused her.

On the witness stand, Watley said she lied to Goodell in that letter because Marshall "begged" her to.

"I did that, in a way, to protect him," Watley said.

After Mather dismissed the jury for the evening, he listened to, then denied, a motion from Steinberg for a mistrial. Steinberg argued that Marshall was not getting a fair trial because Bembridge, in a question to Watley, mentioned that Marshall had been charged with false imprisonment in Colorado in 2007. The comment had been stricken from the record. Steinberg also argued Watley made inappropriate comments about Marshall's DUI arrest in Denver and about Marshall's March 1, 2009, arrest on a disorderly conduct charge — which was quickly dismissed — involving Marshall and his fiancee, Michi Nogami.

after reading that, I'll be surprised if all 6 find him guilty... I wouldn't. As soon as I see that 500k shakedown letter I would be out.

2 Wrongs don't make a right.

Marshall is truly a wild card at the moment as far as drafting goes. Looks like he'll probably get off on this one....but his behavoir pattern has been pretty consistent.

Probably a great value pick in a redraft league if he gets off....He'd have to drop considerable in a dynasty league to be worth the risk.

Whether or not she is a greedy extortionist really doesn't matter, what matters is whether or not Marshall committed the abuse. While I will grant you it certainly damages her creditability as a witness, Marshall has a long ongoing record of being involved in domestic disputes, some as recently as this summer with his new girl. That pattern can be just as damaging to Marshal's case as the letter is to the prosecution. But beyond that, your saying the letter in and of itself would be enough "proof" to vote not guilty if you were on the jury? Bad people can be the victim of a crime just as much as good people, it doesn't make it less of a crime.

Good points. My problem is once I know I can't trust her as a witness, it would be very hard for me to bring in a guilty verdict -- even though I would *think* he probably did something wrong, there would be a resonable doubt. It's basically a "he said, she said" argument, impossible to know how it went down with no credible witness, though perhaps there is enough supporting evidence, I don't know.

As long as there is no real evidence outside of her testimony multiple letters hammering her credibility should be enough for reasonable doubt.

Marshall owners breathe a sigh of relief... :lmao:

He is now free and clear. All legal troubles and suspensions are behind him. At least until the next time he gets into trouble with the law.

I think Stokley is playing the Welker role....Royal is Galloway.......

The numbers support the gentleman you are abusing. In the first game of his career when Marshall was suspended, Royal had 9 catches for 146 yards and a TD. In his other 14 games when Marshall was playing, Royal averaged 5.9 catches for 59.6 yards and0.29 TDs. Though it's a small sample size, it seems Royal is more productive when Marshall is not playing. Also, he didn't say that Royal is the number 1 over Marshall - he was saying he'd be #1 if Marshall was suspended.

I think he should go out tonight and celebrate at a strip club with plenty of alcohol. He should then show up at his new girlfriend's place aroound 4:00 a.M. and see what happens when she notices he smells like strippers.

Well you have to get out from the head butting w/McDaniels - and the fact that Marshall wants to be traded. Not sure I'd call this relief.

From a fantasy perspective, the best thing that could happen to Marshall now would be to get out of Denver. The biggest drag on his value wasn't this trial or his hip; it's swapping Cutler for Orton and Shanny for the McDumbo. Denver fans won't want to hear this but that team is heading toward a decline after a long run of being one of the better teams. As a Marshall owner I would love to see him get off that sinking ship.
