Found out my son is being abused. Update #696 (1 Viewer)

Or maybe they took grandma down to the station, shined a bright light on her face, and got her to spill. When there's missing kids involved, everyone's a suspect.

 
How do felony charges work? Is kidnapping a class A? Any distinction for parental abduction, e.g., just curious if Megan's Law amended that or made it a special kind of crime.

 
BTW had too much wine at dinner...I meant Amber Alert not Megan's Law

But Chet is onto it...was really swell of the cops to take the kids but not arrest the abductor

Dear Seahawk 17,

Thank you for contacting Senator Merkley regarding your child custody case. The Senator asked me to reply to you and tell you that he is sorry to hear of your situation. He has young children and can’t imagine how frustrating and worrisome this must be for you.

Although the Senator has no authority over the Oregon Department of Human Services, or any other state agency, he asked me to look into this for you.

In response to my inquiry DHS wrote:

When Seahawk 17 contacted our office he was waiting to hear back from the worker's supervisor who was out on Friday. I have contacted the supervisor who is calling him back today to help address his concerns.

Seahawk 17's case is a difficult one on many levels. One is custody of the children. Generally, DHS does not take custody of children when one parent is able to pursue custody of these children. Our office talked with him about seeking legal advice to pursue custody of his children.

Another issue is jurisdiction as the children are legal residents of Indiana, the field has followed through and been in communication with Indiana about their concerns.

Another issue is by statute the definition of "physical abuse" which states: Physical abuse includes an injury to a child that is inflicted or allowed to be inflicted by non-accidental means that results in harm. Physical abuse may include injury that could not reasonably be the result of the explanation given. Physical abuse may also include injury that is a result of disciplinary action or punishment. Often cases are on the edge, between inappropriate physical discipline and physical abuse. This makes it difficult to demonstrate "Immediate safety threat" which is needed for DHS to take custody of children.

Because this is a state, not federal, issue the laws vary from state to state. I urge you to contact an attorney in order to seek custody of your children. You should try the Legal Aid office in Deschutes County at (541) 385-6944 or 1-800-678-6944. They handle family law issues pro bono.

Seahawk 17: Your email was forwarded on to me. I cover many child welfare stories for The Oregonian. I'm not sure I have enough information to judge whether there's a news story to be done about your family's situation. These are often very complicated and time-consuming stories to tell, mostly because we're shut down by confidentiality issues. (Unless there's an arrest or the case somehow gets in a public courtroom).

I do have a suggestion, though. It sounds like there's certainly an indication that your child has been abused but no certainty. That leaves you in a no-win situation. My advice would be to get the psychologist and caseworker (or supervisor) on the phone with you or in a meeting so that you all can determine if there HAS been abuse. If that's the case...it would seem like reporting this to the police is the best and safest option for you and your child....just a thought.

I met the cops at a camp ground not a bar, and posted to live about it. :shrug: Thanks :unsure:

This actually has me going the other way. Every one of those addys and phone #s can be Googled; I think it would have been a masterful stroke to have one or two that were not. This actually is starting to remind me of that Seinfeld episode where George begs out of a Susan Ross Foundation gig by saying he has to go to his house in the Hamptons. They call him on his bluff, and they go all the way out to the east end before he cracks.The level of effort in this thread is quite impressive, however.

He was "merely" being served -- they weren't looking to arrest him. Secondly, taking the kids was "merely" enforcing a court order.I take from this story that custody-related orders are not hard-### rules that gets a parent summary prison time for violation. Must be some wiggle room/discretion.

I have taken the advice of many on the board and quit posting about what's going on. Things will be decided in court, so when it's done I will update.
