I assume they are going to request extradition... This could put a strain on US/Italy relations.

I believe that - under the treaty - US only has to extradite if she she would have been convicted under the laws of the US also (or something like that). In this scenario, she can argue that this new trial would not be allowed under double jeopardy laws in the US.

That's a pretty good reason not to extradite.

Well, he is an Italian citizens so that makes his situation different from Knox. He was caught today trying to leave the country so from that standpoint it seems odd he did come back. I believe he stays out of jail until the Italian Supreme Court hears the appeal.

She was acquitted of the crime for which she was sentenced upon re-trial. Once you are found not guilty you can not be re-tried for that crime. You only get so many bites at the apple. I am pretty sure that if Italy pursued extradition, I don't think they will, that her lawyer could make a solid case against it and win. That is why she came back here. That is why her lawyer said she would not go back to Italy. She is pretty safe right where she is.
