On Christmas Eve I attended an impromptu holiday party that started with dinner but rolled into going to a friend's house. He had some special whiskey made by a local distillery and they had delivered 10 cases of it that day. It was late and I was pretty sober, but we hit that whiskey hard and fast. I left with 3 other people who had all left their cars at the restaurant a few blocks away. We all drove home...except I got pulled over about 3 blocks from my house (the drive home is about a mile and a half).
Guy who pulled me over was specifically hired by my little town to make DUI arrests, since they are very lucrative. The guy targets any car in a parking lot of a bar, follows them and makes up bull#### reasons to pull people over. I've been pulled over by this guy 3 times before, but was never drinking. I just go out to dinner a lot because I'm a bachelor. When I drink, I usually Uber (who wouldn't, right)? This time I'm ####ed.
I pulled some lawyer #### during the stop...asked if I was free to leave several times, refused all questions, etc. No field sobriety tests--he didn't even ask. I ended up getting my truck impounded and taken to the station in handcuffs. I immediately lawyered up, but there was a delay talking to my attorney. Cop got frustrated because he's under the mistaken belief that he has 45 minutes to give me a breathalyzer or he can't. He ends up refusing to give me privacy while I talk to my lawyer, and then hangs up on her before I'm done. I blow a pretty surprisingly high BAC.
Washington has two parts to a DUI- the criminal proceeding and the licensing issue. The criminal side come first. My lawyer plead me down to negligent driving, so I took it, even though she thought we could get the breathalyzer excluded. Then I have to wait 5 months for the hammer to come down from the department of licensing. These guys are brutal. The law is a one year suspension, SR-22 insurance for 3 years, and your best outcome is a reduction to 90 days with an blow-and-go that costs $1000 to install and $150 a month. When you reapply after your suspension, you need to pay a bunch of fees. My lawyer tells me I should expect the 90 days + insurance hit.
I got the order today after months of dreading getting my mail. The hearing examiner wrote 4 pages about this cop misrepresenting the law, violating my rights, and screwing with attorney-client privilege. He tossed both the breathalyzer and the police report, so with no evidence against me--complete dismissal.
