JPP suing Shefty and ESPN....LWYRUP (1 Viewer)

This is a slipper slope indeed.  If a nurse tech making 8 bucks an hour finds out that a celebrity is in the hospital and can take a few photos with their cell phone and sell them quick for money it is going to happen again.  Also, if  a reporter can publish any healthcare records/pictures with no ramifications what is to stop me?    Sure the hospital can be held liable, but that still doesn't protect the patient from having their medical information shared.  Will be very interesting to see how this plays out.

That "lawsuit" may have been an enforcement action by CMS for the HIPAA violation.  There is no individual right of action under HIPAA, so JPP couldn't sue the hospital (or anyone else) for that violation. If he sued the hospital it would have to be under a breach of confidentiality claim based on Florida law.  Disclaimer: I haven't researched FL law, but I am assuming they have such a medical confidentiality requirement (as Pennsylvania des).

If a hospital employee released his medical records to ESPN, it's going to play out by a court ordering the hospital to pay a bunch of money.

One.  And she's not really a nurse, she just walks around in a nurse's outfit and says "stat!" all the time.  But she's a non-union janitor.
