Kiss on the cheek triggers trouble for same sex couple on Hawaiian vacation

Los Angeles (CNN)What started as a kiss inside a grocery store on an island vacation landed Courtney Wilson and Taylor Guerrero in jail and stuck far away from home without money for months, they say.

It was supposed to be a relaxing holiday in the place that feels closest to paradise -- Hawaii. The women in their 20s had been dating for two years and wanted a break from their daily grind in Los Angeles.

Then came the kiss at a Foodland store in Honolulu.

"We were holding hands and I was kissing her cheek," Guerrero said. "We were just happy to be out here," Wilson chimed in. "We were just being goofy," Guerrero added.

They were interrupted by yells and saw two people -- one a man in uniform.

"They called after us and told us basically you can't do that. Take that somewhere else," Wilson said. She said she thought it was just a couple of rude random guys. So the women went about buying their snacks.

Calling police on police

But when they made their way to the checkout counter, the man in uniform, off-duty police officer Bobby Harrison, followed them.

"He told us that he was going to find the manager he was going to sign a trespass form and that we were no longer going to be allowed in any Foodland establishments because of the conduct of our behavior. So, being confused as to what exactly we did and how that was just I called the police myself," Wilson said.

CNN has reached out for comments from Officer Harrison.

After Wilson called 9-1-1 saying an officer was harassing her, the situation escalated, she said. Wilson claimed she tried to walk outside to find the store's address to pass on to police, but Officer Harrison grabbed her and wouldn't let go.

Then her girlfriend tried to intervene, getting between the two.

While she talked to 9-1-1, Wilson said she tried to walk outside, and Officer Harrison grabbed her and then pushed her girlfriend.

"He would not let go of her," Guerrero said.

Exchange of punches

Then Guerrero fell and hit her head on the counter, Wilson said. A tussle ensued. Guerrero said the officer punched her in the face when she tried to push him off her girlfriend.

They also dealt blows themselves, kicking and pushing Harrison, and hitting him in the face, Wilson and Guerrero said. His glasses broke. It ended with the two women in zip tie handcuffs and an employee holding them down.

When police they had called showed up, officers arrested Wilson and Guerrero on charges of assaulting an officer, the women said.

They spent two days in jail and spent all their vacation money to bond out, they said. They were told they would have to check in every couple of weeks with the bail bondsman until their initial court date.

Stuck, no money

But with no more money they were forced to stay in Hawaii. Wilson and Guerrero found a friend of a family member who took them in for a while, then a stranger they met who did the same, but eventually they ended up on the streets until they found temporary jobs.

They are now staying with co-workers they hardly know, they said.

"It has been really really tough, but so many good people have helped us," Wilson said.

About five months after being arrested suddenly, they were free to go.

The women filed a civil suit against the city and Officer Harrison. The court documents said that the court dropped the criminal case against them "with prejudice," which means police cannot re-file on the same incident.

Officer 'on full duty'

The police department has responded to the civil lawsuit in a statement.

"The Honolulu police department opened an internal investigation based on the allegations in the lawsuit. The officer has 26 years of service. The officer is currently on full duty," it said.

The women say there may have been surveillance video of the incident, but that they were told the tapes went missing. CNN contacted the store for comment, but is has not responded.

Wilson and Guerrero finally have enough funds to buy their plane tickets out of Hawaii. They never thought they'd be so happy to be able to leave what they once considered paradise.

I am the biggest gay rights advocate in the world but something doesn't sit right with this story

I cannot believe this entire thing was based only on a kiss on the cheek and I am confused to why not one family member chipped in to get them home. You'd think that they could scrape together $500 or whatever to get them home

 
They need to return to Hawaii with Morgan and Eastman from the Walking Dead and take care of Mr. Harrison. Perhaps put him in a cage and starve him to death for 47 days.

The part of the story that seems odd to me, if true, is they were told the tapes went missing. Other than that, parts of the story have gaps...or holes.

 
Was it that didn't have a return flight set up for their vacation or that they would need to get back to HI and wouldn't be able to if they left?

I'm sure they could have received money to go home, but it reads as if they needed to stay on the island until their court date. Not sure how long that was, but it's not a couple days.

If it was the cop vs them- yea, but when there is witness who gives their account (seemingly unbiased) then I am going to go with the witness over the couple that is painfully obviously dressing up their version to a ridiculous level.

Multiple witnesses maybe. One witness could very well be biased. One thing though, the blonde admits to hitting the cop first. That alone justifies them being arrested for assault on an officer.

The brunette was being arrested. The blonde did the punching. You punch an officer, you get arrested. Off duty or not, especially if he's identified himself as an officer and/or is in uniform, both of which I believe are true in this case.

LOL tapes. I seriously doubt there are any stores still using security cam systems that record to tape. It's all DVRs. I worked for a DVR/NVR manufacturer in tech support and we would often get calls where there was an incident but it didn't get recorded as they hadn't even looked at their DVR since their last incident and it locked up and needed to be rebooted or something. Or... the incident happened 3 weeks ago and they're just now getting around to asking for help to back it up and their DVR only stores 20 days of footage.

What's most likely to me though is that the footage didn't corroborate the officer's story as much as the HPD would like, so it disappeared.

I didn't see her admit hitting him. Wasn't it framed something along the lines of "that is when he was hit in the face".... phrases like that make me less inclined to believe your story because you are trying you best to hide what actually happened.

 
I'm having a hard time deciding who to believe here. If the two women would reenact the kissing and bottom-grabbing that precipitated all of this, perhaps I would be in a better position to reach an informed opinion.

what I would have said vs what the cop said

"I noticed the two defendants were in an embrace with one another. Inappropriately all over each other in a long, heated kiss in the back of the store. After I told them to stop I walked toward them because they wouldn't stop. In my opinion it was lewd conduct in what they were doing. I wouldn't want my children to see that."

I hate being so anti-authoritarian and all. But what behavior do we really want to encourage state actors to police? Will we break down into complete anarchy if we don't police every little infraction? Heck, maybe so. I've seen those "stop a d@uchbag" videos from Russia, which appear to show that drivers in Russia do whatever the f$ck they want, regardless of their fellow citizens, or safety, or the law. It's like a colder, bleaker, Mad Max there. Maybe if we didn't have such uptight police here, we'd eventually break down into similar lawlessness and ridiculousness. Because people are . . . well, people. God I hate people sometimes.

Will we break down into complete anarchy if we don't police every little infraction? Heck, maybe so. I've seen those "stop a d@uchbag" videos from Russia, which appear to show that drivers in Russia do whatever the f$ck they want, regardless of their fellow citizens, or safety, or the law. It's like a colder, bleaker, Mad Max there. Maybe if we didn't have such uptight police here, we'd eventually break down into similar lawlessness and ridiculousness. Having been in Moscow and been in vehicles with native Russians- this is absolutely the case.

Traffic? Nah- not if there is a sidewalk (I assum there was a sidewalk... it was winter time, so maybe there was not even a sidewalk there).

"Did get hit" not "I punched him"... I am always suspicious when someone tries to spin something like that and you are not a lawyer. It is an indication that other spin is happening and likely outright lies on something harder to prove (broken sunglasses easier to show vs. he said this to me)

Who the #### else would have hit the cop? She's trying to push him off, "but he's a big dude" followed by he got hit, I broke his sunglasses, he did get hit in the face. There were 3 people there, the cop and the 2 girls. One of the girls was apparently in a choke hold and unable to do anything. Other girl says she pushed the cop, then he got hit in the face. He punch himself? When she broke his sunglasses had they fallen on the floor and she decided to go stomp on them being the crazy anarchist she is?
